' Planning Commission Recommendations July 1 , 1980 SUP-425:80:15 of the referral entities which have reviewed this request. The Planning Commissions recommendation for approval is conditional upon the following: 1 . The attached Operations Standards being recommended and approved for this request. 2. The following note being placed on the Special Use Permit plat: NOTE: The Mined Land Reclamation Board has the authority to issue permits for mining and reclamation activities. Activities related to mining and reclamation are, therefore, under the jurisdiction of the Mined Land Reclamation Board, however, Weld County has jurisdiction of those matters outlined in the Operations Standards. 3. The Operations Standards being placed on the Special Use Permit plat. The Special Use Permit plat shall be delivered to the Department of Planning Services. 4. The applicant identifying the 100 year floodplain boundaries on the plat prior to the Board of County Commissioners hearing. VT/dr 7/7/80 OPERATIONS STANDARDS WELD COUNTY SUP-425:80:15 1. The uses permitted on this site shall be the extraction of sand and gravel as described in the application materials and all other uses permitted by right under Section 3.3.B. of the Weld County Zoning Resolution. 2. No excavation or processing of materials shall be permitted nearer than 10 feet to the boundary of adjacent property, easement or irrigation ditch or right-of-way, nor nearer than 125 feet to any existing residence. 3. All extraction operations shall be conducted during the hours of daylight except in the case of public or private emergency or to make necessary repairs to equipment. This restriction shall not apply to operation of administrative and executive offices or repair facilities located on the property. 4. The Special Use Permit area shall be maintained in such a manner so as to prevent soil erosion, fugitive dust and growth of noxious weeds. The site shall be maintained in such a manner as to present a neat and well kept appearance. 5. Existing trees and ground cover along public road frontage and drainageways shall be preserved, maintained and supplemented if necessary, for the depth of the setback in order to protect against and/or reduce noise, dust and erosion 6. Where topsoil is removed, sufficient arable soil shall be set aside, for respreading over the excavated area. 7. Insurance - The operator shall furnish evidence he is insured to the extent of not less than $100,000.00 against liability for any negligent act or omission by the operator from the operation or maintenance of the sand and gravel pit and the extraction and production of sand and gravel pit and all activities connected with or incidental thereto. 8. All phases of the borrow pit operation shall comply with all applicable County, State and Federal Health Standards and Regulations and other ap- plicable rules and regulations of governmental bodies having jurisdiction on the premises. 9. No diking or berming shall be allowed on the Special Use Permit area which would cause damage to adjacent properties or ditch right-of-ways by alter- ing the historic drainage pattern. 10. The owner/operator shall ensure that the flow capacity of the Meadow Island Ditch #1 shall not be decreased or prior use diminished due to any modifica- tion made during the applications of the gravel pit. 11. The Special Use Permit shall be limited to the plans shown hereon and governed by the Operations Standards stated above and all applicable Weld County Regula- tions. Any material deviations from the plans and/or Operations Standards as shown or stated above shall require the approval of an amendment to the Special Use Permit by the Planning Commission and the Board of County Commissioners be- fore such changes from the plans and/or Operations Standards shall be permitted. Operations Standards - Weld County SUP-425:80:15 Page 2 Any other changes from the plans and/or Operations Standards shall be filed in the office of the Department of Planning Services. 12. The property owner and/or operator of this operation shall be responsible for complying with all of the above stated Development Standards. Noncompliance with any of the above stated Development Standards may be reason for revoca- tion of the Special Use Permit by the Board of County Commissioners. 13. Screening Mounds, stockpiles, dikes, berms and other features Sh-otird not obstruct the passage of 100-year flood flows to the point that it creates any adverse effects on others. 