RE: APPROVAL OF USE BY SPECIAL REVIEW FOR AN ANIMAL RESEARCH
FACILITY - TECH AMERICA GROUP, INC .
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners held a public
hearing on the 14th day of March, 1984 , at the hour of 2 : 00
o' clock p.m. in the Chambers of the Board for the purpose of
hearing the application of Tech America Group, Inc. , 225 Com-
merce, P.O. Box 2211 , Fort Collins , Colorado 80521 , for a Use
by Special Review for an animal research facility on the follow-
ing described real estate, to-wit:
Part of the SWa of Section 3 , Township 7
North, Range 67 West of the 6th P .M. , Weld
County, Colorado
WHEREAS, Section 24 . 4 . 2 of the Weld County Zoning Ordinance
provides standards for review of said Use by Special Review, and
WHEREAS, the Board of County Commissioners heard all of the
testimony and statements of those present, has studied the re-
quest of the applicant and the recommendations of the Weld County
Planning Commission and all of the exhibits and evidence pre-
sented in this matter, and having been fully informed, finds
that this request shall be approved for the following reasons :
1 . The submitted materials are in compliance with the
application requirements of Section 24 . 7 of the Weld
County Zoning Ordinance.
2 . It is the opinion of the Board of County Commissioners
that the applicant has shown compliance with Section
24 . 4 . 2 of the Weld County Zoning Ordinance as follows :
a. The proposal is consistent with the Weld County
Comprehensive Plan. The Comprehensive Plan
supports the expansion and development of agri-
business and agriculturally oriented industry as
long as they do not adversely affect the total
economy or environment.
b. The proposed use is an agricultural activity and,
therefore, is consistent with the intent of the
Agricultural Zone District.
c. The uses permitted would be compatible with sur-
rounding agricultural land uses and with future

development of the surrounding area as permit-
ted by the Agricultural Zone District.
d. No overlay districts affect the site .
e. Use by Special Review Operation and Design
Standards provide adequate protection of the
health, safety and welfare of the neighborhood
and County.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado, that the application for
a Use by Special Review for an animal research facility on the
hereinabove described parcel of land be, and hereby is , granted
subject to the following conditions :
1 . The attached Standards for Use by Special Review be
adopted and placed on the Use by Special Review plat
prior to recording.
2 . No building or electrical permits shall be issued for
the Use by Special Review Permit area until the
Standards for the Use by Special Review have been
placed on the Use by Special Review plat and the plat
has been delivered to the Department of Planning
Services Office.
3 . Prior to recording, the Use by Special Review permit
map shall be corrected to show the access and access
roadway as approved by the Poudre Fire Authority
District.
The above and foregoing Resolution was , on motion duly made
and seconded, adopted by the following vote on the 14th day of
March, A.D. , 1984 .

OPERATION STANDARDS
Tech America Group, Inc.
U.S.R. - 607:84:3
1. The uses permitted shall be an animal research facility as described in
the application materials on file with the Department of Planning
Services.
2. The livestock run-off pond shall be designed and constructed according to
the Colorado Department of Health's Guidelines for the Design of Feedlot
Runoff Containment Facilities. Prior to start-up of the facility, the
run-off pond shall be approved by the Colorado Health Department, Water
Quality Control Division. No livestock run-off from the Use by Special
Review area shall enter the ditch maintained by The Water Supply and
Storage Company.
3. The individual sewage disposal facility shall be engineer-designed and
approved by the Weld County Board of Health.
4. The access and access roadway shall be approved by the Poudre Fire
Authority District prior to start-up of the facility.
5. An adequate water supply on the Use by Special Review area shall be
approved by the Poudre Fire Authority District prior to start-up of the
facility.
6. The applicant shall comply with the design standards for the Use by
Special Review, Section 24.5 et seq. , of the Weld County Zoning
Ordinance.
7. The applicant shall comply with the Operation Standards for Uses by
Special Review, Section 24.6 et seq. , of the Weld County Zoning
Ordinance.
8. Representatives or members of the Weld County Health Department and Weld
County Department of Planning Services shall be granted access onto the
site at any reasonable time in order to insure the operations carried out
on the site comply with the Operation Standards stated hereon and all
applicable Weld County Regulations.
9. The Use by Special Review shall be limited to the plans shown hereon and
governed by the Standards as stated above and all applicable Weld County
Regulations. Any material deviations from the plans and/or Standards, as
shown or stated above shall require the approval of an amendment of the
Permit by the Weld County Planning Commission and the Board of County
Commissioners before such changes from the plans and/or Standards are
permitted. Any other changes shall be filed in the office of the
Department of Planning Services.
10. The property owner and/or operator of this operation shall be responsible
for complying with all of the above stated Standards. Noncompliance with
any of the above stated Standards may be reason for revocation of the
Permit by the Board of County Commissioners.
11. A soil erosion plan shall be submitted to and approved by the West
Greeley Soil Conservation District prior to start—up of the operation.

A public hearing was conducted on March 14 , 1984, at 2:00 P.M. , with
the following present:

