RE : APPROVAL OF USE BY SPECIAL REVIEW FOR GREYHOUND KENNEL -
PHILIP BREEDLOVE
WHEREAS , the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS , the Board of County Commissioners held a public
hearing on the 27th day of June, 1984, at the hour of 2 : 00 o 'clock
p.m. in the Chambers of the Board for the purpose of hearing the
application of Philip Breedlove, 15027 Weld County Road 18 , Fort
Lupton, Colorado 80621, for a Use by Special Review for a greyhound
kennel on the following described real estate, to-wit:
Part of the 141/2 SW4, Section 22 , Township 2
North, Range 66 West of the 6th P .M. , Weld
County, Colorado
WHEREAS, Section 24 . 4 . 2 of the Weld County Zoning Ordinance
provides standards for review of said Use by Special Review, and
WHEREAS , the Board of County Commissioners heard all of the
testimony and statements of those present, has studied the
request of the applicant and the recommendations of the Weld County
Planning Commission and all of the exhibits and evidence presented
in this matter, and having been fully informed, finds that this
request shall be approved for the following reasons :
1. The submitted materials are in compliance with the
application requirements of Section 24. 7 of the Weld
County Zoning Ordinance.
2 . It is the opinion of the Board of County Commissioners
that the applicant has shown compliance with Section
24. 4. 2 of the Weld County Zoning Ordinance as follows:
a. The proposal is consistent with the Comprehensive
Plan policies in that the use does not infringe
on continued agricultural use in the vicinity or
County. The proposal does not appear to have
any adverse impacts on the agricultural interests
of the County or the environment.
b. The proposal is consistent with the intent of the
Agricultural Zone District and is provided for as
a Use by Special Review.

c. The activities proposed will be compatible with
existing agricultural uses, as well as with the
future projected development in the immediate
area. The future uses are intended to remain
agricultural in nature. The intended proposal
will not have any significant traffic or noise
impacts.
d. The proposal was reviewed by the City of Fort
Lupton and was found to be in compliance with
their Comprehensive Plan.
e. No overlay districts affect the site.
f. Use by Special Review Operation and Design
Standards provide adequate protection of the
health, safety and welfare of the neighborhood
and County.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado, that the application for a
Use by Special Review for a greyhound kennel on the hereinabove
described parcel of land, be, and hereby is , granted subject to
the following conditions:
1. The attached Standards for Use by Special Review be
adopted and placed on the Use by Special Review plat
prior to recording.
2. The prescribed Use by Special Review activity shall not
occur nor shall any building or electrical permits be
issued on the subject property until the Use by Special
Review plat has been delivered to the Department of
Planning Services office and the plat has been recorded
in the office of the Weld County Clerk and Recorder.
3 . A revised mylar plat shall be submitted to the Depart-
ment of Planning Services showing a main title, a proper
legal description and an easement for Panhandle Eastern
Pipe Line.
4 . Prior to recording Use by Special Review 631: 84 :27 with
the Weld County Clerk and Recorder, the applicant shall
submit a letter from the Division of Water Resources
indicating that an adequate water source is available
to service the proposed facility.

OPERATION STANDARDS
Breedlove Greyhound Kennel
U.S.R. - 631:84:27
1. The uses permitted shall be a Kennel facility for a maximum of two
hundred and fifty (250) greyhound dogs as described in the application
materials on file with the Department of Planning Services.
2. The greyhound kennel shall comply with the Colorado Racing Commission's
Greyhound Racing Rule Book, Section 17, if racing is to be conducted at
the Use by Special Review facility.
3. Prior to starting the greyhound kennel operation, the applicant shall
submit a revegetation plan to the Platte Valley Soil Conservation
District and to the Department of Planning Services.
4. The applicant shall comply with the design standards for the Use by
Special Review, Section 24.5 et seq. , of the Weld County Zoning
Ordinance.
5. The applicant shall comply with the Operation Standards for Uses by
Special Review, Section 24.6 et seq. , of the Weld County Zoning
Ordinance.
6. Representatives or members of the Weld County Health Department and Weld
County Department of Planning Services shall be granted access onto the
site at any reasonable time in order to insure the operations carried out
on the site comply with the Development Standards stated hereon and all
applicable Weld County Regulations.
7. The Use by Special Review shall be limited to the plans shown hereon and
governed by the Standards as stated above and all applicable Weld County
Regulations. Any material deviations from the plans and/or Standards as shown
or stated above shall require the approval of an amendment of the Permit by
the Weld County Planning Commission and the Board of County Commissioners
before such changes from the plans and/or Standards are permitted. Any other
changes shall be filed in the office of the Department of Planning Services.
8. The property owner and/or operator of this operation shall be responsible
for complying with all of the above stated Standards. Noncompliance with
any of the above stated Standards may be reason for revocation of the
_Permit by the Board of County Commissioners.
9. A suitable program for the disposal of animal waste shall be agreed upon
by the applicant and the Weld County Health Department, and shall comply
with all applicable Weld County Health Department and Colorado State
Health Department regulations.
10. The Use by Special Review Permit shall not be transferable by the
applicant and/or owner to any successors; the Use by Special Review
_Permit shall terminate automatically upon conveyance or lease of the
property with others for operation of the facility.