14. Any fuel tanks, septic tanks and other items which might wash away during floodings should be located outside the 100-year floodplain or adequately floodproofed to avoid the creation of any hazardous conditions. The Mined Land Reclamation Board has approved this request. No one in attendance at the hearing was opposed to the • granting of the Special Use Permit. After d11 the testimony was received, Commissioner Steinmark made a motion to approre this request with the Planning Commission' s recommendations, conditions , and operational standards. Commissioner Dunbar s-econded the motion and it carried unanimously. Commissioner Steinmark amended her motion to included that Operational Standard #10 be eliminated. The only County S.U.P. I am aware of is for the two small parcels of the Koen�ing Pit east of Weld County Road 25. Regarding State Reclamation Permits the County has none. Because the County is continuing to operate under a "Cease and Desist Order" from the Mined Land Reclamation Board they will not issue any permits. The INDEX MAP was reproduced from a standard U.S. Geological Survey topographical quadrange. i EXHIBIT C PRE-MINING AND MINING PLAN MAPS OF AFFECTED LANDS The PRE-MINING PLAN MAP portrays the following information: a. All immediately adjacent surface owners. b. The name and location of all creeks, roads , buildings , oil and gas wells and lines, and power and communication lines on the affected land and within 200 feet of all boundaries. c. The existing topography with contour lines of sufficient detail to show the direction and rate of slope of the land. d. The total area to be involved in the operation. e. The type of present vegetation covering the affected lands. f. Water resources information. g. Soils information. The MINING PLAN MAP portrays the following information: a. Size areas to be worked at any one time. b. Sequence in which each stage of the operation will be carried out. c. Water diversion and impoundment. d. Mining method sketches. e. Extraction standards. f. Legal description. g. Surveyor' s certification. EXHIBIT B MINING PLAN A. Methods of Mining Prior to mining, topsoil and overburden will be removed by scrapers and used in the construction of screening mounds and roadways. It may be necessary to stockpile some material for future use. Mining will begin along the southern boundary of the parcel , just north of the Poudre River, and progress to the north. The County will employ their backhoe capable of excavating to a 25-foot depth. Because of the high water table adjacent to the river, much of the mined material will be saturated. Therefore the operators will stockpile the sand and gravel and allow the water to drain into the excavated area. Ps this material is processed and/or transported out of the site, excavating will resume. B. Earthmoving As previously mentioned, scrapers will be used for topsoil and overburden relocation. A backhoe will excavate the sand and gravel . Bulldozers will he available for slope shaping and sand and gravel processing. Loaders will load trucks for transport out of the site. C. Water Management There will be no water diversion or impoundment structures necessary for this operation. The excavatedarea will simply contain ground water, collect water which drains from the excavated material , and collect storm run-off water. D. Size of Areas (i ) Major disturbance - Less than ten acres at a time will be stripped of topsoil and overburden. Within those ten acres , approximately 1 -3 acres may be excavated each year. (ii ) Moderate disturbance - Less than five acres will be devoted to storage and equipment areas , raodways , and overburden areas . The pond formed from excavation will become enlarged year by year as more material is taken from the site. Its ultimate size could he 30 to 40 surface acres at depths to 25 feet. (iii ) Minor disturbance - Less than five acres total will undergo pre- paration prior to revegetation. Again, this area will vary in size from year to year. E. Timetables It is expected that the operation will progress at the same rate year after year until all the available material is mined. Since there is no natural dividing line such as an irrigation ditch or river within the parcel , the area will probably he completely mined ngt. The parcel will not be divided into separate areas or stages of mining ; and therefore, actual timetables are not applicable, except to say that the esti"ated life of the mine based on present and projected rates of removal will e 20 to 25 years. EXHIBIT E RLCLAMATION PLAN A. Types of Reclamation The operator proposes to achieve a reclaimed land use of a wildlife habi- tat and conservation area. This land use was selected for the following reasons: (1 ) Much of the surrounding land is already used for that purpose and contains wildlife populations. (2) The Colorado Division of Wildlife, District Wildlife Manager stated that gravel pit lakes and reclaiwed land could improve the quality of habitat. (3) The