RE: SUBMITTING TO THE QUALIFIED REGISTERED ELECTORS OF THE COUNTY
OF WELD, STATE OF COLORADO, AN AMENDMENT TO SECTION 2-4 OF
ARTICLE II OF THE HOME RULE CHARTER FOR WELD COUNTY
CONCERNING SERVICE DISTRICTS
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, pursuant to Section 17-3 of Article XVII of the Home
Rule Charter it is required that this Board call an election to
consider an amendment to the Charter when presented with a
petition proposing an amendment, signed by at least 5% of the
total number of votes cast at the last general election , and
WHEREAS , a petition for the amendment of Section 2-4 of
Article II of the Home Rule Charter for Weld County was submitted
during the regular Board of County Commissioners meeting of
September 10 , 1986 , and
WHEREAS, Mary Ann Feuerstein, Clerk and Recorder for the
County of Weld, has reviewed said petition and found that the
petition is proper in form and contains sufficient signatures to
meet the requirements of Section 17-1 (1) (a) of the Home Rule
Charter for Weld County, and
WHEREAS, Section 2-4 of Article II of the Home Rule Charter
for Weld County currently reads as follows:
"Section 2-4 -- Service Districts.
The County shall have the power , when authorized and
permitted by law, and requested by a district, to
provide functions and services within existing service
districts. New service districts may be created only
after the purpose and boundaries of such district have
been submitted to and approved by a majority of those
voting electors living in and owning property in the
district. The procedure for designating and
establishing special districts and submitting the
question to the voters shall be established by the
Board.
Special districts may be created under such laws as are
now in effect or may hereafter be adopted.

The County shall have the power to charge, levy and
collect such taxes and other revenues as may be
authorized or permitted by law or this Charter within
such service districts for the support of district
functions and services. "
WHEREAS, if amended , Section 2-4 of Article II of the Home
Rule Charter for Weld County will read as follows:
"Notwithstanding any other provision of the Weld County
Home Rule Charter to the contrary, a service district,
special district, special taxing district, public
improvement district, a local improvement district, or
other district which may have the power to levy a tax or
impose a lien upon real or personal property shall be
formed and created only after the purpose and boundaries
of such district have been submitted to and approved by
a majority of the taxpaying electors living in or owning
property in the proposed district. "
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of Weld County, Colorado, that:
1 . At the next general election to be held on November 4,
1986 , there shall be submitted to the qualified
registered electors of the County of Weld , State of
Colorado, for their consideration of approval the
following amendment to Section 2-4 , Article II, of the
Home Rule Charter for Weld County:
"Notwithstanding any other provision of the Weld County
Home Rule Charter to the contrary, a service district ,
special district, special taxing district, public
improvement district, a local improvement district, or
other district which may have the power to levy a tax or
impose a lien upon real or personal property shall be
formed and created only after the purpose and boundaries
of such district have been submitted to and approved by
a majority of the taxpaying electors living in or owning
property in the proposed district. "
2 . Each elector voting at said election and desirous of
voting for or against said amendment shall cast his or
her vote as provided by law either "Yes" or "No" on the
proposition: Shall Section 2-4 of Article II of the Home
Rule- Charter for Weld County be amended to provide that
a service district, special district, special taxing