The following business was transacted:
I hereby certify that pursuant to a notice dated June 11, 1984, and duly pub-
lished in the La Salle Leader on June 14, 1984, a public hearing was conducted
on June 27, 1984, to consider the request of Philip Breedlove for a Use by
Special Review for a Greyhound kennel. Lee Morrison, Assistant County Attorney,
read this matter into the record. Michael Mullen, Planning Department repre-
sentative, read the favorable recommendation from the Planning Commission into
the record. He said this recommendation is subject to four conditions and
eight Operation Standards. Philip Breedlove was present and came forward to
answer questions of the Board. Following discussion, Mr. Morrison suggested
that two additional Operation Standards be considered for this request. The
first addition would address establishing a suitable program, which would be
agreed upon by the applicant and the Health Department, for the disposal of
the animal waste. The second additional Standard which he recommended would
state that this permit would be non-transferable. After further discussion,
Commissioner Johnson moved to approve this Use by Special Review, based upon
the recommendation of the Planning Commission, subject to the amended Opera-
tion Standards, with the correct verbage to be provided by the Planning staff.
Commissioner Brantner seconded the motion and it carried unanimously.

The Weld County Planning Commission will conduct a public hearing on
Tuesday, June 5, 1984 at 1:30 p.m. to review a request
-for approval of a Use by Special Review Permit for a Greyhound Kennel
for Philip Breedlove
on a parcel of land described as part of the West 1/2, Southwest 1/4,
Section 22, Township 2 North, Range 66 West of the 6th P.M. ,
Weld County, Colorado

Dear Mr. Mullen:
We have reviewed additional information concerning the proposed Breedlove
Kennel. The applicant proposes to supply the kennel with a new well. the
proposed kennel would occupy 32.249 acres and a 24.575 acre tract would also
be created by the proposal.
We believe a well permit would be available in the Laramie-Fox Hills
formation and that adequate water would be available for the proposed use -of
the 32.249 acre tract. We would consider the use to be commercial and, there-
fore, we must make our recommendation for approval of the use by special
review conditional upon issuance of a suitable well permit.
There is an old well constructed in 1954 to a depth of 650 feet on the
property. The applicant apparently does not intend to use this old well.
Information about the well is insufficient for us to authorize any commercial
use. Unless the applicant intends to late-register the old well, we ask that
it be properly plugged and abandoned in accordance with the rules and regula-
tions for water well drillers.
We can recommend approval of this proposal provided the applicant is
successful in obtaining a satisfactory well permit.

Dear Sir:
After visiting with your wife on 6-11 -84 about your vegetation plan for
those areas outsi-de the actual runs, I would suggest the -Following:
While annual Tye will provide adequate cover in protecting the soil ,
it does Tot compare to a permanent grass _cover. -With the extremes
of the climate, some years may pose serious problems in getting -a
Tye stand established. In drier years, an established stand of grass
may be slow to -start but would have -a developed root system with
which to store needed plant nutrients for growth as well as protect
the soil -from wind erosion. All in all , I would still recommend a
permanent type seeding. I would suggest seeding YON PLS/Ac (pure live
seed) of Crested Wheatgrass. This grass is fairly easy to seed, es-
tablishes well and has a fair Tate of spread. Once established this
coulxl also the utilized in your operation.

1. The uses permitted shall be a Kennel facility for a maximum of two
hundred and fifty (2550) greyhound dogs as described in the application
materials on file with the Department of Planning Services.
2. 'The greyhound kennel shall comply with the Colorado Racing Commission's
Greyhound Racing Rule Book, Section 17, if the dogs are to be used for
racing.
3. Prior to -starting the greyhound kennel operation, the applicant shall
submit a revegetation plan to the Platte Valley $oil Conservation
District -and to the Department of Planning Services.
4. The applicant shall comply with the design standards for the Use by
Special Review, Section 24.5 et seq. , of the Weld County Zoning
Ordinance.
5. -The applicant shall comply with the Operation Standards for Uses by
Special Review, Section 24.6 et seq. , of the Weld County Zoning
Ordinance.
6. Representatives or members of the Weld County Health Department and Weld
County Department of Planning Services shall be -granted access -onto the
site at any reasonable time in order to insure the operations carried out
on the site comply -with the Operation Standards stated hereon and all
applicable Weld County Regulations.
7. The Use by Special Review area shall be limited to the plans shown hereon
and governed by the Standards as stated above and all applicable Weld
County Regulations. Any _material deviations from the plans and/or
Standards as shown or stated above shall require the approval of an
amendment of the Permit by the Weld County Planning Commission and the
Board of County Commissioners before such changes from the plans and/or
Standards are permitted. Any other changes shall -be filed in the office
of the Department of Planning Services.
8. The property -owner and/or operator of this operation shall be responsible
for complying with all of the above stated Standards. Noncompliance with
any of the above stated Standards may be reason for -revocation of the
Permit by the -Board of County Commissioners.