The following business was transacted:
I hereby certify that pursuant to a notice dated February 27, 1984, and duly
published in the LaSalle Leader on March 1, 1984, a public hearing was held con-
cerning the Use by Special Review, requested by Tech America Group, Inc. , for an
animal research facility. Lee Morrison, Assistant County Attorney, read this
request into the record. Rod Allison, Planning Department representative, road
the favorable recommendation from the Planning Commission, along with the eleven
proposed Operation Standards, into the record. Mr. Allison stated that
the Planning Department is recommending that the last sentence of Operation
Standard #2 be amended to read: "No livestock run-off from the Use by Special
Review area shall enter the ditch maintained by The Water Supply and Storage
Company." Tom Norton, engineer representing Tech America Group, Inc. , reviewed
the site plans for this facility. He further stated that the applicant has re-
viewed the proposed Operation Standards and has no problem with them. Dr. Steve
Stroh explained that his company tests already manufactured vaccines and pharma-
ceuticals for safety and also does research testing on the development of new
vaccines and pharmaceuticals. Dr. Stroh stated they are regulated by the USDA
Animal Plant Health Inspection Service, by another branch of the USDA, and by
the Health and Human Services. Commissioner Johnson ctuestioned the holding pond
which will hold run-off water. In response to Commissioner Brantner's question
concerning pathogenic organisms which might be present in the pond, Dr. Stroh
presented the Board with a list of organisms which are to be used, stating that
the USDA would have to be notified if there are any deviations from this list.
Further discussion was held concerning the testing to be done and the precautions
which will be taken. Mr. Morrison asked if the applicant is aware that approval
of this Use by Special Review will not affect the drilling rights of mineral
owners of this property, and the applicant stated that would not create a
problem. Commissioner Brantner moved to approve the Use by Special Review for
an animal research facility requested by Tech America Group, Inc. , based upon
the recommendation of the Planning Ca mission, toiinclude the Operation Standards,
with Operation Standard #2 amended as requested by the Planning Department.
Commissioner C. Carlson seconded the motion, which carried unanimously.

2. No building or electrical permits shall be issued for the Use by Special
Review Permit area until the Standards for the Use by Special Review have
-been placed on the Use by Special Review plat and the plat has been
delivered to the Department of Planning Services office.
3. Prior to recording, the U.S.R. permit map shall be corrected to show the
access and access road way as approved by the -Poudre Fire Authority
District.
OPERATION STANDARDS

1. The uses permitted shall be an animal research facility as described in
the application materials on file with the Department of Planning
Services.
2. The livestock run—off pond shall be designed and constructed according to
the Colorado Department of Health's Guidelines for the Design of Feedlot
Runoff Containment Facilities. Prior to start—up of the facility, the
run—off pond shall be approved by the Colorado Health Department Water
Quality Control Division. No livestock run—off from the U.S.R. area
shall enter the Larimer Canal.
3. The individual sewage disposal facility shall be engineer—designed and
approved by the Weld County Board of Health.
4. The access and access roadway shall be approved by the Poudre Fire
Authority District prior to start—up of the facility.
5. An adequate water supply on the U.S.R. area shall be approved by the
Poudre Fire Authority District prior to staff-up of the facility.
6. The applicant shall comply with the design standards for the Use by
Special Review, Section 24.5 et seq. , of the Weld County Zoning
Ordinance.
7. The applicant shall comply with the Operation Standards for Uses by
Special Review, Section 24.6 et seq. , of the Weld County Zoning
Ordinance.
8. Representatives or members of the Weld County Health Department and Weld
County Department of Planning Services shall he granted access onto the
site aL any reasonable time in order to insure the operations carried out
on the site comply with the Development Standards stated hereon and all
applicable Weld County Regulations.
9. The Use by Special Review shall be limited to the plans shown hereon and
governed by the Standards as stated above and all applicable Weld County
Regulations. Any material deviations from the plans and/or Standards as shown
or stated above shall require the approval of an amendment of the Permit by
the Weld County Planning Commission and the Board of County Commissioners
before such changes from the plans and/or Standards are permitted. Any other
changes shall be filed in the office of the Department of Planning Services.
10. The property owner and/or operator of this operation shall be responsible
for complying with all of the above stated Standards. Noncompliance with
any of the above stated Standards may be reason for revocation of the
Permit by the Board of County Commissioners.
DETERMINATIONS TO BE MADE BY THE BOARD OF
COUNTY COMMISSIONERS ON USE BY SPECIAL, REVIEW REQUESTS
24.4. 2 The Board of County Commissioners shall hold a public
hearing to consider the application and to take final
action thereon. In making a decision on the proposed Use
by Special Review, the Board shall consider the
recommendation of the Planning Commission, and from the
facts presented at the public hearing and the information
contained in the official record, which includes the
Department of Planning Services case file, the Board of
County Commissioners shall approve the request for the
Special Review Permit unless it finds that the applicant
has not met one or more of the standards or conditions of
Sections 24.2. 2, 24.5 (design standards) and
24.6(operation standards) . The applicant has the burden.
of proof to show that the standards and conditions of
24.4. 2, 24.5 (design standards) and 24.6 (operation
standards) are met. The applicant shall demonstrate:
24.4.2. 1 That the proposal is consistent with the Weld County
Comprehensive Plan.
24.4.2.2 That the proposal is consistent with the intent of the
district in which the USE is located.
24.4.2.3 That the USES which would he permitted will be compatible
with the existing surrounding land USES.
24.4.2.4 That the USES which would be permitted will be compatible
with the future DEVELOPMENT of the surrounding area as
permitted by the existing zone and with future DEVELOPMENT
as projected by the COMPREHENSIVE PLAN of the COUNTY or
the adopted MASTER PLANS of affected municipalities.
24.4.2.5 That the application complies with the Weld County Zoning
Ordinance, Section 50, Overlay District Regulations if the
proposal is located within any Overlay District Area
identified by maps officially adopted by Weld County.
24.4.2.6 That if the USE is proposed to be located in the
A-District, that the applicant has demonstrated a diligent
effort has been made to conserve productive agricultural
land in the locational decision for the proposed USE.
24.4.2.7 That there is adequate provision for the protection of the
health, safety and welfare of the inhabitants of the
NEIGHBORHOOD and the COUNTY.

