SORENSON WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS , a public hearing was held on the 16th day of May, 1984 , at 2: 00 o' clock p.m. for the purpose of hearing the appli- cation of Louis M. Sorenson, 1716 23rd Avenue, Greeley, Colorado 80631 , requesting a Change of Zone from I-3 (Industrial Three) to C-3 (Commercial Three) for a parcel of land located on the following described real estate, to-wit: Part of Lot 5, Union Colony Subdivision; SE4 NEa, Section 5 , Township 5 North, Range 65 West of the 6th P.M. , Weld County, Colorado WHEREAS, Section 21 . 6 . 2 of the Weld County Zoning Ordinance provides standards for review of such a Change of Zone, and WHEREAS, the Board of County Commissioners heard all the testimony and statements of those present, has studied the re- quest of the applicant and the recommendations of the Weld County Planning Commission, and having been fully informed, finds that this request shall be approved for the following reasons: 1 . The applicant has complied with the application re- quirements listed in Section 21 . 7 et seq. , of the Weld County Zoning Ordinance. 2. The request is in conformance with Section 21 . 6 of the Weld County Zoning Ordinance as follows: a. The proposal is consistent with the Weld County Comprehensive Plan; the plan encourages com- mercial development to locate in or near exist- ing municipalities. b. The subject site is surrounded by industrial and commercial zoned land and is therefore compatible with the surrounding land use and with the future land use. c. The Greeley Planning Commission has recommended no objection to the Change of Zone request. d. The proposed Change of Zone is located in a floodplain district. Any future building de- velopment in the floodplain will require com- pliance with Section 53, Flood Hazard Overlay District Regulations of the Weld County Zoning Ordinance. It is not considered to be a commercial mineral deposit due to the small size of this tract, and the uneconomic feasibility of extracting the underlying sand and gravel. f. The subject site will be served by a septic sewer system. g. The subject site will be served by a well water system. h. Fifth Street Road will provide adequate access to the site. NOW, THEREFORE, BE IT RESOLVED by the Board of County Com- missioners of Weld County, Colorado that the application of Louis M. Sorenson for a Change of Zone from I-3 (Industrial Three) to C-3 (Commercial Three) on the above -referenced parcel of land be, and hereby is, granted subject to the following con- dition: a revised Change of Zone plat shall be submitted to the Department of Planning Services with a statement on the plat stating that an adequate source of potable water and an adequate sewage disposal facility shall be made available on said site prior to any Site Plan review and the issuance of building per- mits. Either the requirements of the Colorado Division of Water Resources shall be met or a public water source shall be pro- vided. The sewage disposal facility shall meet the requirements of the Weld County Health Department. Discussion was also held concerning the present zoning on this parcel of land. Commissioner Brantner moved to approve the Change of Zone, from I-3 to C-3, for Louis M. Sorenson for the reasons stated by the Planning Commission, and including the proposed condition. Commissioner Johnson seconded the motion which carried unanimously. Sorenson The Greeley Planning Commission recommended no objection to the Sorenson Change of _Zone. The Commission, however, further recommended that a -mobile home not be used as an office for the business. The Department of Planning Services cannot deny the first mobile home in a commercial or industrial zoned district, as long as the mobile home can he identified as an accessory use to a principal use (i.e. , an office for the used car lot) . The subject site is within the one hundred (100) year flood plain of the Cache la Poudre River. Prior to the issuance of a building permit for a mobile home to be used as an office, the applicant will need to submit a Flood Hazard Development Permit, including the following requirements: 1. 'The sanitary sewer system shall be designed to prevent inundation or infiltration by floodwaters as certified by a registered professional engineer, and 2. Any domestic water well or water supply shall be designed to prevent inundation or infiltration by floodwaters as certified by a registered professional engineer. In addition, prior to the issuance of a building permit for said mobile home, a site plan review will need to bs conducted for the subject site. -Approval of the water system and the sanitary sewer system will be required at this stage. DET-ERMINATIONS TO BE MADE BY THE BOARD OF COUNTY COMMISSIONERS ON CHANCE OF ZONE REQUESTS 21.6.2 The Board of County Commissioners shall hold a public hearing to consider the application and to take final action thereon. In -making a decision on the proposed change of zone, the Board shall consider the recommendation of the _Planning Commission, and from the facts presented at the public hearing and the information contained in the official record, which includes the Department of Planning Services case file, the Beard of County Commissioners shall approve the request for the change of zone unless it finds that the applicant has not met one o-r more of the standards or conditions of Sections 21 .6.2 and 21 . 7 (application requirements) . The applicant has the burden of proof to show that the standards and conditions of -Sections 21.6.2 and 21.7 (application requirements) are met. The applicant shall demonstrate: 21.6.2. 