The submitted materials are in compliance with the application requirements of Section 24 . 7 of the Weld County Zoning Ordinance. 2 . It is the opinion of the Board of County Commissioners that the applicant has shown compliance with Section 24 .4 .2 of the Weld County Zoning Ordinance as follows: a. This proposal is located within the urban growth boundary area of the Town of Erie and is consistent with the Weld County Comprehensive Plan ' s Urban Growth Boundary Goals and Policies. The Town of Erie, in a letter dated April 23 , 1988 , indicated 880456 / .� Page 2 RE: USR - SMITH that the proposal is compatible with its Comprehensive Plan . b. The proposal is consistent with the intent of the Agricultural Zone District in which the use would be located. The proposed use is a home business and is provided for as a Use by Special Review in the Agricultural Zone District. c . The uses permitted will be compatible with the existing surrounding land uses and with the future development of the surrounding area as permitted by the Weld County Comprehensive Plan. Uses on surrounding properties include an egg farm, residences, and row crop farming. d. No overlay districts affect the site. e. Special Review Development Standards will provide adequate protection of the health, safety and welfare of the neighborhood and County. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the application for a Site Specific Development Plan and Special Review Permit for a home business (cultured marble business) in the A (Agricultural) Zone District on the hereinabove described parcel of land be , and hereby is, granted subject to the following conditions: 1 . The attached Development Standards for the Special Review Permit be adopted and placed on the Special Review plat prior to recording the plat. 2 . The Special Review activity shall not occur nor shall any building or electrical permits be issued on the property until the Special Review plat has been delivered to the Department of Planning Services Office and the plat is ready to be recorded in the office of the Weld County Clerk and Recorder. 3 . The septic system for the proposed use shall be inspected and evaluated by a Colorado Registered Professional Engineer, according to the Weld County Individual Sewage Disposal Regulations. 880456 Page 3 RE: USR - SMITH 4 . The Special Review activity shall not occur until the applicant/operator has met the requirements of the Weld County Building Code Ordinance and the Dacono Area Fire Protection District. 5 . Prior to recording, the Special Review plat shall be amended to show the correct legal description of the Special Review site. 6 . Within 180 days following approval by the Board of County Commissioners , an Air Emissions Permit shall be obtained from the Colorado Department of Health, Air Pollution Control Division. 7 . The applicant shall supply the Weld County Office of Emergency Management with a list of chemicals and quantities of chemicals stored at the site. The Site Specific Development Plan and Special Review Permit is for a home business (cultured marble business) in the A (Agricultural) Zone District as submitted in the application materials on file in the Department of Planning Services and subject to the Development Standards stated herein. 2. Approval of this plan may create a vested property right pursuant to Article 68 of Title 24 , C.R.S. , as amended. 3 . No outside storage of materials associated with the Special Review Permit shall be allowed. 4 . The Special Review site and improvements shall conform to the requirements of the Uniform Fire Code, 1985 Edition. 5 . All construction on the property shall be in accordance with the requirements of the Weld County Building Code Ordinance. 6 . The property owner or operator shall be responsible for complying with the Design Standards of Section 24 . 5 of the Weld County Zoning Ordinance. 7 . The property owner or operator shall be responsible for complying with the Operation Standards of Section 24 . 6 of the Weld County Zoning Ordinance. 8 . Personnel from the Weld County Health Department, Dacono Area Fire Protection District , and the Weld County Department of Planning Services shall be granted access onto the property at any reasonable time in order to ensure the activities carried out on the property comply with the Development Standards stated herein and all applicable Weld County Regulations . 9 . The Special Review area shall be limited to the plans shown herein and governed by the foregoing Standards and all applicable Weld County Regulations. Any material deviations from the plans or Standards as shown or stated shall require the approval of an amendment of the Permit by the Weld County Planning Commission and the Board of County Commissioners before such changes from the plans or Standards are permitted. Juline Bates, a neighbor, voiced concerns about the amount of traffic to be generated and the safety of children in the neighborhood. After further comments by Mr. Barnhart, Commissioner Lacy moved to approve this request, subject to the seven Conditions and ten Development Standards contained in the Planning Commission recommendation. Seconded by Commissioner Kirby, the motion carried unanimously. This Certification was approved on the 20th day of June, 1988. Introduction The following