TechArnerica is an agriculture-related business producing
pharmaceuticals and biologics for use in domestic livestock
production. The Animal Research Facility will be used to safety
test these products before release of the product for sale to
the general public .

of Black Bellow Reservoir on Weld County Road 84 . The legal

SITE DESIGN AND OPERATION
The location znd size of the various buildings, corrals
and pond-s to be used at the Animal Research Facility are shown
on the Use by Special Review Permit Plan Map attached.
A clay lined pond will be constructed at the site to
store and treat runoff Ii.o.it the livestock containment areas.
Wastes from the -office and challenge building will be treated
by a small septic syst:cm or package treatment units with evap-
otranspiration of effluent. Shallow draft surface aerators will
be used to aerate the pond to prevent odors.
The pond will be five (5) feet d. •ep with a ruoximu L
of three (3) feet of water stored at any time. The pond
will be clay lined using the native clays on-site. The

the pen areas to be treated annually.
4. Wastes from 50% of the maximum animal concentration
listed in Appendix A to be treated annually.
The pond will have a surface a;_ea of four (4) acres .
The challenge building will be equipped with a H.F. . P.A.
filtration system which cleanses the air of bacteria and
viral particles .
No large stockpiles of manure will be allowed to accumulate
at the facility. The manure will be spread on the convalescent
pasture and adjacent farm lands .

The following are supporting documents or statements required
in the "Procedural Guide for Use by Special Review Application" .
The numbering used is that of the guide furnished by Weld
County.
la. The proposal is consistent with the Weld County Comprehensive
Plan in that it will be established and operated i a manner
that is compatible with existing and planned land uses in the
area. The site will not interfere or adversely effect the health,
safety, convenience, and general welfare of the present and
future residents of Weld County.
lb . The proposal is consistent with the uses allovied in the A
District iu which ii is located . The Weld County Corip, ehcnsivc
Plan allows agriculture related service establishments in the A
District upon approval of a Use' by Special Review Application .
TechAmerica is an agriculture- related business nroclucing pharn:-.
aceuticals and biologics for clomestic livestock production. These
products will be safety tested at this research facility farm
operation before releasing theproduct for sale to the general
public .
lc. The existing land of this and adjacent props, rats. is dryland
wheat fanning and cattle pasture. Existing residences arc over
one-half mile from the site. The corrals , steel buildings , and
sheds , and feed storage areas are compatible in appearance and
use , with other agricultural operations in the area.
ld. The facility has been lousted outside the existing growth
patterns of the surrounding municipalities which are Fort
Collins , Ault, and Windsor. There is no reason to believe that
the surrounding land use will change from agriculture in the
forseeable future.
le. The site has been located outside the Flood Hazard, Weld
County Airport , and Geologic Hazard Overlay Districts .
if. A diligent effort has been made to avoid removing prime
agricultural land from production in locating this facility. The
land is presently used for dryland wheat farming. No irrigation
water will be diverted for use at the facility. By locating the
facility in a d?-gland area the use of prime irrigated farm land
in Weld County rill be avoided . The buildings will be located
at the South end of the property where the poorer quality (from
an agricultural standpoint) soil is found. The better quality
soil at the North end of the property will be used for a conval-
escent pasture and will he planted in pasture grass .
lg. The facility has been designed using the latest engineering
technology to protect the health, safety, and welfare of the
inhahitarrt s of the neighborhood and the county. The site will
be surrounded with a security fence with signs to act both as a
deterrent for people attempting to enter the facility, and as
a second line of security to prevent animals from escaping from

the facility. The handling of biologic products is controlled
by the USDA-APHTS , and at least bi-yearly inspections are made
by USDA-APHIS to ensure proper handling of these materials . Dr.
D. C. Randall , based in Denver at (303) 837. 6012 , is the contact
veterinarian for USDA-APHIS that: inspects such facilities .
2 . The application is at the front of this Appendix.
3 . A certified list of the owners of property within five hundred
(500) feet of the property subject to this application is at
the back of this Appendix.

under the property subject to this application is on the applica-

of the property . The closest house is one--half mile away.

in a step-wise fashion. initial work will require five employees .
Over a five to ten year period , the number of employees could
reach possibly as high as twenty.

5f. Animals . The farm will primarily house 500 cattle, 500 sheep ,
100 horses , 100 swine, and 40-50 small animals . These numbers
are all maximums and it would be highly unlikely to have all
animals at a maximum at any one time.
5g. Structures . Structures to be built at the facility would
include the following:
1 . Office complex (24 ' x 72 ' ) which would have a 24 x 24 office
and lab area , 24 x 24 apartment , and a 24 x 24 shop area.
2 . Stall barn (36 ' x 80 ' ) for large animals .
3 . Challenge building (36 ' x 128 ' ) which would house calves ,
pigs , cats , and dogs in an H.E .Y.A. filtered environment.
An H. E.P.A. filter cleanses air of bacteria and viral part-
icles .
4 . Heed storage building (24 ' x 112 ' ) for storing grain and
hay products .
5. livestock sheds (14 ' deep x 24' to 200 ' ) . There are 12
sheds planned for 198h with additional sheds being built as
needed , to a maximum of about 30 sheds . These sheds will be
three- sided and will have metal siding and roof to match
other buildings .
6. Several small buildings and win .ibreaks will be added to
facilitate working in adverse weather.
7 . An area will be left available on the east side of the uro-
perry for a laboratory animal building. This building may
or may not be needed in the future to replace the

new building now being used in Fort Collins . If built in the
next -5-10 years , the building would be used for laboratory
testing of rodents , rabbits , dogs , and cats .
5h. Traffic. The property will be accessed from Colorado
Ili.ghway 1.4 on Weld County Roads 19 and 21 to Weld County Road
84 which borders the property. Most vehicular traffic will
he personal cars and pickups . A two-ton livestock truck and
"fifth-wheel" livestock trailer will also he used. Occasional-
ly a semi-- tractor-trailer load of feed or cattle will deliver
to the farm. Most traffic will be made by vehicles with less
than 8500 GVW.
Si . Sewage. Sewage facilities will consist of an aerobic treat-
ment pond with on-site evaporation for the runoff from the live-
-stock containment micas . A se.utic syster+i or small package treat-

to treat wastes front the office and challenge building. Additional

constructed.

The current time table of construction is as follo,as :

3 . October 1984 through January 1985 ; stall barn and

4 . 1989 through 1990 ; laboratory animal building.
5 . Additional corrals will be built as needed .

