RE: APPROVAL OF RECORDED EXEMPTION NO. 466 - ERNEST AND CORRINE
LEWIS
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, it has been determined by the Board of County Com-
missioners of Weld County, Colorado, at a public meeting held on
the 17th day of December, 1980 in the Chambers of the Board of
County Commissioners of Weld County, Colorado, that the division
into two parcels of land, as shown on the plat known as Recorded
Exemption No. 466, being the property of Ernest and Corrine Lewis
described as part of the Northwest Quarter of Section 20, Township
3 North, Range 68 West of the 6th P.M. , Weld County, Colorado,
being more particularly described as follows, does not come
within the purview of the definition of the terms, "subdivision"
and "subdivided land" , pursuant to its authority under Section
30-28-101 (10) (d) , CRS 1973, as amended:
All that certain parcel of land and pre-
mises located in the South Half of the
Northwest Quarter, Section 20, Township
3 North, Range 68 West of the 6th P.M. ,
Weld County, Colorado, and described as
follows:
Beginning at the West Quarter Corner of

WHEREAS, the Board of County Commissioners of Weld County,
Colorado finds that this particular division of land is not
within the purposes of the Weld County Subdivision Regulations
and the Board desires to exempt this particular division of land
from the definitions of "subdivision" and "subdivided land"
pursuant to its authority under Section 30-28-101 (10) (d) , CRS
1973, as amended, and Section 2-lA(3) of the Weld County Sub-
division Regulations.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado that the hereinabove described
parcel of land owned by Ernest and Corrine Lewis be, and hereby
is, exempt from the definition of the terms "subdivision" and
"subdivided land" pursuant to its authority under Section
30-28-101 (10) (d) , CRS 1973 , as amended.
The above and foregoing Resolution was, on motion duly made
and seconded, adopted by the following vote on the 17th day of

Re: Recorded Exemption 466
Dear Commissioners:
The attached application, plat and related items are in reference to a
request from Ernest and Corrine Lewis for a recorded exemption. The parcel
of land on which this request has been made is described as part of the
NWµ, Section 20, T3N, R68W of the 6th P.M. , Weld County, Colorado. This
property is located li miles north of Union Reservoir. The property con-
tains approximately 77.74 acres of Class 11 and 111 irrigated soils. The
request is to split the property into parcels of 66.07 acres and 11 .67
acres.
On March 19, 1980 the Board of County Commissioners approved a request by
Ernest and Corrine Lewis for a lot size variance so that they could make
application for this recorded exemption. At the time they made the decision
on that request, the Department of Planning Services Staff submitted a
letter of recommendation for denial to the Board. A copy of the letter
for denial is included in the attached packet. Nothing has been received
by our office that would change our recommendation for denial for this
request as outlined in the letter to the Board of County Commisioners
dated March 19, 1980.

Dear Board Members ,
This is to confirm our request to divide our farm as we dis-
cussed with Ms . Carter during our visit to your office this
week .
We bought and moved on this farm in March of 1967 . We have
remodeled the house , built large barn , sheds and lots of
fencing; and customed the farm in general to accommodate
our business of breeding Arabian Horses . We plan to continue
the breeding program, but on a much smaller scale .
Some of the reasons we are requesting this division so that
we can continue to live in our home are ;
1 . We have reached retirement age and Mr . Lewis
is no longer able to farm .
2 . We need to sell the surplus farm acreage to
have a comfortable retirement, and enjoy a
few carefree years as a reward for many years
of hard work . .
3 . Our son lives next door and as we grow older
it would be very advantageous to have family
so near.
4 . Shopping , hospital , doctors , and church are
all convenient .
5 . We enjoy this neighborhood and the friends
we have made here .
6 . Our farm is well known as an Arabian Breeding
Farm and is very accessible to I-25 , easy for
out of town and state clients to visit .
Our farm consists of 77 . 9 acres , the plot where the house and
buildings are would be approximately 10 acres , which is the
part we want to retain .
We are enclosing a sketch of the farm, with area we wish to
retain shaded .
We trust that you will give us a favorable recommendation