proposed mining area is zoned "Agriculture" and is located with- in the "Resource Conservation Area" as defined in Weld County' s Ex- traction Plan. The entire area totalling 54.7n acres will hn reclaimed for this use. B. Land Use Comparisons As stated previously, the proposed land use is the same as the use being accorded all adjacent land to thi' south, southeast, and southwest. Also, local and state plans recommend the same. C. Implementation Requirements Reclamation for each phase will hr' cc'i"plrti'd within five years after that phase has commenced. The following measures are set forth as those the operation will act upon to ','rr't thr, -eouirrr' nt- of rYi_r r : 6.1 - Grading a. Backfilling - There will be no backfilling of overburden or waste materials in the mined area. b. Erosion - Screening mound/roadway structures will be graded and sta- bilized in such a manner to minimize or prevent erosion on their side slopes. c. Timeliness - The nradinn in question will be done before and during the mining process and will be completed before or at completion of mining. d. Aesthetics-There will he no acid-forming or toxic materials. Refuse generated as a result of mining activities will he transported from the site and disposed at a landfill area. e. Drill/auger holes - There will he no drill or auger holes , nor will there be any addits or shafts which should be backfilled. f. Slopes - Slopes outside the pond will he less than 2: 1 (horizontal to verticle ratio) and no steeper than 3: 1 on the pond side. g. Farm machinery - The reclaimed use is not anricultural farming which would necessitate farm machinery. 6.2 - Water a. Hydrology and ' ater Quality - The mining operation will be in com- pliance with applicable water laws and regulations noverning injury to existing water rights. The operation will be in compliance with Section 404 dredge and fill regulations in that there will be no discharges of dredged or fill material into the South Platte River. It will not he necessary to construct (or to remove) any temporary or large siltation structions in (or from) drainage ways. b. Earth dams - There will be no construction of earth dams in order to mine or reclaim this site. 6.3 - Wildlife a. Safety and protection - There are no species of wildlife having crit- ical periods in their life cycle and requiring special consideration. Activity at the site, especially adjacent to the river, will he kept to a minimum during winter months. [von though mining activities are not dangerous to migratory waterfowl , the activities may cause incon- venience to wildlife. b. Habitat management and creation - Wildlife habitat in and adjacent to the Poudre River will not be disturbed. Large cottonwoods and willows along the river will remain. The pond which will be formed will encour- age many wildlife species , i .e. fish, waterfowl , deer, etc. The Colorado Division of Wildlife has been contacted and is supportive of the reclama- tion plans. He also anticipates that mining and reclamation activities will cause minor disturbances to existing wildlife. As time goes on, mining activity will take place further and further from the natural river habitat. 6.4 - Topsoiling a. Topsoil preservation - Topsoil and overburden will be placed in per- manent locations at the time it is stripped from its present location, thereby negating potential deterioration. b. Trees - The operator will utilize trees that must be removed in a reasonable and appropriate way to avoid wastefulness. Every effort will be made to save the large, healthy cottonwoods by incorporating their locations into the proposed reclamation plan. c. Stockpile erosion - It is not planned to stockpile any topsoil or overburden. d. Stockpile relocation - N/A e. Grading - Areas where topsoil will he replaced will have no or min- imal slope thereby providing a stable base and topsoil relationship. f. Other material - N/A g. Fertilization - Fertilization will not be neccessary to promote growth of preferred vegetation. h. Vegetative piles - There will be no vegatative piles. 