OF A
GEOTECHNICAL INVESTIGATION
SCOPE
This report presents the results of a -geotechnical evaluation
prepared for the proposed animal research facility located south of Black
Hollow Reservoir, northeast of Fort Collins, Colorado. The investigation
included test borings and laboratory testing of samples obtained from
these borings.
The objectives of this study were to (1 ) evaluate the subsurface
conditions -at the site relative to the proposed construction, (2) make
recommendations regarding the design of the substructures and detention
basin, and (3) recommend certain precautions which should be taken
because of adverse soil and/or groundwater conditions.
SITE EXPLORATION
The field exploration, carried out on December 20, 1983, consisted of
drilling, logging , and sampling seven (7) test borings. The location and
number of test borings were determined by personnel of NorLUii
Underwood and Larnh. 1 he locations of the test borings are shown on
the Test Boring I oration Plan and Geologic Map included in Appendix A
of this report. Boring logs prepared from the field logs are shown in
Appendix A. Those logs show soils encountered, location of sampling,
and groundwater at the time of the exploration.
The borings were advanced with a four-inch diameter, continuous--
type, power—flight auger drill. During the drilling operations, a
geotechnical engineer from Empire Laboratories, Inc. was present and
made continuous observations of the soils encountered. A visual
inspection was made of the site on the same date by an engineering
geologist of Empire Laboratories, Inc.

The proposed site is located on Weld County Road 84 approximately
-one and one-half miles east of its intersection with Weld County Road 19,
northeast of Fort Collins, Colorado. More particularly, the site is
described as a tract of land situate in the South 1/2 of Section 3,
Township 7 North, Range 67 West of the Sixth P.M. , Weld County,
Colorado.
The north and east boundary of the property is formed by the
Lariruer County Canal, and the south boundary is formed by Yield
County Road 84 which is gravel surfaced. An overhead power line is
located north of ‘Veld County Road 84 along the south edge of the
project area. Black Hollow Reservoir lies north of the site. The
property consists of cultivated farmland planted in alternating strips of
winter wheat. The site is relatively flat to gently rolling and has minor
drainage to the north and east from a low rise at the southwest corner
of the property.
LABORATORY 1 F:SI S AND FVAL UATION
Samples obtained from the test borings were subjected to testing in
the laboratory to provide a sound basis for evaluating the physical
properties of the soils encountered. Moisture contents, dry unit
weights, unconfined compressive strengths, water soluble sulfates,
swelling potentials, and the Atterberg limits were determined. A
summary of the test results is included in Appendix B. Consolidation,
swell-consolidation, moisture density and permeability characteristics
were also determined, and curves showing these data are included in
Appendix B.
SOIL AND GROUNDWATER CONDIT IONS
The soil profile at the site consists of strata of materials
arranged in different combinations. In order of increasing depths, they
are as follows:

(1 ) Silty _Topsoil: area tested is overlain by a six (6) inch
layer of silty topsoil. The topsoil has been penetrated by root
growth and organic matter and should not be used as a bearing
soil or as a fill and/or backfill material. The topsoil has been

It is suggested -that the topsoil be stripped and stockpiled for
reuse in planted areas.
(2) Sandy Silty -Clay: This stratum underlies the topsoil and
extends to the bedrock below. The silty clay is moderately
plastic, contains varying amounts of sand and isolated lenses of
silty sand and exhibits moderate bearing characteristics in its
moist in situ condition. When wetted, the clay stratum exhibits
slight swell potential; and upon loading, consolidation readily
occurs. In situ, the clay stratum exhibits low permeability
rates; and the silty sand exhibits moderate permeability. When
compacted to ninety-five percent (95%) of Standard Proctor
Density, the clay material is relatively impervious.
(3) Siltstone- Sandstone- Claystoiie Bedrock: The bedrock was
encountered in all borings at depths four (4) to twenty- four
and one- half (24-1 /2) feet below the surface and extends to
greater depths. the upper three and one-half (3-1 /2) to eight
(8) feet of the bedrock is highly weathered; however, the
underlying interbedded siltstone, sandstone and claystone is
firm and exhibits high bearing characteristics. When wetted,
the bedrock stratum exhibits slight to moderate swell potential.
(4) Groundwater: At the time of the investigation, free
groundwater was encountered in Borings 5, 6, and 7 at depths
seven (7) to twelve and one-half (12-1 /2) feet below the
surface. No free groundwater was encountered in Borings 1
through 4 to the depths explored. It is our opinion that a •
perched water table may develop at the site where groundwater

is not -already encountered above the bedrock stratum. Here,
surface water may percolate through the upper subsoils and
become trapped on the relatively impervious bedrock stratum,
thus forming the perched groundwater condition.
RECOMMENDATIONS AND DISCUSSION
It is our understanding that the proposed animal research facility is
to consist of single--story metal buildings having conventional
slab-•on-grade construction. Animal pens will be constructed north of
the buildings. A detention basin designed to ce!lect surface water will
be constructed in the area of Borings 5 and 6 north of the proposed
buildings. The size and exact location of the proposed buildings and
detention pond were not known to us at the time of the site exploration.
Geology
The proposed facility is located within the Colorado Piedmont section
of the Great Plains physiographic province. The Colorado Piedmont,
formed during late Tertiary and Early Quaternary time (approximately
)xty-five million (65,000,000) years ago) , is a broad, erosional trench
which separates the Southern -Rocky Mountains from the Ilic;h Plains.
Structurally, the property lies along the western flank of the Denver
Basin. The Black Hollow oil field, a low relief anticlinal feature, is
located within the Denver Basin adjacent to the project area. During
the Late Mesozoic and Early Cenozoic Periods (approximately seventy
million (70,000,000) years ago) , intense tectonic activity occurred,
causing the uplifting of the Front Range and the associated downwarping
of the Denver Basin to the east. Relatively flat uplands and broad
valleys characterize the present-day topography of the Colorado Piedmont
in this region. The site is underlain by the Cretaceous Pierre Shale.
1 he Pierre formation is overlain by alluvial and residual clay soils of
-Pleistocene and/or Recent Age. •
Bedrock outcrops ware not encountered at the site. However, the
Pierre formation underlies the site at varying depths _of four and