is an application and request for a Use By Special Review for a home business within the (A) Agricultural District located in the southwest corner of Weld County, Colorado. The applicant, Mrs. Sarah Ann Smith, wishes to move from her Adams County residence to the property and also relocate her present cultured marble business (bathroom vanity tops and shower/tub sur— rounds) to an existing accessory building on the property. She and her hus— band purchased the 2.9 acre property in May, 1987 with the intent of operating a home business on the property. His illness and untimely death in March, 1988 hindered the completion of this goal. B. Product and Manufacturing Description The proposed business activity is a small scale manufacturing operation in which bathroom counter tops and shower stall and bathtub surrounds are pro— duced for wholesale and custom retail distribution. The products range in size from 22 by 24 inches to 22 by 120 inches for the vanity tops and 30 by 30 by 84 inches to 30 by 60 by 84 inches for the shower surrounds. Because each product is made individually, variations in design and size are endless. The operation presently sells wholesale to several H.M. Woods stores in the Denver area and Surplus Plumbing in North Denver. In addition, the company supplies cultured marble products to several local contractors and word of mouth customers for private installations. The cultured (man—made) marble products are manufactured from a mixture of 30% polyester resin and 70% powdered marble or limestone (calcium carbonate) with %b M.E.K.P. (methyl ethyl ketone peroxide) used as a catalyst to harden the mix— ture. A variety of titanium dioxide based pigments are also used to add color to the products; acetone is used for cleaning tools and equipment. The chemi— cal ingredients and manufacturing process are identical to those found in fib— erglass industry with the exception that marble dust is used in place of glass matting. Like most chemical products used in home, farm and industrial activities, many of these ingredients can be toxic if care is not taken in their storage and handling. Adequate precautions are taken by the workers during the manufac— turing process. These precautions include the use of ventilation fans in the mixing areas, proper raw material storage and the wearing of personal protec— tion devices such as safety glasses, dust masks and protective clothing. The final products are non—toxic and safe to use with potable water supplies. The manufacturing process involves spraying a mold of the desired shape with a liquid polyester paint or sealer. The polyester resin and powdered marble mixture is poured into the mold and allowed to cure. The finished product is then removed from the mold and stored for a day to finish hardening. All of the manufacturing operations take place indoors. This includes stock piling of both raw materials and finished products. Separate rooms will be required for an efficient operation: a preparation room for mold waxing and mold set up; a mixing room for chemical/material storage and preparation; and a finishing room for product curing and storage. The present operation employs one full time worker plus Mrs. Smith as manager. Current product output is approximately four to five vanity tops per day or one shower/bath surround and one or two vanity tops per day. With the relocation of the business to the Weld County property, it is antici— pated that an additional employee will be needed for a more efficient oper— ation. Three employees including the owner/manager will be the maximum number of employees given the present mold inventory. It is unlikely that additional molds and equipment will be purchased or employees added in the foreseeable future to expand the operation. C. Need of Proposed Use The proposed business activity on the property will be the primary source of income for the applicant. Considerable effort and expense has been made since 1985 to start the business. Much of that effort was the result of hard work by the applicant's late husband. She wishes to continue with the business. D. Past, Present and Surrounding Land Uses The property was formerly used as a poultry farm, similar to other operations in this area of Weld County. A large poultry barn (32 by 146 feet), small pole shed ( 11 by 16 feet) and small poultry feeder still remain on the prop— erty along with a single family house built in 1973. The area around the house is a landscaped yard with the remaining portion of the property being undeveloped and vacant. At the present time, the applicant's youngest son is living in the house. Mrs. Smith is still residing in the Broomfield area and is in the process of sel— ling the family home before moving to the property. Since the purchase of the property, the family has been cleaning up buildings including the removal of much of the poultry equipment from the barn and weeds on the grounds. The property had been in foreclosure and was vacant for some time. The surrounding properties to the north and south are of similar size and character with single family residences and several outbuildings on small acreages. The Hilltop Egg Farm is located immediately to the north and is an operating poultry farm and residence owned by Lothar and Herta Guenther. The property to the south is used