RESOLUTION RE: APPROVAL OF USE BY SPECIAL REVIEW FOR DOG KENNEL IN THE "A" (AGRICULTURE ZONE DISTRICT) - RICHARD AND DEBORAH ZUBKO WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners held a public hearing on the 11th day of May, 1983, continued until the 18th day of May, 1983, at the hour of 2 : 00 o'clock p.m. in the Chambers of the Board for the purpose of hearing the application of Richard and Deborah Zubko, 9452 Sierra Vista Road, Longmont, Colorado 80501, for a Use by Special Review for a Dog Kennel in the "A" (Agriculture Zone District) , on the following described real estate, to wit: Lot 5, Block 4, Casa Grande Estates, Weld County, Colorado. WHEREAS, Section 24 . 4. 2 of the Weld County Zoning Ordinance provides standards for review of said Use by Special Review, and WHEREAS, the Board of County Commissioners heard all of the testimony and statements of those present, has studied the request of the applicant and the recommendations of the Weld County Planning Commission and all of the exhibits and evidence presented in this matter, and having been fully informed, finds that: 1. The submitted materials are in compliance with the application requirements of Section 24. 7 of the Weld County Zoning Ordinance; 2 . It is the opinion of the Board of County Commissioners that the applicant has shown compliance with Section 24 . 4 . 2 of the Weld County Zoning Ordinance as follows: a . The proposal is consistent with the Comprehensive Plan policies in that the use does not infringe on continued agricultural use in the vicinity or County. The proposal does not encourage urban use to expand in a rural area; b. The proposal is consistent with the intent of the Agricultural Zone District; and is provided for as a Use by Special Review; c. The activities proposed will be compatible with existing agricultural and rural residential uses in the neighborhood, as well as the projected development in the future. The intended proposal will not have significant traffic or noise impacts; d . No Overlay Districts affect the site; e . Use by Special Review Operations and Design Stand- ards provide adequate protection of the health, safety and welfare of the neighborhood and County. NOW, THEREFORE, BE IT RESOLVED by the Board of County Com- missioners that the application for a Use by Special Review for a Dog Kennel in the "A" (Agriculture Zone District) on the here- inabove described parcel of land be, and hereby is, granted sub- ject to the following conditions: 1. The attached Standards for Use by Special Review be adopted; 2 . The plat for the Use Permit be placed of record by the Department of Planning Services' staff prior to any building permits being issued on the site. The use permitted on this site shall be a dog kennel operation as described in the application materials on file in the Weld County Department of Planning Services. The kennel operation shall not exceed ten (10) dogs. 2. The dog breeding facility and kennel shall comply with all applic- able Weld County Health Department and Colorado State Health Depart- ment regulations. 3. A six (6) foot wooden privacy fence shall be constructed surround- ing the kennel in order to screen the kennel from the adjoining lots. 4. Design standards for Uses by Special Review, Section 24.5 et seq. of the Weld County Zoning Ordinance shall be complied with . 5. Operations Standards for Uses by Special Review, Section 24.6 et seq. of the Weld County Zoning Ordinance shall he complied with. 6. The Use by Special Review shall be limited to the plans shown hereon and governed by the Standards stated above and all applic- able Weld County Regulations. Any material deviations from the plans and/or Standards, as shown or stated above, shall require the approval of an amendment of the Permit by the Weld County Planning Commission and the Board of County Commissioners before such changes from the plans and/or Standards are permitted. Any other changes shall be filed in the office of the Department of Planning Services. 7. The property owner and/or operator of this operation shall be responsible for complying with all of the above stated Standards. Noncompliance with any of the above stated standards may be reason for revocation of the Permit by the Board of County Commissioners. 8. All but one (1) of the dogs on the property over eight (8) months old shall be debarked. 