one half (4-1 /2) to twenty-foul ariu one half (24; 1 /2) feet 1.):.l the
surface. The bedrock encountered is that of the Pierre Shale transition
zone, which consists of medium dark gray shale or claystone, siltstone
and sandstone thinly interbedded and grading upward from shale to
predominantly siltstone and silty sandstone. -The bedrock section of the
Pierre shale transition zone is approximately two thousand (2000) to
three thousand (3000) foot thick and includes what has been mapped by
others as the Lower Fox Hills Formation. The siltstones and claystones
encountered at the site are anticipated to be relatively impervious;
however, water may follow joints and fractures which exist within the
bedrock stratum. The Pierre shale in this general area is a poor
aquifer, and its water yields are very low being generally less than
twenty-five (25) gallons per minute.
The general regional dip of the Pierre Shale in this area is three
degrees (30) to six degrees (6°) in an easterly direction. However, a
dip reversal may occur in the vicinity of the project area. The Black
Hollow oil field is located approximately two (2) miles east of the site
and is underlain by a north-south trending anticlinal structural feature
of low relief. Seismic activity in the area is anticipated to be low; and
in our _opinion from a structural standpoint, the property is relatively
stable.
The topography of the site is flat to gently-sloping. Geologic
hazards due to mass movement caused by gravity, such as landslides,
mudflows, etc. , are riot anticipated at the site. With proper site
grading around the structures, erosional problems within the upper clay
soils should be minimal. The site lies within the drainage basin of The
Slough, an intermittent stream which is a tributary of the Cache La
Poudre River. The property does not appear to lie within the flood
plain of the stream and should not be subjected to its flooding.
Site Grading and Utilities
Specifications pertaining to site grading are included below and in
Appendix C of this report. It is recommended that the upper six (6)
inches of topsoil below building, filled and paved areas be stripped and
stockpiled for reuse in planted areas. All organic matter and other

the subgrade below building, filled and paved areas should be scarified
and recompacted two percent (2%) wet of optimum moisture to at least
ninety-five percent (95%) of Standard Proctor Density ASTM D 6_98-78.
(See Appendix C. ) The fill should consist of the on-site soils or
imported material -approved by the geotechnical engineer. The fill should
be placed in uniform six (6) to eight (8) inch lifts and mechanically
compacted two percent (2%) wet of optimum moisture to at least
ninety-five percent (95%) of Standard Proctor Density ASTM D 698--78.
Bedrock _encountered at the -site may be used as fill material.
Heavy-duty construction equipment equivalent to a U 9 tractor may be
needed to excavate the bedrock, and bedrock used as fill should be
broken into pieces less than six (6) inches in diameter. Proper
placement of the bedrock as fill may be difficult, and a disc or other
mixing equipment may be needed to obtain uniform moisture and proper
compaction. The bedrock may he used as fill in open and planted areas
or in the lower portion of fill below paved areas.
In computing earthwor-k quantities, an estimated shrinkage factor of
eighteen percent (18-%) to twenty--three percent (23%) may be used for
-the on-site clays compacted to the above-recommended density. A
shrinkage factor of fifteen percent (15%) -to twenty percent (20%) may be
used for the bedrock used as compacted fill.
Utility trenches dug four (LI) feet or more into the upper clay soils
should be excavated on slopes no steeper than 1 : 1 . The bedrock may
be excavated on vertical slopes. -Excavation of the bedrock may require
-the use of heavy-duty construction equipment. Where utilities -are
excavated below groundwater, dewatering will be needed during
placement of pipe and backfilling for proper construction. All piping
should be adequately bedded for proper load distribution.
Backfill placed in utility trenches in open and planted areas
should be compacted in uniform lifts at optimum moisture to at least
ninety percent (90%) of Standard Proctor Density ASTM D 698-78 the full
depth of the trench. The upper four (4) feet of backfill placed in
utility trenches under building and paved areas should be compacted at
or near optimum moisture to at least ninety-five percent (95%) of
Standard Proctor Density ASTM D 698-/8, and the lower portion of these

Standard Proctor Density ASTM D 698-78. Addition of moisture to
and/or drying of the subsoils may be needed for proper compaction.
Proper placement of the bedrock as backfill may be difficult, as is
discussed above.
Stripping, grubbing, subgrade preparation, and fill and backfill
placement should be accomplished under continuous observation of the
geotechnical engineer. Field density tests should be taken daily in the
compacted subgrade, fill, and backfill under the direction of the
geotechnical engineer.
Foundations
In view of the anticipated loads transmitted by the proposed
construction and the soil conditions encountered at the site, it is
recommended that the structures be supported by conventional-type
spread footings and/or continuous _grade beams. All footings and/or
grade beams should he founded on the original, undisturbed soil a
minimum of thirty (30) inches below finished grade for frost protection.
The identification and undisturbed nature of the soil and bedrock
stratum should be verified by the geotechnical engineer prior to
placement of -any foundation concrete. Tootings and/or grade beams
founded at the above level riiay be designed for a maximum allowable
bearing capacity of two thousand (2000) -pounds per square foot (dead
load plus maximum live load) . To counteract swelling pressures which
will develop if the upper clay soils become wetted, all footings and/or
grade beams founded on the upper clay soil a minimum of two (2) feet
above the bedrock stratum should be designed for a minimum dead load
of five hundred (500) pounds per square foot. Footings founded on or
within two (2) feet of the bedrock stratum should be designed for a
minimum dead load of -seven hundred fifty (750) pounds per square foot.
The predicted settlement under the above maximum loading, as
determined by laboratory consolidation tests, should be less than
three-fourths (3/4) inch, generally _considered to be within acceptable
tolerances.