The Board of Directors, at its November 6, 1980 meeting, approved the
issuance of a limited number of water taps, subject to the following
conditions:
1. Request for tap must have been made prior to October 1,
1980;
2. Applicant shall be limited to a single tap for use in a
single family residence;
3. Applications must be received, accompanied by current tap
fee on or before December 31, 1980. Membership fee as of
this date is $4,000 or $1,600 plus one unit of Big T water.
Each membership tap must receive Board approval and is subject to
applicant's compliance with rules, regulations and requirements of the
Association. Any line extension or oversizing necessary for service
would be the responsibility of the applicant.
If you wish to apply for a tap, please complete and submit the enclosed
application form, along with your check for $4,000 in order that the Board
may consider same at the December 4th meeting or the January 8th meeting.
Meetings are held at 7:00 p.m. at the Liberty Hall Grange, Corner of
Weld County Road #5 and. Colorado Highway #66. If you wish, you may attend
the meeting or leave your application at the office and it will be presented
to the Board.
Minimum monthly billing ($15.00) commences 45 days after approval of the
application and issuance of membership whether or not water is used.

RE: Lot Size Variance 108 : 80 :5
Dear Commissioners:
The attached letter and related materials are in reference to a request
for a lot size variance from Mr. and Mrs. Ernest Lewis. The property on
which this request has been made is described as Pt. NW4, Section 20, T3N,
R68W of the 6th p.m„ Weld County, Colorado. This property is located
11 miles north of Union Reservoir and 11 miles southwest of Mead.
The property under consideration contains approximately 78 acres of
Class II and III irrigated soils. The request is to obtain a variance
from the minimum lot size requirement, Section 9-4 A. (6) of the Weld
County Subdivision Regulations, so that they may make application for a
recorded exemption.
Mr. and Mrs. Lewis wish to keep the smaller 10 acre parcel for retirement
purposes and sell the remainder of the property.
Based upon the information submitted and the adopted policies in the
County, the Department of Planning Services staff recommends the request
be denied for the following reasons:
1. The request is not in compliance with the intent clause of the
recorded exemption procedure (Section 9-2 of the Weld County
Subdivision Regulations) . Said clause states:
"The intent in establishing the recorded exemption procedure
is to provide, in accordance with the Weld County Comprehensive
Plan, a means whereby non-productive agricultural lands may

be developed for higher and more productive uses insofar
as such uses are compatible with surrounding agricultural
uses in areas where such land divisions are proposed.

The proposed request does not comply with the Weld County Comprehensive
Plan because it would promote non-agricultural use of agricultural
land and it would encourage residential encroachment on rural agri-
cultural land use. The Plan urges residential development to be
closely connected to and served by municipal utilities. Within a
reasonable service area from their corporate limits, towns and
municipalities can provide better services at a lower cost to
residential development. Additionally, residential land uses in
rural areas may generate conflicts wihch may prohibit efficient agri-
cultural operations.
2. This request is not in conformance with the intent clause of the
Agricultural Zone District, Section 3. 3.A. of the Weld County Zoning
Resolution. This request would not be encouraging agricultural uses
as the highest and best uses, it would not be providing for the
orderly expansion of urban growth, it would be promoting the division
of agricultural land into smaller, less economic parcel sizes, and
increasing the residential density on the property.
The approval of this request would allow another residence to be
built on the larger parcel. While the addition of one residence does
not in itself create an urban encroachment, the cumulative effect
of recorded exemptions in the surrounding area may have future
negative impacts on the agricultural economy. Increased residential
density results in greater demands on the services which residential
development requires and therefore higher costs of those services
to the residents of the County.
3. The minimum lot size in the Agricultural Zone District for irrigated
parcels is 80 acres and for non-irrigated parcels is 160 acres. The
intent is to maintain tracts which are large enough for farm purposes,
and to assist in the encouragement of agricultural uses as the highest
and best use of the land. This request is in conflict with that intent.

Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners has determined
at a public hearing held on the 19th day of March, 1980 in the
Chambers of the Board of County Commissioners of Weld County,