6.5 - Revecetation a. Self-sustaining - Since the majority of the site will be a pond , the only areas for reverletation will be on tie areas built up by replaced topsoil and overburden. ',i •1 . EXHIBIT H WILDLIFE INFORMATION A. Significant Wildlife Resources The area in and around the proposed mining site contains a wide variety of wildlife. Included are the following species: mule deer, ducks , geese, bald eagles , and golden eagles. Other species that utilize the river bottom habitat include: raccoon, coyote, red fox, cottontail rabbit, fox squirrel , great horned owl , great blue heron, mourning dove, woodpeckers , flickers , and redtail hawks. B. Seasonal Use The greatest concentration of mule deer, ducks, geese, bald eagles , and golden eagles occurs from October through February of each year. During each of the past three winters 20,000 to 40,000 mallard ducks have utilized the Poudre River and adjacent sloughs. This concentration occurs when lakes and ponds begin to freeze over and waterfowl begin to look for open water pro- vided by rivers and warm water sloughs. Although mule deer use this area throughout the year, highest concentra- tions are also found during the winter months. C. Threatened or Endangered Species During the winter of 1978-79, a minimum of six eagles were observed in this area. Four were definitely mature bald eagles , while the other two were either very young bald eagles or mature golden eagles. Large cottonwood trees provide roosting cover for the eagles. An ample food supply exists in and along the Poudre River. Bald eagles are on the endangered species list and this esti- mated seasonal population is the most recent information available. D. General Effect of Operation The Weld County property along the Poudre River is very valuable to wild- life. The specific area of proposed gravel mining contains important wildlife habitat. Any open pit mining operation should include plans to protect all large trees and should not alter or jeopardize the Poudre River or adjacent sloughs. In addition, mining operations should be minimized during winter con- centrations of wildlife. However, the quality of the habitat will definitely improve with the development of gravel pit lakes and eventual reclamation of the area. First of all I would like to point out a significant difference between your map and the enclosed copy of an ariel photo taken in 1977. At the southwest portion of the proposed mining area (cross-hatched on photo) your map shows the Poudre River meandering to the south. As the photo indicates, this meander has been removed from the main flow of the river by a channel which directs the water straight east at that location. The area in and around the proposed mining site contains a wide variety of wildlife. However, this property has become a refuge for several significant species including mule deer, ducks, geese, bald eagles and golden eagles. The greatest concentration of these animals occurs from October - February of each year. During the winter of 1978-1979, a minimum of six eagles were observed in this area. Four of these were definitely mature bald eagles while the other two could have been immature bald eagles or golden eagles. Large cottonwood trees provide roosting cover for the eagles, in addition to an ample food supply of fish and waterfowl (wounding mortality) found in the Poudre River and adjacent warm water sloughs. PHYSICAL CHARACTERISTICS • 1 . Physiographic Features • Elevation is about 5000 feet. Topography is nearly level to gently sloping. Surface may be smooth or there may be minor undulations. This site often occupies the first bench between the streambed and higher sandy land. It may also be found in a few sandy valleys and dralnageways where there is some effect from extra moisture. 2. Climatic Features 1721- High intensity summer storms and hot dry periods between storms are common. The effect of the semi -arid climate is offset to some extent by a slightly to moderately effective water table or by occasional flooding, or both. The average annual precipitation is from 13 to 17 inches with 75 to 80% falling from April to September. Optimum growing season of native plants is laze spring and summer: 3. Native (potential ) Vegetation The vegetation has a definite tall grass appearance, dominated by switchgrass, Indian grass, prairie sandweed and sand bluestem, with smaller amounts of various midgrasses such as side-oats grama, little bluestem, needle-and-thread ; acid Canada wildrve are scattered through- out. Tall dropseed , sand dropseed, sedgcs, inland saltgrass, pere- nnial forbs , and western wheatgrass may make up about 20Z, of the vegetative composition. Solis a. The soils are usually deep but may be shallow and underlain by clean sand or gravel . They vary in texture from sandy loam to loose sand. The sandy texture with its faster intake, deeper penetration and more ready release of moisture than heavier soils, is the principal factor affecting plant growth. R EXHIBIT K CLIMATE A. Seasonal Precipitation Weld County has a climate consisting of semi-arid steppe with moder- ately cold winters and warm summers. The area has low relative humidity and less than 15 inches of precipitation a year. The precipitation is mainly in the form of thunderstorms, occasionally accompanied by hail and strong winds. Most of the precipitation occurs during the 140 day growing season. This