WHEREAS, Section 8 . 2 and 8 . 3 of the Weld County Zoning
Resolution authorizes the Board of County Commissioners to
grant a change of zone upon the showing by the petitioners
of certain facts, and

WHEREAS, the Board of County Commissioners heard all of
the testimony and statements of those present, has studied the
recommendations of the Weld County Planning Commission, and
having been fully informed, is satisfied that the request for
re-zoning complies with the Weld County Comprehensive Plan and
the conditions set out in Section 8 . 2 and 8 . 3 of the Weld County
Zoning Resolution.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado that the petition of Theador
and Sandra Blehm for a change of zone from E-Estate District to
A-Agricultural District for the above described tract of land be,
and hereby is, granted.
BE IT FURTHER RESOLVED by the Board of County Commissioners
that the reasons for approval contained in the Planning Commis-
sion recommendations dated August 19 , 1980 be, and hereby are,
adopted as the findings of fact of the Board of County Commis-
sioners in this matter.
The above and foregoing Resolution was, on motion duly made
and seconded, adopted by the following vote on the 8th day of
October, A.D. , 1980 .

for the following reasons:
1. The applicant has complied with Section 81 .7 et. seq . of the Weld County Zoning
Resolution regarding the application requirements for a change of zone.
2. It is the opinion of the Planning Commission that the applicant has demonstrated
on the submitted application materials that the proposed rezoning will correct
faulty zoning on the property. The applicant has indicated that the subject
property was intended to be used as a practice fairway with the golf course
since its conception and subsequent development. However, the applicant
inadvertently requested a change of zone on the property which was approved
by the County which prohibits the use as a practice fairway.
3. It is the opinion of the Planning Commission that this request will be compatible
with the surrounding land uses , will have adequate water and sewer service to
serve the permitted uses within the proposed zone district, and will have
adequate road and highway facilities to provide access to the property. In
addition, the property does not appear to have sand, gravel , or other mineral
resources on or under the subject property and is not located within a Flood or

Transmitted herewith is a rezoning application and amended
Conditional Use Permit application for a parcel adjoining
the Blehm Golf Course at Milliken, Colorado .
The subject site is presently zoned E (Estate) and is des-
ignated as outlot "B" on the approved preliminary plat .
It was always intended that the parcel would be used as a
practice fairway, however, we have been advised by County
staff that use would be limited to residents of the area unless
the zoning is changed to agricultural , and the parcel added
to the golf course conditional use permit . Approval of the
requested rezoning and conditional use permit will permit use
of the area by all golf course users .
It is our opinion that access , water supply, water rights ,
soils , and other concerns have been suitably addressed in
previous submittals and are not pretinent here ,

Dear Sirs:
Our office was requested to make an evaluation of the following described
property, owned by Ted Blehm, as to the value for farming purposes.
Pt. SE 1/4 and Pt. NE 1/4 S. 34, T5N, R67W
Pt. NE 1/4 S. 3, T4N, R67W
• I inspected this property, and my evaluation follows. This land is uneven,
rolling, hilly, and rough. There is a slope to the majority of this parcel
which would make irrigation difficult, utilizing normal irrigation systems.
There is a portion of this property that would be almost impossible to farm
except for grass due to the slope and terrain.
Due to the slope, surface water runoff would be rapid with a high erosion
hazard.
The soil surveys for this farm show areas of shale and sandstone close
to the surface and layers of clay in some areas. The soil under these conditions
would have poor water permeability which would restrict the kinds of crops
that could be grown and have a low production potential .
The south portion of this property is low and seepy in appearance , which
is restrictive to use.
Some of the soil in this farm would be suited to limited cropping; however,
intense farming would be hazardous because of erosion.
This total parcel is definitely not prime agricultural land. There are
small , uneven areas that could be farmed; however, it would not appear practical
due to the size and shape of these tracts.

This letter is in regard to your questions concerning my original letter
for Blehm Land and Cattle Company, Project No. 79032, prepared July 30th,
1979.
First, I want to correct a statement concerning Colby loam, 1 to 3 percent
slopes and Colby loam, 3 to 5 percent slopes. These soils are not high
potential cropland without irrigation water available. They are prime
soils with irrigation.
Second, as indicated by your contour map prepared from the actual site
measurement. There is probably more 40-D, Colby loam, 5 to 9 percent slopes,
than indicated on our copy of the soil survey map. There are probably about
20 to 25 acres of soil types Colby loam, 1 to 3 percent slopes and Colby loam,
3 to 5 percent slopes actually present, rather than the 50 acres indicated by
the soil map.
20 acres of prime farmland, when surrounded by lesser potential soil, is
very difficult to economically justify maintaining in today' s market place.
