FAGERBERG WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners , pursuant to its authority under Section 30-28-101 (10) (d) , CRS , as amended, did determine at a public meeting held in the Chambers of the Board, that a certain parcel of land, to be divided into two parcels, as shown on the plat known as Recorded Exemption No. 673 , does not come within the purview of the definition of the terms, "subdivision" and "subdivided land" , and WHEREAS, the request for Recorded Exemption No. 670 was submitted by Kenneth C. Fagerberg for property being located in Part of the NW4, Section 16 , Township 7 North, Range 66 West of the 6th P.M. , Weld County, Colorado, being more particularly described in the plat which shall be provided by the applicant and known as Exhibit "A" , said plat to be recorded, and WHEREAS, this request is to divide the property into par- cels of 66. 89 acres and 5. 11 acres, more or less, so the appli- cant may sell the smaller parcel, with the larger parcel remain- ing in irrigated cropland. NOW, THEREFORE, BE IT RESOLVED by the Board of County Com- missioners of Weld County, Colorado that the hereinabove described parcel of land be, and hereby is, exempt from the definition of the terms, "subdivision" and "subdivided land" . BE IT FURTHER RESOLVED by the Board that this approval is conditional upon the applicant submitting a mylar plat to the Department of Planning Services to be recorded in the office of the Weld County Clerk and Recorder. Fagerberg for a recorded exemption. The parcel of land on which this request is being made is described as Part of the NWT, Section 16, T7N, R66W of the 6th P.M. , Weld County, Colorado. The property is located 3 miles west of Ault on State Highway 14. The property contains approximately 72 acres of Class Ile (prime) IVe irrigated and IVe, VIe nonirrigated soils. The request is to divide the property into parcels of 66.89 acres and 5. 11 acres, more or less. The smaller parcel will be sold to Northern Colorado Pork Producers and will be used as a swine handling, transfer station. The larger parcel will remain irrigated cropland. Based upon the submitted information and policies of the County, the Department of Planning Services staff recommends the request be approved for the following reasons: 1. The request complies with Section 9-2C. of the Weld County Subdivision Regulations submission requirements; and 2. The request complies with Section 9-2E. of the Subdivision Regulations as follows: The 72 acres, more or less, under consideration will be compatible with the existing surrounding land uses and with future development of the surrounding area as permitted by the existing Agricultural Zone. The proposal is also consistent with the intent of the Agricultural Zone district in which it is located. 8/-1.010 Board of County Commissioners Page 2 - The proposal was reviewed by the city of Ault and was found to comply with their long-range Comprehensive Plan. - The proposal is in compliance with Section 1-3 of the Weld County Subdivision Regulations and the proposed land division complies with the Weld County Comprehensive Plan. Therefore, the proposed use is consistent with efficient and orderly development. - The proposal does not exist in an overlay district area. - The proposed lots meet minimum lot size requirements for land division. - North Weld County Water has indicated adequate water service is available for this proposal. - The proposed lots are not part of a recorded exemption within the last five (5) years. - The two lots proposed will have adequate access from State Highway 14 and Weld County Road 29. The Department of Planning Services staff recommendation for approval is conditional upon the following: 1. The applicant shall submit a mylar plat to the Department of Planning Services to be recorded in the office of the Weld County Clerk and Recorder. The plat shall be drawn in accordance with the requirements of Section 9-2C. (4) of the Weld County Subdivision Regulations. The purpose of this request is to allow splitting off approximately 5. 110 acres from a larger parcel that I own. The Northern Colorado Pork Producers Association currently has a lease, with option to buy, on this 5.110 acre parcel. Purchase is subject obtaining a Recorded Exemption. The Association has constructed a building on this property in good faith that a Recorded Exemption can be obtained. 2. Consistency With Weld County Comprehensive Plan: The proposed Special Use is consistent with the Weld County Comprehensive Plan. Activities proposed for the Special Use site are agricultural—related and the site is zoned "Agriculture" . 3. Consistency With Intent of District: The proposed Special Use is consistent with the intent of the district. All land surrounding the Special Use site is zoned "Agriculture" for several miles in all directions. 4. Compatibility With Surrounding Land Uses : The proposed Special Use is compatible with surrounding land uses. Within one—half mile of the Special Use site there are a sheep feedlot and a cattle feedlot. All other land around the Special Use site is used for grazing or for cultivated crops. 5. Compatibility With Future Development of Surrounding Area: The proposed Special Use is compatible with future development of the surrounding area. The Weld County Comprehensive Plan indicates that this area will remain agricultural for the foreseeable future. 6. Efficient and Orderly Development : The proposal is not inconsistent with efficient and orderly development. The entire area is zoned Agriculture and is significantly removed from population centers. The Weld County Comprehensive Plan does not indicate any development anywhere near the project site in the foreseeable future. 7. Compliance With Overlay District Regulations: The project area for the proposed Special Use is outside of all Overlay Districts according to existing Weld County Overlay Maps. Therefore, this application complies with Weld County Zoning Ordinance , Section 50, Overlay District Regulations. 8.