amount is sufficient to support native grasses and shrubs. B. Temperature Ranges Seasonal temperatures range between an average of 23.8° F in January to 74.8° F during July. Periodic extremes find temperatures falling near zero a few days each winter and summer hot spells in the 90' s , lasting one to two weeks. i f -, r EXHIBIT L RECLAMATION COSTS Because of the type of proposed reclamation and final land use, the costs of reclamation are expected to be negligible. This is to say that the time and equipment costs to the operator above and beyond those expected for the mining operation itself will be very small . The mining plan and mining meth- ods, which the operator has used in the past, have proven to result in an area that can be reclaimed to a conservation/wildlife habitat land use without ex- pensive reclamation efforts. The operator and owner, Weld County, being a governmental organization, is un- der unique financial constraints. It is more economical for Weld County to fol- low a mining plan which will facilitate a natural reclamation process than to reclaim the land for other uses. The proposed land use was selected, in part, because of the negligible cost of reclamation. EXHIBIT M LOCAL GOVERNMENT APPROVAL The proposed operation is located in the "A" Agricultural District and within the "Resource Conservation Area" outlined in Weld County's Extraction Plan. Although parts of Sections 2 and 11 , Township 5 North, Range 65 West lying north of the Poudre River are within the "I" Industrial District and would require rezoning to "A" , this does not affect the proposed site as it is entirely within Section 1 . As I understand, you are preparing submittals to the Colorado Mined Land Reclamation Board for the three areas. The following information relates to the sites. t 1. Pierce Site: The subject property is located in the W1/2 , of Section 7, T8N, R65W. The current gravel operation is a legal non-conforming use and as such can continue operation with no further County action required. Based I upon my information, the proposed application does not exceed the boundaries of the accepted non-conforming use area and therefore will not be constituted as an expansion. 2. KoenigSite: The subject property is located in the SW4 " of Section 18, T2N, R66W and the SE!.j of Section 13 , T2N, R67W. That portion of the site located in Section 18 '� has been approved for gravel extraction by the County. The portion of the site located in Section 13 has not,i1H at this time had appropriate approval by the County to 41 permit gravel extraction. The location in Section 13 is currently zoned "A" Agri- ;• _ cultural . Said zone district does permit surface mine * activity upon approval of appropriate permits. Policies within the Extraction Plan do promote such areas for mining. 3. Davis Ranch Site: The Davis Ranch in total comprises • parts of several sections . Based upon your preliminary maps you are proposing extraction in Section 1 , T5N, R65W north of the Poudre River. Again as above, no current permits exist for this area with the County at this time. The site referenced above is, however , currently in the "A" Agricultural District. Again it is similar to the i Koenig site as it is within the "Resource Conservation Area" outlined in the County ' s Extraction Plan. Current limitations around the Davis Ranch area are those parts of Sections 2 and 11 , T5N, R65W lying north of the Poudre River. Said area is currently within the "I" Industrial District . Such portions would require rezoning to the "A" Agricultural District before the County could consider surface mining applications. As indicated above, this issue does not appear relevant to the current site. It will, however, be important to insure the proposed permit area will be within the portion of the Davis Ranch currently in the "A" Agricultural District. COUNTY REFERRAL: COUNTY GRAVEL MINE LOCATION: Southeast of Airport 1/4 mile Represented by: Drew Sheltinga Weld County Engineering Department 915 Tenth Street Drew Sheltinga explained that the site of the gravel mine was located on the County-owned Davis Ranch. Mr . Sheitinga indicated that the topsoil and overburden would be removed by scrapers and that the gravel will be mined to approximately a 25 foot depth. After excavation, the gravel will be stockpiled to allow it to drain and dry. It will then be loaded into trucks and hauled away for use within approximately a 30 mile radius of the mining operation. He indicated that no permanent facilities would be located on the site, and that the operation would not require mechanical dryers or crushers . Mr . Sheltinga indicated that the life of the mine would be approximately 20 to 30 years . He (-- indicated that operation at the