When Blocks 1 and 2, Ward Acres, Third Addition, were platted in 1955, the lots were platted at a diagonal from the street. The original owners agreed among themselves to place their fences perpendicular to the street as shown on the resubdivision plat. The property line discrepancies have made it impossible for a lot to be conveyed due to concerns of lending institutions and title companies. The applicants seek to adjust the property lines to conform to what has historically been used by each property owner. The Department of Planning Services' staff has received referral responses from the Weld County Health Department, Weld County Engineering Department, City of Greeley Planning Department, and the Western Hills Fire Department. m. This gave more equal lot dimensions to each lot . After the houses were all sold, the original owners got together with the builder and all agreed to place their fences between their houses and running perpendicular to the street, thus not following the plat. At this point, the builder told the owners that the fence lines would become the legal boundaries by rights of adverse posession after a period of time . Thus, after so many, many years, the fence lines were just considered the lot lines by those living there and nothing was ever done "on paper' to make it legal . When we bought our house in 1978, the discrepency was noted, but the title and mortgage companies didn' t seem to see it as a major problem because we had no problems buying the home with the title the way it was. Apparently, before we bought our home, a number of other times there had been other houses bought and sold without any problems, either . We are , now, in the process of selling the house . Since we bought the house in 1978, no home in the block has been bought or sold. We have had buyers for our home since April , 1989, but they cannot find a lender who will give them a loan with the boundaries being so 'undecided, " nor can they find a title company who will give title insurance on a piece of property where there is such a discrepency on the title . In essence, we cannot sell our property without first legally 'defining its boundaries, ' i .e . replatting it. Since defining the boundaries on our house would cause a dominoe effect to those on either side of us, we need to replat the subdivision. We contacted all of our neighbors, and the majority of them have had problems in the past with this title 'mess' in getting home equity loans or permits on putting other buildings on their properties . One other owner has just listed his home for sale and also needs to get the title cleared up before he can sell . Essentially, what we did was to hire a surveyor who worked with the owners on either side of each property line making sure they all agreed on its placement . In essence , the original fence lines were adopted as the new property lines . When the surveyor had the corner pins in place , we all got together to 'OK' the final decision before the final plat was 891187 drawn up.