9. The Use by Special Review Permit shall not be transferrable to any successors and interests to the described property shall expire automatically upon conveyance or lease of the property or contracting with others for operation of the facility. M. , with the following present: Chuck Carlson Chairman, Excused John Martin Pro Tern Gene Brantner Commissioner Norman Carlson Commissioner Jacqueline Johnson Commissioner Also present: Acting Clerk to the Board, Tommie Antuna Assistant County Attorney, Lee D. Morrison Planning Department Representative, Rod Allison The following business was transacted: I hereby certify that pursuant to a notice dated April 25, 1983, duly published on April 28, 1983, in the La Salle Leader, a public hearing was conducted for the purpose of considering a Use by Special Review for a dog kennel in an A-Agricultural Zone District for Richard and Deborah Zubko. Lee D. Morrison, Assistant County Attorney, read the application into the record. Rod Allison, representing the Planning Department, read the recommendation of the Weld County Planning Commis- sion into the record. Mr. Morrison stated it should be made clear that the motion which was made was for passage with the conditions as stated, that motion did fail, so the recommendation is against approval. He said the Board could consider the conditions suggested by the Planning Commission, but the official recommendation is for denial. Wayne Kaufman, attorney representing the Zubkos, gave a brief presentation on behalf of the Zubkos. He commented on the dogs which are presently on a one acre of land owned by the applicants. He said all but one dog have been de-barked and are kept inside of a six-foot privacy fence which is in the process of being completed. He said the dogs are a hobby dog, strictly for the purpose of show. Mr. Kaufman presented pictures of dogs and fence to the Board. Mr. Morrison asked if pictures are available for the record. Mrs. Zubko said identical copies would be made for the record. Mr. Kaufman commented on the concerns about setting a precedent and about property values going down. He said that they are not requesting that the permit be given to the land, so if the Zubkos would leave the area, this property would no longer have the permit and they have no intention of expanding. Commissioner Brantner asked if protective covenants have anything to do with this hearing. Mr. Morrison said it has very little to do with it, the decision depends on impact on surrounding area. Mr. Kaufman presented more pictures to the Board and also letters from neighbors. Commissioner Johnson asked if it would be permissible to expand. Mr. Allison said 10 dogs on the property is the limit. Mr. Morrison said it could be in excess of 10 dogs if they are under 6 months, but then they must get rid of them. Kathleen Cowan, a neighbor, said she is concerned about setting a precedent, the houses are too close together. She said she has heard that others are already considering starting a kennel in the neighborhood. Jerry Murks came forward and said he is totally against this proposal and stated his reasons. William Cappelleti said he considers the neighborhood residential even though it is zoned Agricultural. He also is opposed. Leonard Lashaway said he is totally opposed to this pro- posal because of the noise and the property values. Keith Light is opposed because of the dogs barking and he feels that having 10 dogs means a business and not. a hobby. Kathy Lashaway voiced opposition because she fears that a precedent wil.L be set and others may apply for a dog kennel permit. Linda Marks stated that she too is opposed. Steve Hanson stated that he is in favor of granting this permit. He said the Zubkos have been there approximately 5 years and he doesn't see what the problem is now. Robert Hicks, real estate agent, said property values will not drop. He also is in favor of granting this permit. Deborah Zubko said that they probably do more for fly control than most people. She explained why the dogs are not kept in an enclosure. She said that they have their house listed for sale because if the Board denies their request, they will move. Commissioner Johnson asked if the dogs have been on this property for the past 5 years. Mrs. Zubko answered in the affirmative. Richard Zubko said they had never applied for a permit before because no one had ever complained before this. Commissioner Martin asked if any of the / f , Page 2 RE: Hearing Certification - USR, Zubko Standards bothered the applicants. They said no. Commissioner Brantner asked if the Health Department had been contacted. Mrs. Zubko said that requirements are waived for show dogs. Commissioner Johnson asked Mr. Morrison if granting this permit would make it easier to grant another in the future. Mr. Morrison said that this Board is not bound as a Court of Law might be to rule the same under similar facts. He said the granting of this permit would not mean that anyone else who applies, ftom that area, would be granted a permit. However, what actually is on the ground in the area, does enter into any future decisions. The existence of a kennel determines the nature of the neighborhood if someone else applies for another kennel. It does