mine would be intermittent and �) would peak every few weeks . During peak operational periods , there would be approximately one truck every five or ten minutes entering or leaving the site from an existing access road. Mr. Sheltinga also indicated that the land surrounding the site could possibly be sold to the Colorado Division of Wildlife . He also explained that the Division of Wildlife was interested in purchasing the mined property after reclamation has occurred. The A.R.T . board indicated a concern in reference to the construction and engineering capabilities of Highway 263 to withstand the heavy gravel truck traffic that would result from this mining operation. Bill Hange also questioned the site distance when pulling out of the access road to the mine . Mr. Sheltinga indicated that the sight distance at the access point was adequate . Concern was also expressed in reference to the proximity of the gravel mine to the Poudre River. It was felt that all applicable flood plain regula- tions should be applied to this operation . Ken McWilliams indicated that the Planning staff would make its recommendation to the Planning Commission at its June 10 meeting . Those present were Commissioners Roeth, Miller, Cummins and Keirnes. f 0 J �* I. APPROVAL OF MINUTES • , Commissioner Cummins made a motion to approve the minutes of the previous meeting as mailed. Commissioner Keirnes seconded the motion. Vote was taken and the motion carried unanimously. II. REPLAT: OLIVER SUBDIVISION LOCATION: Southwest corner of 19th Street and 13th Avenue Commissioner Keirnes abstained from discussion on this item due to a possible conflict of interest. Ken McWilliams indicated that the existing lot contains approximately 15,000 square feet and the request is to subdivide this lot into • two lots which would both meet minimum lot size requirements. Two single family residences exist on the current lot. Each proposed lot would include one of these residences. The existing frame garage will be removed so that minimum lot size requirements can be met by platting a straight lot line between lots. Staff is recommending approval of the plat as presented. Commissioner Cummins made a motion to approve the plat as presented. Commissioner Miller seconded the motion. Vote was taken and the motion carried unanimously. I WELD COUNTY REFERRAL: COUNTY GRAVEL MINE • LOCATION: Southeast of Airport 1/4 mile Mr. McWilliams noted that the request is for a 5d.8 acre gravel mine located on property owned by the County. The entrance to the property is from an access road onto Highway 263. Staff has expressed concern for the adequacy of the State Highway in handling the heavy gravel truck traffic. Concern was also expressed for complying with the County flood regulations. Staff suggested that the Commission recommend to the County that they work with the State Highway Department regarding the adequacy of Highway 263. Drew Sheltinga indicated that he has talked to the State Highway Department regarding this concern and they have not completed their evaluation yet. Commissioner Cummins asked what happened with the Doeringsfeld gravel mine that was proposed a few years ago. Mr. Sasaki indicated that he could not recall what the Commission recommended on that proposal. There was a concern at that time with how the trucks would get out to 18th Street. Mr. Sasaki noted that that request was granted, but mining has not begun on the • property at this time. Mr. Sheltinga indicated that the proposed county pit is a marginal pit from the standpoint that there isn't much large stone to crush. Commissioner Keirnes made a motion to recommend no objections to the proposal as presented and to recommend expressing concern for items identified by staff. Commissioner Roeth seconded the motion. . Vote was taken and the motion carried unanimously. IV. REVIEW OF PRELIMINARY DRAFT OF CAPITAL IMPROVEMENTS PLAN Mr. McWilliams handed out copies of the revised tables from the Capital Improvements Plan. Iie indicated that the only new thing in the plan was the amount budgeted for bike storage facilities in the parks. Although the mining plan basically is straightforward, I would like out to point out two questionable aspects. First, the report states that the entire 55-acre site probably will be mined out because of the absence of internal natural obstructions. However, Note 2 on the mining plan map and the map itself imply that four noncontiguous 5- to 20-acre ponds are planned with an option by the owner, Weld County, to mine the entire site. One of these two plans should be decided upon initially because the choice may affect the ultimate reclamation plan. This leads to the second issue, the placement of overburden and topsoil . The report