Home My WebLink About830304.tiff FINDINGS AND RESOLUTION RE : FINDINGS AND RESOLUTION CONCERNING THE 3 .2% BEER LICENSE APPLICATION OF MUSKET CORPORATION, D/B/A LOVE ' S COUNTRY STORE #204 The application of Musket Corporation, d/b/a Love ' s Country Store #204 , 3851 Highway 119, P.O. Box 1046 , Longmont, Colorado 80501, for a 3 . 2% Beer License, for consumption off the premises only, came on for hearing on the 14th day of September, 1983 , at 2 : 00 p.m. and the Board of County Commissioners of Weld County, Colorado, having heard the testimony and evidence adduced upon said hearing, and having considered the testimony, evidence and remonstrances filed with said Board, and having carefully weighed the same, now makes the following findings: 1. The evidence discloses that the applicant has sustained the burden of proof as to the desires of the inhabitants. 2 . That the applicant is of good character and reputation. 3 . The applicant has proven a prima facie case as to the reasonable requirements of the neighborhood. RESOLUTION WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners has considered the application of Musket Corporation, d/b/a Love' s Country Store #204 , 3851 Highway 119 , P .O. Box 1046 , Longmont, Colorado 80501, for a 3 . 2% Beer License for the sale of fermented malt beverages, containing not more than 3 .2% of alcohol by weight for consump- tion off the premises only, and WHEREAS, due to the Findings of the Board of County Com- missioners in this matter, as stated herein, the Board deems it advisable to approve said application for a 3 .2% Beer License for Musket Corporation, d/b/a Love' s Country Store #204, and 830304 Page 2 RE: FINDINGS AND RESOLUTION - MUSKET CORP . WHEREAS, applicant has paid to the County of Weld, the sum of $350.00 for the Hearing Fee. NOW, THEREFORE, BE IT RESOLVED that the Board of County Commissioners of Weld County, Colorado, having examined said application, the qualifications of the applicant, and the testi- mony of those present at the hearing, does hereby approve the application of Musket Corporation, d/b/a Love' s Country Store #204 for a 3 . 2% Beer License for the sale of fermented malt bev- erages containing not more than 3 .2% of alcohol by weight for consumption off the premises only, for the reasons stated herein. Russell Anson Planning Department Representative, None The following business was transacted: I hereby certify that pursuant to a notice dated August 3, 1983, and duly published in the La Salle Leader on August 11, and September 1, 1983, a public_ hearing was held for the purpose of considering the application for a 3.2% beer license from Musket Corporation, dba Love's Country Stores. Russ Anson, Assistant County Attorney, read this request, and the criteria to be met by the applicant, into the record. Leonard Burden, manager of Love's Country Stores in Longmont, was present and answered questions of the Board. Mr. Anson suggested that maybe Mr. Burden should give a brief background on him- self, which Mr. Burden did. The Chairman, C. Carlson, expressed his concern that there may be too many liquor stores in this area. Mr. Burden said he feels that the volume of customers in this area is great enough to warrant the need. The Chairman and Commissioner Brantner also voiced their concerns about selling beer to minors. Mr. Burden assured the Board that his employees are all aware of the liquor laws and they will be careful about checking identification. After further discussion, Commissioner Johnson moved to approve the 3.2% beer license for Musket Corporation, dba Love's Country Stores for consumption off the premises only. Commissioner Brantner seconded the motion and it carried unanimously. APPROVED: AITLST:'........
