Gentlemen:
I wish to inform you that I am now presently in
construction of my waste water disposal. I am
giving you this notice that I am aware of the
risk in developing this site without having the
correct plat, which I am informed is incorrect.
The reason for this continuance of this construct-
ion is that I have several loads of bentenite
in transit. This bentenite must be laid out
upon delivery.
If for any reason I should not get my permit,
I will discontinue construction.

RE: Application for Emission Permit 82WE344 - Roggen
Dear Mr. Cervi :
Your application for a fugitive dust emission permit for site preparation
for a brine disposal pond located in Roggen, Colorado, has been reviewed
by the Air Pollution Control Division, and it has been determined that
said activity does not constitute a new source of fugitive dust emissions
as defined in Air Pollution Control Commission Regulation No. 3. , II.C.1
(effective July 30, 1980) , which exempts all site preparation or land
development activities of a total size of 25 acres or less and 6 months
duration or less from the emission permit requirements. According to your
letter of October 27, 1982 and November 8, 1982, the project size is 1 .2
acres and earthmoving activities will last 3 days.
Accordingly, an emission permit for the above-referenced project is not re-
quired from the Division; however, you are still required to use fugitive
dust abatement measures during earthmoving activities associated with this
project.
The $40.00 permit filing fee will be refunded. Should you have any questions
do not hesitate to contact this office. Thank you for your cooperation in
the abatement of air pollution.
