WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, in November, 1978 , Greeley Sand and Gravel Company, Inc. transferred 1 . 3 acres , more or less, to Weld County, Colorado for right-of-way purposes, and WHEREAS, Greeley Sand and Gravel Company, Inc. wishes to submit an application to the Northern Colorado Water Conservancy District for a change of Class D allotment contract, and WHEREAS, said application concerns certain real estate which includes the 1 . 3 acres, more or less, mentioned herein, and WHEREAS, Greeley Sand and Gravel Company, Inc. has requested that the Chairman of the Board of County Commissioners be authorized to execute said application. NOW, THEREFORE, BE IT RESOLVED by the Board of County Com- missioners of Weld County, Colorado that the Chairman of the Board be, and hereby is , authorized to execute the application for change of Class D allotment contract. However, the use of the water shall not be limited solely to the described lands. 131 An acre-foot of water as referred to herein is defined as being one-three-hundred-ten-thousandth 11/310,0001 of the quantity of water annually declarr by the Board of Directors of the District to be available for delivery from the water supplies of the District. The water delivery obligation of the Distrlc: shall terminate at any delivery point from which water is released from the works of the District. Further, on November 1 of each year, any water un- delivered from the annual quantity made available to the Applicant shall revert to the water supplies of the District.