Slays on Grade
Subgrade below slabs on grade should be prepared in accordance
with -the -recommendations discussed in the "Site Grading and Utilities"
section of this report. It is important that the moisture content of the
subgrade be two percent (2%) wet of optimum moisture just prior to
placement of underslab gravel and concrete. If the subgrade below
slabs on grade is allowed to dry below optimum moisture, it should be
rewetted just prior to slab construction. Slabs on grade supporting
heavy floor loads should be underlain by at least six (6) inches of
crushed gravel base course, compacted at optimum moisture to at least
ninety-five percent (95%) of Standard Proctor Density ASTM D 698-78.
(See Appendix C. ) Office and other areas transmitting light floor loads
should be underlain by a -minimum of four (4) inches of clean gravel or
crushed rock devoid of fines. The gravel base course and/or gravel
should help to distribute floor loads and should act as a capillary break.
Slabs on grade should be designed for the imposed loading, and it is
suggested that they be designed structurally independent of bearing
members. To minimize and control shrinkage cracks which may develop
in slabs on grade, we suggest that control joints be placed every ten
(10) to fifteen (15) feet and that the total area contained within those
joints be no greater than two hundred twenty-five (225) square feet.
Detention -Pond
It is -our understanding that a detention pond is to be constructed in
the -area of Borings 3 and 6 -at the site. The depth of the pond will be
approximately five (5) to six (-6) feet below -existing grades. In situ
permeability rates of the sandy -silty clays encountered in the proposed
pond area vary from .06 to 3.97 feet per year. Thin lenses of silty
-sand encountered within the clay stratum have higher permeability rates
of 1_6.10 feet per year. When the clay material is compacted to
ninety-five percent (95%) of Standard Proctor Density ASTM D 608-78,
the permeability is greatly reduced; and perrneabilities of 0.02 feet per
year were obtained in laboratory compacted samples. In view of the

Soil, groundwater, and geologic conditions encountered at the site, it is
our opinion the site is suitable for construction of the proposed
detention pond. It is recommended that the bottom of the pond be
placed a minimum of two (2) feet above existing groundwater. Where
this is not practical, temporary dewatering during construction will be
-required to properly excavate and/or line the pond. If the bottom of
the pond is placed below groundwater, it is recommended that water be
-kept in the pond to counteract hydrostatic pressures or that a drainage
system be provided below the bottom of the pond to lower water levels
and minimize damage to the lining caused by hydrostatic uplift. The
pond should be founded within the relatively impervious sandy silty clay
stratum. Lenses of silty sand encountered within the bottom or wetted
perimeter of the pond should be overexcavated a minimum of one (1 )
foot. The overexcavated areas should be backfilled with the on-site
sandy silty clays mechanically compacted in two uniform lifts to a
minimum of ninety-five percent (95%) of Standard Proctor Density ASTM
D 698-78. (See Appendix C.) The upper six (6) inches of the
clay subgrade below, the pond bottom and embankment area should be
scarified and tecompacted at or near optimum moisture to at least
ninety-five percent (95%) of Standard -Proctor Density ASTM D 6S8-78.
Embankment material used to form the T,orid should consist of the on-site
sandy silty clay soils mechanically compacted in uniform six (6) to eight
(8) inch lifts to a minimum of ninety-five percent (95%) of Standard
Proctor Density AS1 M D 698-78. It is suggested that the proposed pond
embankment should be placed on grades of 3:1 or flatter. For ease of
maintenance and construction, the top of the berm should be a minimum
of eight (8) to ten (10) feet wide. It is suggested that all topsoil
removed from within -the limits of the proposed pond be stockpiled and
_used to vegetate the pond slopes.
Parkinc Areas
1 he required total thickness for the pavement structure is dependent
primarily upon the foundation soil or subgrade and upon -traffic
conditions. Based on the soil conditions encountered at the site and the

anticipated type and volume of traffic and using a group index of 15 as
the criterion for pavement design, the following minimum pavement
-thicknesses are recommended:

Subyrade below proposed parking areas should be prepared in
-accordance with the recommendations discussed in the "Site Grading and
Utilities" section of this report. The surface of the subyrade should be
hard, uniform, smooth, and -true to grade. To prevent the growth of
weeds, it is suggested that all subgrade under parking areas be treated
with a soil sterilant.
The base course overlying the suhyrade should consist of a hard,
durahle, crushed rock or stone and filler and should have a minimum
"k" value of 80. 1 he composite base course material should be free from
vegetable matter and lumps or balls of clay and should meet the Colorado
Department of Highways Specification Class 6 Aggregate Base Course which
follows:

The base course should be placed on the subgrade at or near optimum
moisture and compacted to et least ninety-five percent (95%) of Standard
Proctor Density ASTM D 698-78. (See Appendix C. ) It is important that
the base course be shaped to grade so that proper drainage of the
parking area is obtained.
GENERAL RECOMMENDATIONS
(1 ) Laboratory test results indicate that water soluble sultates in
the soil are negligible, and a Type I cement may be used in
concrete exposed to subsoils. Slabs on grade subjected to
de-icing chemicals should be composed of a more durable
concrete using a Type II cement with low water-cement ratios
and higher air contents.
(2) Finished grade should be sloped away from the structures on -all
sides to give positive drainage. Ten percent (10%) for the first
ten (10) feet away from the structures is the suggested slope.
(3) Backfill around the outside perimeter of the structures should
he mechanically compacted at optimum moisture to at least ninety
percent (90%) of Standard Proctor Density AS1M D 698-7E.
(See Appendix C. ) Puddling should not be permitted as a
method of cornpac.tion.
(4) Plumbing and utility trenches underlying slabs and paved areas
should be backfilled with an approved material compacted to at
least ninety-live percent (95%) of Standard Proctor Density
ASTM D 698-78. Puddling should not be permitted as a method
of compaction.
(5) Cutters and downspouts should he designed to carry roof
runoff water well beyond the backfill area.