cited no test-hole or other information that would indicate the true thicknesses of the gravel , overburden, and topsoil layers. The volume of over- burden that is to be permanently placed around the pit will determine the width and height of the structure. Although Extraction Standard 13 states that no berm will be allowed that will alter the drainage pattern, the placement of this over- burden around the pit will , I think, constitute a berm. Cross-section A-A on the mining plan map suggests that this structure will be significant, especially if the entire tract is mined out. The real question here is why the overburden will not logically be used to backfill portions of the mined area. This could, I believe, be an economy move that may not be in accordance with state reclamation guidelines. Sincerely, <7.) Stephen D. Traxler: The Colorado Water Conservation Board staff has completed a flood hazard evaluation for the county's Davis Ranch Gravel Pit operations with the following findings : Location: County - Weld Community - 34 miles east of Greeley and 4 mile southeast of Weld County Airport Section, Township, Range - Sz, Sz Section 1, T5N, R65W, 6th P.M. USGS Quad - Kersey, Colorado Potential Source of Flooding: 1. Cache La Poudre 2. South Platte River 3. Local Drainage Area Available Floodplain Information: 1. "Flood Plain Information, Cache La Poudre River, Colorado, Volume II, Greeley, Weld County" prepared by the U. S. Department of the Army, Omaha District, Corps of Engineers in March, 1974. This report was designated by the Colorado Water Conservation Board on February 26, 1975, and thus is available for regulation purposes. 2. "Special Flood Hazard Information Report, South Platte River, Volume I, Weld County, Colorado prepared by the U.S. Department of the Army, Omaha District Corps of Engineers in April, 1977. This report was designated by the Colorado Water Conservation Ms. Vickie Traxler June 19, 1980 Page two Board on November 15, 1977 and thus is available for regulation purposes . 3. "Flood Insurance Study, Weld County, Colorado Unincorporated Areas and Town of Eaton, Colorado" prepared in September, 1979 by Gingery Associates, Inc. under FEMA-FIA contract. This report was designated by the Colorado Water Conservation Board on March 17, 1980. Findings : 1. The Flood Insurance Study contains the designated information and data on the South Platte River and Corps ' report contains the designated information on the Cache La Poudre River. 2. The 100-year floodplain is not shown on the permit application. 3 . The property was not flooded by the South Platte in 1973; however, it does appear the Cache La Poudre flooded a portion of the South boundary at that time. 4. The 100-year flood is approximately 4606 feet above MSL at the west end and 4602 feet above MSL at the confluent of the two streams. 5. The property lies on both sides of the Cache La Poudre River but mining is only planned on the north side of the river in this permit. However, applicant has mining rights to South of river also. 6. The equipment area in the northwest corner is out of the 100-year floodplain. All other identified stockpile, storage and equip- ment areas are within the 100-year floodplain. 7. There will be no water diversions other than natural seepage into the pits and runoff from the immediate area. 8. No impoundment structures will be built; however, the gravel pits will remain as permanent lakes. 9. "Screening mounds" are planned which could obstruct passage of 100-year flood flows. These mounds are not completely located on the permit and thus, there affects cannot be totally evaluated . Recommendations; A. The applicant should identify the 100-year floodplain on the special use permit application as described in the designated reports. Please see the attachments. B. All storage, equipment and office areas should be located M . Vickie Traxler June 19, 1980 Page three outside the 100-year floodplain. According to the flood maps, acceptable sites are possible by locating primarily in north- west corner of the property. C. Any operations of the gravel pit should not obstruct the passage of the 100-year flood flows or natural drainage to the point that is has any adverse effects on others. Item 13 of the "Extraction Standards" should include stockpiles and screening mounds as well as dikes and berms. D. Fuel tanks, septic tanks and other items that might wash away during flooding, thus creating "hazards to public welfare"should be located outside the 100-year floodplain or securely anchored and adequately floodproofed. E. The reclamation plan should assure that this area will be left unobstructed and as natural as possible. These areas should remain zoned 100-year floodplain lands.
