HomeMy WebLinkAbout800618.tiff RESOLUTION RE: APPROVAL OF RECORDED EXEMPTION NO. 453 - LARRY AND JEAN REID WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, it has been determined by the Board of County Com- missioners of Weld County, Colorado, at a public meeting held on the 30th day of July, 1980 in the Chambers of the Board of County Commissioners of Weld County, Colorado, that the division into two parcels of land, as shown on the plat known as Recorded Exemption No. 453 , being the property of Larry and Jean Reid, described as Part of the North Half of the Southwest Quarter of Section 14 , Township 1 North, Range 67 West of the 6th P.M. , Weld County, Colorado, being more particularly described as follows does not come within the purivew of the definition of the terms, "subdivision" and "subdivided land" , pursuant to its authority under Section 30-28-101 (10) (d) , CRS 1973 , as amended: That portion of the North Half of the South- west Quarter of Section 14 , Township 1 North, Range 67 West of the 6th P.M. , County of Weld, State of Colorado, being more particularly described as follows: Beginning at the West Quarter corner of said Section; thence North 89°15 '45" East along the North line of said Southwest Quarter 2635. 50 feet to the Northeast corner of said Southwest Quarter; thence along the East line of said Southwest Quarter, South 00°07 ' 00" West 740 . 10 feet to the centerline of the Brantner Ditch; thence along said denterline the following seven courses: South 70°45 ' 53" West 99 . 12 feet; thence South 80°04 ' 53" West 250 .60 feet; thence North 80°12 ' 52" West 462. 50 feet; thence North 87°53 ' 52" West 130. 60 feet; thence North 83 ' 14 ' 22" West 167. 70 feet; thence North 62°58 ' 02" West 94 . 50 feet; thence North 67°34 ' 32" West 198 . 30 feet; thence South 88°48 '45" West 1273. 13 feet to the West line of said South- west Quarter; thence along said West line North 586.64 feet more or less to the point of BEGINNING. The above described parcel contains a gross acreage of 39 . 95 acres more or less. 80061d WHEREAS, the Board of County Commissioners of Weld County, Colorado finds that this particular division of land is not within the purposes of the Weld County Subdivision Regulations and the Board desires to exempt this particular division of land from the definitions of "subdivision" and "subdivided land" pursuant to its authority under Section 30-28-101 (10) (d) , CRS 1973 , as amended, and Section 2-1A(3) of the Weld County Subdivision Regu- lations. NOW, THEREFORE, BE IT RESOLVED by the Board of County Com- missioners of Weld County, Colorado that the hereinabove described parcel of land owned by Larry and Jean Reid be, and hereby is, exempt from the definition of the terms "subdivision" and "subdi- vided land" pursuant to its authority under Section 30-28-101 (10) (d) , CRS 1973 , as amended, provided that the applicants submit an access agreement which will grant ingress and egress to the proposed 9. 83 acre parcel which has no frontage along the County Road, said agreement to be recorded at the time the Recorded Exemption Plat is recorded. The property under consideration is described as part of the N1 SW1, Section 14, T1N, R67W of the 6th P.M. , Weld County, Colorado. This property is located 1i miles southwest of Fort Lupton. The property contains approx- imately 40 acres of Class II and III irrigated soils. The request is to divide the property into parcels of 30.12 and 9.83 acres. On May 5, 1980 the Board of County Commissioners approved a request from the Reids for a Lot Size Variance so that they could make application for this recorded exemption. At the time the Board made the decision on that request, the Department of Planning Services Staff submitted a letter of recommendation for denial to the Board. A copy of the recommendation letter is included in the attached materials. Nothing has been received by our office which would change our recommendation of denial for this request as outlined in the letter to the Board dated April 25, 1980. On June 12, 1980 the Weld County Board of Adjustment approved a request from the Reids for a variance of 180 feet from the 180 foot minimum lot width requirement along a public road as set forth in Section 3.14 of the Weld County Zoning Resolution and Section 9-4 A. (3) of the Weld County Subdivision Regulations. If this request is approved the Board should consider as a condition of approval having the Reids submit an access agreement which will grant ingress and egress to the proposed 9.83 acre parcel which has no frontage along the County Road. The property on which this request has been made is described as part of the N1 SW3s of Section 14, T1N, R67W of the 6th P.M. , Weld County, Colorado. This property is located 11 miles South and 111 miles West of Fort Lupton. The property under consideration contains approximately 40 acres of Class II and III irrigated soils. The request is to obtain a variance from the minimum lot size requirement, Section 9-4. A.A.(6) of the Weld a recorded exemption. The proposed request does not comply with the Weld County Comprehensive Plan because it would promote nonagricultural use of agricultural land and it would encourage urban en- croachment on rural land use. The Plan urges residential development to be closely connected to and served by municipal utilities with towns being encouraged to service new develop- ments within a reasonable service area from its incorporated boundaries. The Plan further indicates subdivision of land should conform to the overall development goals and policies of the Comprehensive Plan. 800618 ,f // Board of County Commissioners April 25, 1980 Page 2 2. The request is not in conformance with the intent clause of the Agricultural Zone District, Section 3.3.A. of the Weld County Zoning Resolution. This request would not be encour- aging agricultural uses as the highest and best uses, it would not be providing for the orderly expansion of urban growth, it would be promoting the division of agricultural land into smaller, less economic parcel sizes, and increasing the residential density on the property. The parcel contains only one set of improvements. This request would allow another residence to be built on the 30 acre parcel. Furthermore, the request would place a greater demand on the services which residential uses require. 3. This request is not in compliance with the intent clause of the recorded exemption procedure, Section 9-2 of the Weld County Subdivision Regulations. The parcel has Class II and Ill irrigated soils. Additionally, the nature of the re- quest is not providing for the orderly expansion of urban growth in accordance with the Comprehensive Plan. The De- partment of Planning Services Staff feels that if residential development increases in the area, inefficient development will result. 4. The minimum lot size in the Agricultural Zone District for irrigated parcels is 80 acres and for nonirrigated parcels is 160 acres. The intent is to maintain tracts which are large enough for farm purposes, and to assist in the encourage- ment of agricultural uses as the highest and best use of the land.