as a residence for Ainslie and Ailine Bates. —2- 880456 Smith Property Use by Special Review April 14, 1988 The proposed business use within the applicant's outbuilding is approximately 140 and 230 feet respectively from the two adjacent residences. Adjacent properties to the east and west are vacant agricultural fields. The property is within the Town of Erie's Urban Growth Boundary, but approxi— mately three miles from the incorporation limits. Preliminary discussions with the town's planning commission chairman indicate that the proposed home business use will probably be acceptable. The town has a home business ordi— nance which encourages home occupations. E. Proposed Improvements and Existing Utility Systems No major on-site improvements or additional outbuildings are planned for the proposed business activity. Interior modifications are planned for the exist— ing outbuilding (former poultry barn). These include several interior parti— tions, electrical wiring improvements, extension of a water service line from the existing residential structure, a compatible heating and ventilation sys— tem for the mixing room. These improvements will be completed in accordance to the County building permit process and will conform to all applicable building codes. Approximately half of the existing barn will be used for the cultured marble operation with the remaining area of the barn to be used for family storage and work areas. The interior partitions will create an office, receiv— ing/loading area, mixing room, preparation room and finishing room. The existing utility systems on the property are adequate to serve the pro— posed special use since the operation uses very little water in the manufac— turing process. Water is provided by the Left Hand water Supply Company thru a 3/4 inch residential tap located within the Weld County Road 7 right of way. Water to the proposed business in the converted poultry barn can be supplied thru the existing tap providing that a request is made to convert from the residential rate to the business and light commercial rate. The attached let— ter and Schedule of Policies and Rates from the water company provide addi— tional information. There is an existing septic system on the property which was inspected by Weld County Department of Health in April of 1987. A copy of the results of the inspection is attached with this submittal. Both electric power and gas service are available on the property. It is anticipated that wiring improvements will be made to the barn and that a gas line will be extended from the existing house to provide heating for the structure. F. Neighborhood and Environmental Impacts Impacts to the surrounding properties and neighborhood from the proposed home business will be negligible due to the nature and size of the operation. The -3- 880456 Smith Property Use by Special Review April 14, 1988 proposed manufacturing operation will be confined to the existing barn and away from residential areas. There are no anticipated noise impacts to the surrounding neighborhood. The manufacturing operation is basically a quiet operation with no large indus- trial machines. Further, the operation will be conducted entirely within the converted poultry barn and during the daytime hours. Storm water runoff will not be increased because the will not be an increase in the size or amount of impervious surfaces, i.e. paving or buildings. On—site fire protection measures will be taken to reduce the risk of fire to the buildings or surrounding properties. These include proper storage and handling of the raw materials and the availability of on—site fire extinguish— ers. The property is in the Dacono Fire Protection District with the fire house located in Dacono approximately 9 miles away; the estimated response time is 12 minutes. According to the District Fire Chief, Mr. Bob Fuss, the residents of the district are being asked to approve the funding of a new fire house to be located at 175th Avenue and Weld County Road 7 in a bond election on May 3, 1988. If approved and built, the new fire protection facility would be within a quarter mile of the proposed home business. Chief Fuss was optimistic that an adequate fire protection plan could be developed for the home business once he knows more details of the raw materi— als, final product and manufacturing operation. Other similar plans have been developed for small manufacturing operations in the area including that of a small wood furniture manufacturing business. There will be a minimal increase in traffic on the County roads primarily due to the arrival and departure of the employee, customer and supplier vehicles. It is presently anticipated upwards to be 4.5 to 6 employee vehicle trips per day will be added to Weld County Road 7. A vehicle trip is defined as a one way trip to or from the property. The probable route for most of the vehicle trips will be south from the property on Weld County Road 7 towards State Highway 52. As a point of comparison, these traffic projections would be roughly the same as the number of vehicle trips generated by an addition single family house on the County road. In addition, approximately 6 to 11 trucks ranging in size from small pickups to two ton truck will be added to the traffic volume of the County road. This will include