THE DEPARTMENT OF PLANNING SERVICES STAFF RECOMMENDS THAT THIS -REQUEST BE
APPROVED FOR THE FOLLOWING -REASONS:
1. The submitted materials are in compliance with application requirements
of Section 24.7 of the Weld County Zoning _Ordinance.
2. It is the opinion of the Department of Planning Services staff that the
applicant has shown compliance with Section 24.3. 1 et seq. of the Weld
County Zoning Ordinance as follows:
- The proposal is consistent with the Comprehensive Plan Policies in
that the use does not infringe on continued agricultural use in the
vicinity or County. The proposal does not appear to have any
adverse impacts on the -agricultural interests of the County et the
environment;
- The proposal is consistent with the intent of the Agricultural Zone
District and is provided Tor -ass Use by Special Review;
- • The activities proposed will be compatible with existing
agricultural uses, as well as with the future Projected development
in the immediate area. _The future uses are intended to remain
agricultural in nature. The intended proposal will not have any
significant traffic or noise impacts;
- The Proposal was reviewed -by the City of Ft. Lupton and was found to
be in compliance with their Comprehensive Plan.
- No overlay _districts affect the site.
- Use by Special Review Operations and Design Standards provide
adequate protection of the health, safety and welfare of the
neighborhood and County.
The Eepartment of Planning Services staff recommendation for approval is
conditional upon the following:
1. The attached Standards for Use by Special Review be adopted and placed an
the Use by Special Review plat prior to recording.
2. The prescribed Use by Special Review activity shall not occur nor shall
any building or electrical permits be issued on the subject property
until the Use by Special Review plat has been delivered to the Department
of Planning Services office and the plat has been recorded in the office
of the Weld County Clerk and Recorder.
3. -A revised mylar plat shall be submitted to the Department of Planning
Services showing a main title, a proper legal description and an easement
for Panhandle Eastern Pipe Line.
4. Prior to recording USR 631:84:27 with the Weld County Clerk and Recorder,
the applicant shall submit a letter from the Eivisicr f Water Resources
inaicating that an aaequate water source is avaiiaoie to service cee
proposed facility.

DETERMINATIONS TO BE MADE BY THE BOARD OF
COUNTY COMMISSIONERS ON USE BY SPECIAL REVIEW REQUESTS
24.4.2 The Board of County Commissioners shall hold a public
hearing to consider the application and to take final
action thereon. In making a decision on the proposed Use
by Special Review, the Board shall consider the
recommendation of the Planning Commission, and from the
facts presented at the public hearing and the information
_contained in the official record, which includes the
Department of Planning Services case file, the Board of
County Commissioners shall approve the request for the
Special Review Permit unless it finds that the applicant
has not met one or more of the standards or conditions of
Sections 24.2.2, 24.5 (design standards) and
24.6(operation standards) . The applicant has the burden
of proof to show that the standards and conditions of
24.4.2, 24.5 (design standards) and 24.6 (operation
standards) are met. The applicant shall demonstrate:
24.4.2. 1 That the proposal is consistent with the Weld County
Comprehensive Plan.
24.4.2.2 That the proposal is consistent with the intent of the
district in which the USE is located.
24.4.2.3 That the USES which would be permitted will be compatible
with the existing surrounding land USES.
24.4.2.4 That the USES which would be permitted will be compatible
with the future DEVELOPMENT of the surrounding area as
permitted by the existing zone and with future DEVELOPMENT
as projected by the COMPREHENSIVE PLAN of the COUNTY or
the adopted MASTER PLANS of affected municipalities.
24.4.2.5 That the application complies with the Weld County Zoning
Ordinance, Section 50, Overlay District Regulations if the
proposal is located within any Overlay District Area
identified by maps officially adopted by Weld County.
24.4.2.6 That if the USE is proposed to be located in the
A—District, that the applicant has demonstrated a diligent
effort has been made to conserve productive agricultural
land in the locational decision for the proposed USE.
24.4.2.7 That there is adequate provision for the protection of the
health, safety and welfare of the inhabitants of the
NEIGHBORHOOD and the COUNTY.

kennel. They will breed dogs here and have puppy kennels. They would like

have two mobile homes on the property for employees. This is a thirty-three
acre site, but only seven to eight acres will be used for the greyhound
operation.