(6) Underground sprinkling systems should be designed such that
piping is placed a minimum of five (5) feet outside the backfill
of -the structure. Heads should be designed -so that irrigation
water is not sprayed onto the foundation walls. These
recommendations should be taken into account in the landscape
Manning.
(7) Footing and/or grade beam sizes should be proportioned to
equalize the unit loads "applied to the soil and thus minimize
differential settlements.
(8) It is recommended that compaction requirements specified herein
be verified in the field with density tests performed under the
direction of the geotechnical engineer.
(9) It is recommended that a registered professional engineer design
the substructures and that he take into account the findings
and recommendations of this report.
GENERAL COMMENTS
This report has been prepared to aid in the evaluation of the
property and to assist -the -architect and/or engineer in the design of
this project. In the event that -any Changes in the type of structures or
pond or their locations are planned, the conclusions and recommendations
contained in this report will not be considered valid unless said Changes
-are reviewed and conclusions of this report modified or "approved in
writing by fmpire Laboratories, Inc. , the geotechnical engineer of
record.
Variations in soil "and groundwater conditions between test borings
may be encountered _during con-struction. In order to permit correlation
between the reported subsurface conditions end the -actual conditions
encountered during construction and to aid in -carrying out the plans
and specifications as originally contemplated, it is recommended that
Empire Laboratories, Inc. be retained to perform continuous construction

review during the excavation and foundation phases of the work.

APPENDIX C.
Suggested Specifications for Placement of Compacted Earth Fill
and/or Backfills. ..
GENERAL
A soils engineer shall be on-site to provide continuous observation
during filling and grading operations and shall be the owner's repre-
sentative to inspect placement of all compacted fill and/or backfill on
the project. The soils engineer shall approve all earth materials prior
to their use, the methods of placing, and the degree of compaction
obtained.
MATERIALS
Soils used for all compacted fill and backfill shall be approved by the
soils engineer prior to their use. The upper two (2) feet of compacted
earth backfill placed adjacent to exterior foundation walls shall be an
impervious, nonexpansive material . No material , including rock, having
a maximum dimension greater than six inches shall be placed in any fill .
Any fill containing rock should be carefully mixed to avoid nesting and
creation of voids. In no case shall frozen material be used as a fill
and/or backfill material .
-PREPARATION OF SUBGRADE
All topsoil , vegetation (including trees and brush), timber, debris,
rubbish, and other unsuitable material shall be removed to a depth
satisfactory to the soils engineer and disposed of by suitable means
before beginning preparation of the subgrade. The subgrade surface of
the area to be filled shall be scarified a minimum depth of six inches,
moistened as necessary, and compacted in a manner specified below for
the subsequent layers of fill . Fill shall not be placed on frozen or
muddy ground.

PLACING TILL
No sod, brush, trozen or thawing material , or other unsuitable material
shall be placed in the fill , and no fill shall be placed during unfavorable
weather conditions. All clods shall be broken into small pieces, and
distribution of material in the fill shall be such as to preclude the
formation of lenses of material differing from the surrounding material .
The materials shall be delivered to and spread on the fill surface in a
manner which will result in a uniformly compacted fill . Each layer
shall be thoroughly blade mixed during spreading to insure uniformity of
material and moisture in each layer. Prior to compacting, each layer
-shall have a maximum thickness of eight inches, and its upper surface
shall be approximately horizontal . Each successive 6" to 8" lift of
fill being placed on slopes or hillsides should be benched into the
existing slopes, providing good bond between the fill and existing
ground.
MOISTURE CONTROL
While being compacted, the fill material in each layer shall as nearly
as practical contain the amount of moisture required for optimum compaction
or as specified, and the moisture shall be uniform throughout the fill .
The contractor may be required to add necessary moisture to the fill
material and to uniformly mix the water with the fill material if, in
the opini-on of the soils engineer, it is not possible to obtain uniforr
moisture content by adding water on the fill surface. If, in the opinion
of the soils engineer, the material proposed for use in the compacted
fill is too wet to permit adequate compaction, it shall be dried in an
acceptable manner prior to place ,ent and compaction.
COMPACTION
When an acceptable, uniform moisture content is obtained, -each layer
shall be compacted by a method acceptable to the soils engineer and as
specified in the foregoing report as determined by applicable standards.
Compaction shall be performed by rolling with approved tamping rollers,

pneumatic-tired rollers, three-wheel power rollers, vibratory compactors,
or other approved equipment well-suited to the soil being compacted. If
a sheepfoot roller is used, it shall be provided with cleaner bars
attached in a manner which will prevent the accumulation of material
between the tamper feet. The rollers should be designed so that effective
weight can be increased.
MOISTURE-DENSITY DETERMINATION
Samples of representative fill materials to be placed shall be furnished
by the contractor to the soils engineer for determination of maximum
density and optimum moisture or percent of Relative Density for these
materials. Tests for this determination will be made using methods
conforming to requirements of ASTM D 698, ASTM D 1557, or ASTM D 2049.
Copies of the results of these tests will be furnished to the owner, the
project engineer, and the contractor. These test results shall be the
basis of control for all compaction effort.
DENSITY TESTS
The density and moisture content of each layer of compacted fill will be
determined by the soils engineer in accordance with ASTM D 1556, ASTM D
2167, or ASTM D 2922. Any material found not to comply with the minimum
specified density shall be recompacted until the required density is
_obtained. Sufficient density tests shall be made and submitted to
support the soils engineer' s recommendations. The results of density
tests will also be furnished to the owner, the project engineer, and the
contractor by the soils engineer.