have some impact on future deliberations. Mr. Cappelleti came forward and identified where neighbors are located on map in relation to applicants. Mr. Allison addressed the Board and said that there is criteria established in the Zoning Ordinance to help guide the Commissioners in their decision. He said that the part pertaining to this application is whether or not the applicants have demonstrated that their use, if permitted, would be compatible with the existing surrounding land uses and whether it would be compatible with the future uses and also that there is adequate provision for protection of the health, safety and welfare of the inhabitants of the neighborhood and the County. Commissioner Brantner read addresses of adjacent neighbors into the record. After further comments, Commissioner Johnson moved to continue this matter until May 18th to allow her time to visit area involved. This motion died for lack of a second. Commissioner N. Carlson moved to grant this application with conditions. This motion died for lack of a second. Commissioner Brantner moved to deny application. This motion also died for lack of a second. Commissioner Johnson again moved to continue this hearing to May 18, 1983. Commissioner Brantner seconded the motion. Commissioner N. Carlson said he had problems with the fact that this kennel had been there for 4%5 years with no complaints. The motion carried unanimously. Commis- sioner Martin said that no additional testimony would be accepted unless it was something new. Mr. Morrison said that this should be part of the Board's action if this is so desired. Commissioner Johnson then moved that TAPE no additional testimony be accepted, except for new evidence. Jerry Murks came forward and presented a letter • and pictures to the Board. He said the letter was concerning an incident which had occurred since the last hearing. Mr. Kaufman voiced an objection to the letter being submitted. Mr. Anson, Assistant County Attorney, asked why the pictures had not been presented at the last Hearing. Mr. Murks said that they had not been developed in time. Mr. Anson said that the letter was actually . a Sheriff's report and he wasn't sure of its relevance. Commissioner Johnson said she and Commissioner Brantner had toured the property in question. She said she questioned the fact that the Zubkos have had these dogs for a number of years and yet no complaint had been made earlier. Commissioner Johnson moved to approve the Use by Special Review with the Standards as recommended. Commissioner N. Carlson seconded the motion. In the summer, the flys are really bad and the smell is really intolerable. For one reason they can- not wash their so called kennels because they are outside with gravel on the ground instead of concrete floors which can be washed, so the dog droppings stay in the gravel creating a health hazard for the neighborhood. The dogs bark at night and when you have several they make quite a bit of noise when people are trying to sleep. Their kennels have a tarp top with gravel on the floor and not at all sanit=ary. I don' t think they should be allowed to have a dog kennel in a residential neighborhood. Any help would be most appreciative by me and my neighbors for having the smell, noise, flys and ect. cleaned up in this section of Casa Grande Estates. I would also like to object to Mr. Mrs. Hicks for having a dog kennel. I don' t want this same problem closer to our home than it already is. My objections are listed below: 1. They are already in violation of the existing code which allows only four dogs. 2 . The kennels they now have are not kept up. 3. Although it has been stressed that the dogs cannot bark because of cut vocal cords , they can still whine and make noises that have kept the neighbors up some nights. ;. The property is not kept up as it is , and the addition of extra kennels would bring down the property values of the neighboring properties. 5 . The houses in this acreage are in close proximity to each other unlike other acreage areas where a kennel may be feasible , 6. The area is already inundated with loose dogs that are allowed to run at will; we don' t need more dogs in this area . I am unable to attend the hearing in person. I also have noticed that the home and land is For Sale. It would appear to me that the zoning variation is solely commercial , sought only to enhance the salability and profit obtainable on the property, and I cannot understand how this person would have any concern or considera- tion for any inconveniences to the neighboring residents of Casa Grande by this actior , when they plan to sell and move. I therefore cannot believe their sincerity in stating any preventative measure to preclude this zoning variance from becoming a community liability and public nuisance.