1 That the proposal is consistent with the policies of the Weld County Comprehensive Plan; if not, then that the zoning of the property under consideration is faulty, or that changing conditions in the area warrant a change of zone. 21.6.2.2 That the USES which would be allowed an the subject property by granting the change of zone will be compatible with the surrounding land USES. 21.6.2.3 That adequate water and sewer service can be made available to serve the site. If the rezoning is approved, the applicant shall demonstrate, -prior to issuance of building permits on the site, that the water and -sewer services are available at the site and are adequate and appropriate to meet the DEVELOPMENT requirements. 21.6.2.4 That STREET or highway facilities providing access to the property are adequate in size to meet the requirements of the proposed zone district. In the event that the STREET or highway facilities are not properly sized and are planned to be properly sized in the future, In conformance with the Weld County Thoroughfare Plan or in conformance with the MASTER PLAN of affected municipalities, -the applicant may either wait to secure the rezoning until the improvements are made by the appropriate unit of government or the applicant may express a willingness to upgrade the STREET or highway facilities at his own expense in order to secure approval of the requested change of zone. ]n the latter event, it will fie -necessary for the applicant to either construct the necessary improvements before building permits are issued, or submit suitable performance guarantees to Weld County to ensure construction of the required STREET or highway facility improvements. No rezoning shall he finally approved by the Board until the applicant has submitted an Improvements Agreement or Contract approved by the Board which sets forth the form of improvements guarantees. Any such Agreement or Contract shall be made in conformance with the Weld County Policy on Collateral for Agreements. 21 .6.2.5 '?hat, in those instances where the following characteristics are applicable to the rezoning request, the applicant -had demonstrated compliance with the applicable standards: 21 .6.2.5. 1 If the proposed change of zone is located within any Overlay District identified by maps officially adopted by Weld County, that the applicant has demonstrated compliance with the Weld County regulations concerning Overlay Districts. Compliance may be demonstrated in a previous public hearing or in the hearing concerning the rezoning application. 21.6.2.5.2 That the proposed rezoning will not permit the USE of any area known to contain a COMMERCIAL MINERAL DEPOSIT -as defined by Colorado Statutes in a manner which would -interfere with the present or future -extraction of such deposit by an extractor to any greater extent than under the present zoning of the property. 21.f.2.5.3 If soil conditions on the site are such that they present moderate or severe limitations to the construction of STRUCTURES or facilities proposed for the site, the applicant has demonstrated that such limitations -will be addressed by the applicant, the applicant's successors or assigns prior to DEVELOPMENT of the property. The subject property is part of a triangle bordered on the east by U.S. Highway 85, the southwest by 5th Street Road and the south by 5th Street. The applicant owns 0.83 acres of the approximately 2 acre triangle. The area outside the city limits to the west and north of the subject pro- perty is zoned "I-3" (industrial-Three). This area is a large tract suitable for "I-3" development. The subject property is quite small and combined with its triangular shape the property'-s potential for development as "I-3" is sharply reduced. Immediately to the east (across U.S. Highway 85) is a recently platted Iili) Subdivision that is surrounded by "C-1" (Commercial- One) zoning. This indicates that much of the nearby property was thought to be commercial in nature. The current uses of the surrounding properties seem to be more commercial than industrial in nature. Some of these are as follows: 1. Law Equipment Co. located south of applicant and engaged in sales and service. 2. Wadsworth Recreation Vehicle Sales located across U.S. 85 to the north- east and engaged in sales and services. 3. Sharp Bros. Seed Co. located across U.S. 85 to the east and engaged in sales. 4. U.S. Welding Co. located across U.S. 85 to the east and engaged in sales and service as well as storage and industrial uses. 5. Starlite Waterbeds located across -U.S. 85 to the southeast and engaged in commercial sales. Sorenson change of zone from "I-3" to "C-3" for part of lot 5; SE' NE4 of Section 5 , T5N, R65W; adjacent and east of the Greeley City Limits; north of 5th Street and -west of U.S. Highway 85. I have no problems with the change of zone from industrial to commercial. However, I do find difficulty with the presentation made by Jasper M. Freese. He states that the soils in the area are made up of Type 3, Weld-Colby when in fact the Weld-Colby designation is from the general soils map for an area two miles north of the subject location. The soil type at the site as shown on Map Sheet #E, "Weld Co. Soil Survey - Southern Part" is Map Unit #3, Aquoll-s and Aquents , gravelly substratum. These are nearly level bottom lands and flood plains of all major streams in the survey area. They are deep, poorly drained soils that have been formed in recent alluvium. Most of the acreage is subject to flooding. These soils have severe limitations for use with septic tank leach fields anti for construction of small commercial buildings due to potential soil wetness and possible flooding. I would recommend that a very close on-site testing be made by a competent soils -engineer to determine _proper construction standards to alleviate the possible poor -site conditions that may exist. This site investigation should include testing for presence of a permanent ground water table and flood eleva- tions for footings and foundations for commercial buildings.