p . 'j The Poudre Fire Authority has two concerns that should be addressed.
FriFirst, the access as shown does not meet requirements as spelled out in
Section 10.207 of the 1982 Uniform Fire Code. We will require a turn-
around for our apparatus on site or irelane encircling the structures.
The minimum width of a fire lane is 20 ft. Minimum turning radii for
our equipment is 40 ft. outside and 20 ft. inside. In addition, the
access roadway needs to be within 150 ft. of all portions of the exterior
walls of the first story of any building. (See enclosure)
Water for fire suppression is the second concern that needs to be addressed
`j on this site. While the Poudre Fire Authority does maintain tankers, we do
LL II� not have the ability to provide the necessary water to protect the proposed
facility. The future plans to provide adequate water for fire fighting
should be included in the initial construction phase. We will require the
II' on-site storage to meet NFPA 1231 requirements. (See enclosure)

Dear Mr. Allison:
In response to Mr. Tom Norton' s request, I am writing you to
describe what Platte River Power Authority considers appropriate
use of our Rights-of-Way as a parking area. Enclosed is a copy
of a typical easement currently used .
Platte River is not in opposition to the joint use of our Trans-
mission Rights-of-Way. However any such joint use must be done
in strict adherence to the safety requirements of the National
Electric Safety Code and Platte River Power Authority. Conse-
quently Platte River requires review and approval of all design
drawings for any such facility. Our review would address such
issues as -ground elevation and the .location of traffic ways such
as curb cuts or cul-de-sacs.
Platte River is prepared to approve the use of our Rights-of-Way
for parking areas provided that the intended users of such
Rights-of-Way submit plans for our review and obtain a permit
for construction from Platte River in writing.
We would be available to discuss the procedures for submitting
such plans for our review and subsequent approval .

Ladies and Gentlemen :
Champlin Petroleum Company has received notice that a hearing
is scheduled for Tuesday, February 21 , 1984 to consider the
application for a Special Use Permit allowing intensive agri-
cultural use.
Union Pacific Land Resources Company, an affiliate of Champlin
Petroleum Company, owns the oil and gas estate underlying the
above-referenced Section 3; Champlin Petroleum Company has the
right to acquire those interests from Union Pacific Land Re-
sources Company.
It is my understanding from a telephone conversation with Rod
Allison that the applicant has not requested a zoning change
from the present agricultural classification , and that oil and
gas extraction will remain a use by right . Therefore, Champ-
lin Petroleum Company has no objection to the proposed Special
Use Permit . Nevertheless, Champlin may wish in the future to
exercise its right to drill wells and extract oil and gas from
the affected property and therefore asserts its position that

The following are remarks pertinent to the application for a Use by Special Review
submitted by Tech-America Group, Inc. for an animal research facility located in
part of the SW' of Section 3, T7 North, R67 West, of the 6th P.M., Weld County,
Colorado.
The greatest concern appears to be the retention of animal wastes on the site without
risk of contaminating the Larimer Co. Canal, Black Hollow Reservoir or the ground-
water.
Since any runoff from the animal holding facilities will be channelled directly
into an impervious holding pond, and since no large stockpiles of manure are to be
maintained at the site but periodically spread onto surrounding cropland and pas-
tureland, it seems that the problem of any possible contamination has been planned
for in a sufficient manner.
Substantial imput has already been provided by Empire Labs, Inc. regarding any possi-
ble soil limitations on the site. There appears to be no conflicts between their
statement and any special consideration as may have been set forth by the South Weld
County Soil Survey.
I do, however, have some concerns regarding the future landscaping plans for the
site. Since a good percentage of the total area under consideration is to be seeded
to permanent grass pasture for the purpose of erosion control and livestock feed,
and since the soils on the site tend to be shallow and have a low soil loss tolerance,
I feel that the species selection as well as the future management applied should
meet certain requirements.
Slope ,n the site is approximately 4 percent in some of the steeper areas so there is
a p. _. .bility of water erosion as well as wind erosion. Dryland grass mixtures, as
sold by many seed companies, often contain a variety of species which may or may not
be successful on the soils in question. Any dryland grass mixtures should be limited
to native species that are compatible with each other as well as the soils on which
they are planted. Any introduced grasses should be planted singularly or perhaps
with one other well adapted perennial such as a small amount of dryland alfalfa. At
any rate, rhizomatous species should be preferred over bunch grass types for their
erosion prevention qualities. Yellow sweetclover, crested wheatgrass and any mixtures
containing even a small portion of annual ryegrass would be better avoided under exist-

Our comments:
1. The pond must be designed and constructed per the Colorado
Department of Health's Guidelines for the Design of Feedlot
Runoff Containment Facilities. The pond msut be approved by
the Colorado Health Department Water Quality Control Division's
District Engineer. I suggest that a referral be made to him.
(Bud Mahn - telephone 320-8333).
2. The individual sewage disposal facility must be engineer-designed
and approved by the Weld County Board of Health. Permit appli-
cations may be obtained at our office.
3. Any pathological incinerator planned must be approved by and
permitted through the Colorado Department of Health's Air
Pollution Control Division (telephone 320-4180) .
4. I am concerned with the various types of organisms which may
be used to infect the animals and how impact to the public
will be negated. We require that a list of organisms be
submitted to both the Colorado Department of Health's Zoonoses
Division (Dr. Emerson) and to our department. I am concerned
with the effects of building a pond (which may be filled with
pathogenic organisms) adjacent to a major irrigation canal
without any controls other than construction guides.

Based upon a telephone conversation with Dr. Steve Stroh on 2-8-84,
-I can make the following comments:
1. No site incinerator is planned. Dead small animals
(dogs and cats) are taken to the CSU incinerator.
Larger animals are disposed of through bi-products
companies. Larger animals, if considered a potential
biohazard, are taken to the Larimer County Landfill
by Tech-America personnel. Weld County Health
Department has no problems with the above-delineated
procedures.
2. Dr. Stroh is sending me a list of organisms with which
they will use to inoculate animals. The list is filed
with the USDA-APHIS office. Organisms to be used are
those commonly found in any feedlot operation and are
not considered hazardous.
