ORDINANCE NO . 9-B
IN THE MATTER OF AN AMENDMENT TO ORDINANCE NO. 9-A, WELD COUNTY
INDIVIDUAL SEWAGE DISPOSAL SYSTEM REGULATIONS, CHANGING THE FEES
FOR APPLICATIONS FOR NEW INDIVIDUAL SEWAGE DISPOSAL SYSTEMS.
BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF WELD COUNTY,
COLORADO:
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners has the power
and authority under the Weld County Home Rule Charter and Sec-
tion 101, et seq. , of Article 10 of Title 25, CRS 1973, to adopt
invididual sewage disposal system regulations, and
WHEREAS, the Board of Public Health of Weld County , Colorado,
has recommended the adoption of an increase in permit fees for
the application for new individual sewage disposal systems , and
WHEREAS, CRS 1973, Section 25-10-106, as amended, now
authorizes a permit fee up to the sum of $150 .00 for an applica-
tion for a new individual sewage disposal system, and
WHEREAS, a fee of $100 . 00 accurately reflects the costs to
the Department for administration of the permit program pursuant
to the Individual Sewage Disposal System Regulations, and
WHEREAS, the increased fees are identified as anticipated
revenues for the 1982 fiscal year, commencing January 1, 1982 ,
and therefore, the Board of County Commissioners of Weld County
hereby finds and determines that the necessity of immediately
enacting this Ordinance constitutes an emergency under the pro-
vision of Section 3-14 of the Weld County Home Rule Charter.
NOW, THEREFORE, BE IT ORDAINED by the Board of County Com-
missioners of Weld County, Colorado , that Ordinance No . 9-A is
amended by the repeal and re-enactment of Section 3. 3 .C.1 . to
read as follows:
"A permit fee of $100 .00 or as authorized
by Colorado State Statutes or Weld County
Charter, shall be required of applicants

payable at the time of application to the
Weld County Health Department. Permit
fees are non-refundable. Permit applica-
tions are non-transferable . The issuance
of a permit does not denote approval of
any zoning requirements. "
BE IT FURTHER ORDAINED that an emergency exists which requires
that this Ordinance No . 9-B is declared an emergency ordinance
under the provisions of Section 3-14 of the Weld County Home Rule
Charter.
The above and foregoing Ordinance No . 9-B was , on motion
duly made and seconded, adopted by the following vote on the
8th day of February 1982 .