both the delivery of raw materials and the pick up of the final products. The increased storage areas of the barn will help reduce the number of delivery trucks since raw materials can be purchased in larger quantities. The present operation requires one material delivery per week; it is expected that this can be reduced to one delivery every two weeks. The truck traffic will be similar to the agricultural truck traffic on the County. The exception is that there will be no large semitrailer trucks which are often associated with grain and animal hauling. -4- 880456 Smith Property Use by Special Review April 14, 1988 There are no anticipated waste, stockpiles or outdoor storage areas associated with the proposed operation. All storage of both raw materials and final products will be stored within the existing barn and out of view from the sur- rounding properties and County Road 7. Disposal of all wastes associated with the operation is currently being made at a local land fill with a covered pickup truck. The proposed operation will continue this practice. Wastes include excess and cured resin/marble dust mixture, paper and plastic from raw material bags, pigment containers and resin barrels. The ends of the barrels are removed so that the barrels can be crushed and buried. Approximately one pickup truck load of solid waste will be generated per month by the operation. Because the proposed operation will be contained within the existing outbuild- ing, no special landscaping treatments, erosion control measures or reclama- tion procedures will be required either before the operation starts or after it stops. There are no known flood or geologic hazards on or near the site; the property is not located within the Weld County Airport overlay district. Soils on the property are primarily Nunn loam with 1 to 3 percent slopes. This soil type is rather typical in this area of Weld County and is considered a important agricultural soil for both irrigated and non—irrigated crops. The soil type will have no bearing on the proposed business and the manufacturing operation will not contaminate the soil. G. Schedule of Proposed Use The applicant wishes to start construction of the necessary improvements for the operation immediately following the successful completion of this Use by Special Review Procedure. It is presently anticipated that the operation itself could begin within 30 days after all necessary permits have been obtained and finalized. H. Comprehensive Plan Compatibility This home business proposal is compatible with the goals and objectives of the Weld County Comprehensive Plan in several ways: 1. The proposed operation will help to expand and diversify the Weld County economic base by relocating two, non-agricultural related jobs into the County. It will also create an additional job in the near future. 2. The proposal will restore the previous productivity of the property, establish a permanent occupancy at the residence and make improvements to the existing buildings. The property was in foreclosure by Standard Federal Savings and Loan Association prior to the purchase by the applicant. -5- O45 Smith Property Use by Special Review April 14, 1988 3. The proposal will maintain the rural character of the area and preserve the agricultural productivity of the County. The proposed business use will modify and recycle an existing agricultural building without creating further impacts to the property or land. The property was divided into the small 2.9 acre parcel many years ago, so the proposal does not contribute to the reduction or subdivide any prime agricul- tural lands of the County. Further, due to its present size and con- figuration of the property it is not and has not been under cultiva- tion. In addition, the proposed business use will preserve the poultry barn and as well as the rest of the property for possible future agri- cultural reuse. 4. The proposed home business will not contribute to urban growth outside the Erie urban growth boundary area. The utility systems are already in place and the proposed operation will not adversely burden these systems. Further the proposal will not encourage additional commer- cial, industrial or companion businesses to locate in the neighborhood. 5. The proposed use will have minimal impact to the existing transporta- tion system of the county. The increased car and truck traffic will be within the traffic standards of residential and agricultural uses. 6. The proposal is consistent with environmental goals/policies of the County. The operation will conform to all applicable Federal, State and local environmental regulations and laws. I. Consistent with Agricultural District and Surrounding Properties Home business is allowed by special review within the (A) Agricultural Dis— trict of Weld County. While the zoning regulations do not specify the type of allowed home businesses, the intent is for small scale entrepreneurial oper— ations to be conducted at the homes of the residents within the district. This is the basic nature of the agricultural industry and the heritage of our culture. The proposed home business is consistent with the Agricultural District in that the owner and resident of the property will be deriving her sole liveli— hood from the business activity to be conducted on the property.