William Ray Adams, Sr. , applicant, reported they wanted to created a rural
residential subdivision. He is working with the Weld County Engineering
Department to supply access to all of the lots. The covenants state there
can only be three horses per thirty-six acre lot to prevent overgrazing.
He has worked with the County Attorney so the covenants would run with
the benefit of the County and;. therefore, enforcable by the County. Lee
Morrison clarified that the only County enforcable covenants would be the
open-space provisions.
The Chairman asked Mr. Adams if he had read the recommendations and condi-
tions as outlined by the Department of Planning Services staff. He stated

Gerry McRae, McRae and Short, Inc. , stated the State Board of Reclamation
will review this request next week. This request is for a limited ten acre
gravel pit. This is a small operation and will be pit run gravel. There
will be no washing, crushing or grading of the gravel. Reclamation plans
call for grading to match the surrounding pasture so it will be used for
grazing as it is reclaimed. There will be very little open exposure on
this pit at any one time. This is a dry pit and no water will be opened
to the surface. This is not a large commercial pit; usage will be
primarily by local people who live in the area.

Mike Mullen reported Weld County School District RE-2 would like to install
new septic tanks and seepage beds for the Galeton Elementary School. The
domestic facility is designed for a capacity of two-hundred-twenty (220)
students.
Lee Morrison stated the Water Quality Control Division makes a distinction
between septic permits of special sizes. Even if both the Planning Commis-
sion and the Board of County Commissioners were to recommend denial, the
Water Quality Control Division can still approve this request.
The Chairman called for discussion from the audience. Steve Wornsman,
Western Technical Services reviewed what they will be doing and where the
new septic tanks will be placed.
Lee Morrison explained this request is not forwarded to the Board of
County Commissioners as a recommendation. Both Boards forward their
individual decisions to the Water Quality Control Division.
MOTION:
Doug Graff moved this request for a new septic tank and seepage bed for
Weld County School District RE-2 be approved by the Planning Commission
and that the Chairman be instructed to sign the necessary forms for the
Planning Commission's recommendation for approval. Motion seconded by
Louis Rademacher.

Dear Mr. Mullen:
We have received the above referenced proposal. Unfortunately, insuffi-
cient information was submitted for our review. We require a narrative water
supply plan which includes at least the following information:
1. A plat and -legal description of the affected property. Has this
property been involved in a Previous exemption since 1972?
2. Well permit number or numbers for existing and permitted wells when
available. Names of previous owners, date each wells were con-
structed, _depth, etc. , if permit number or numbers are not available.
3. Existing use of water supply on the property as it now exists. 'this
should include information on the number and location of dwellings
supplied, area of irrigated lawn and garden, water use for livestock,
etc.
4. If any subdivision is involved in this application, then the water
supply proposal for each lot must be detailed.
5. Water requirements for each of the proposed lots. Will more than one
dwelling be allowed? Proposed area of lawn and garden for each lot.
Will horses or livestock be allowed?
We will be happy to review this proposal once -a water supply plan is
transmitted. Until that time, we must recommend that this proposal be held in
abeyance.

Reviewing the Use by Special Review Permit for a Greyhound Ken-
nel, Philip Breedlove, case #USR 631; Colorado Health Department
Regulations specifically exempt greyhound kennels from the rules and
regulations enforced by this Department.
You may wish to contact the Colorado Racing Commission to de-
termine if there are any concerns they have with the proposed
application.
-From the minimal information received by this office, I have
the following comments:
1. It should be Aetermined that the well water to be
provided the animals is potable.
2. The installation of individual sewage disposal system
for animal wastes should be permitted and approved by
-the -Weld County Health Department.
3. It may be difficult or impossible to dispose of the
indicated quantity of animal wastes at the applicant's
property without causing a public health nuisance. A
disposal method should be arranged following contact
with Wes Potter, Weld County Health Department, Environ-
mental Health Division.
She transportation of such wastes to a sanitary landfill
may be necessary.

We have reviewed the above referenced plan and have the following comments:
1 ) -The soils in this area are sandy textured and very susceptible to wind
erosion. The land is currently -being used for wheat production. In
order to prevent wind erosion, it is imperative that those areas not
occupied by the kennels -be seeded to some type of _permanent vegetation.
We woul-d recommend that the applicant contact the Soil Conservation Ser-
vice office in Brighton (659-7004) for their recommendation3.
Until some type of revegetation plan is submitted, we cannot support this
project.
