RE: DISPOSITION OF SURPLUS PROPERTY - 1963 MAGNOLIA MOBILE HOME
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners was advised that,
through tax sale, the County had acquired a 1963 Magnolia mobile
home, Serial Number 1741 , and there does not appear to be a County
need for said mobile home , and
WHEREAS, said mobile home is located in such a way that its
removal costs would exceed the anticipated sales prices , and
WHEREAS, the property owners , John E. and Laura Underhill,
where said mobile home is located, have offered to pay $25. 00 to
the County for said mobile home and insure that said mobile home
and its location complies with all applicable zoning and building
permit requirements as part of a court settlement in Nineteenth
Judicial District Court Case 86-CV-102.
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of Weld County, Colorado, that the offer of John E.
and Laura Underhill of 3113 Weld County Road 17 , Brighton ,
Colorado, in the amount of $25 . 00 , for the 1963 Magnolia mobile
home as part of a court settlement be, and hereby is , accepted
subject to a formal stipulation between the Underhills and this
Board and approval by the amount of such stipulation.
BE IT FURTHER RESOLVED by the Board that the Chairman be, and
hereby is , authorized to convey title of the above mobile home to
John E. and Laura Underhill .

The above and foregoing Resolution was, on motion duly made
and seconded, adopted by the following vote on the 28th day of
May, A.D. , 1986 .

STIPULATION AND ORDER
BOARD OF COUNTY COMMISSIONERS OF WELD COUNTY, COLORADO,
Petitioner,
v.
JOHN E. UNDERHILL,
LAURA UNDERHILL,
Respondents.
COMES NOW the Petitioner, by and through its attorney, the assistant of
Thomas 0. David, Weld County Attorney below named, and the Respondents John
E. and Laura Underhill appearing pro se and Stipulate and agree as follows:
1. That there is currently located on the property which is located
within Weld County and owned by John E. and Laura Underhill, a mobile home
which is identified as a 1963 Magnolia 10' x 47 ' mobile home.
2. That through the course of collection proceedings against the former
occupant of said mobile home the Petitioner has acquired a Certificate of Purchase
for said mobile home and is entitled at this time, due to the expiration of the
redemption period, to obtain title to said mobile home.
3. Because of the age and condition of the mobile home, it appears more
economical for all parties to leave the mobile home on the property under certain
conditions.
4. That the Respondents agree to remove the undercarriage and wheels from
the mobile home so that it no longer qualifies as a mobile home under Weld County
Zoning Ordinance or is required to be titled as a mobile home.
5. That Respondents agree to deliver to the Board of County Commissioners
of Weld County, Colorado, the sum of $25.00 for the mobile home. The Petitioner
agrees to provide a Bill of Sale for the transfer of ownership for the mobile
home to the Respondents.

6. The parties mutually request that the hearing set for June 4, 1986
be vacated.

BILL OF SALE
The Board of County Commissioners of Weld County, Colorado ,
Seller, of 915 Tenth Street, Greeley, Colorado, County of Weld,
State of Colorado, in consideration of $25 . 00 paid by John E.
Underhill and Laura Underhill, 3113 Weld County Road 17 , Brighton ,
Colorado 80601 , County of Weld , State of Colorado, receipt of
which is hereby acknowledged , do grant , sell, transfer, and
deliver to Buyer, the following goods : A 1963 Magnolia 10 foot by
47 foot mobile home under the terms and conditions of the
Stipulation and Order adopted by the Court in Case No. 86-CV-102
of the Weld District Court on August 29 , 1986 .
Buyer shall have all rights and title to the goods in himself
and his executors , administrators , and assigns.
IN WITNESS WHEREOF, Seller has executed this Agreement at
Greeley, Colorado, on the 24th day of September
1986 .
