HomeMy WebLinkAbout820657.tiff RESOLUTION RE: APPROVAL OF RECORDED EXEMPTION NO. 577 - PHILIP AND ROBIN MORGAN WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, it has been determined by the Board of County Com- missioners at a public meeting held in the Chambers of the Board, that the division into two parcels of land, as shown on the plat known as Recorded Exemption No. 577, being the property of Philip and Robin Morgan, described as part of the W1 Nigh of Section 1, Township 1 North, Range 67 West of the 6th P.M. , Weld County, Colorado, being more particularly described in the plat which shall be provided by the applicants and known as Exhibt "A" , said plat to be recorded, does not come within the purview of the definition of the terms, "subdivision" and "subdivided land" , pursuant to its authority under Section 30-28-101 (10) (d) , CRS 1973, as amended. NOW, THEREFORE, BE IT RESOLVED by the Board of County Com- missioners of Weld County, Colorado that the hereinabove described parcel of land owned by Philip and Robin Morgan be, and hereby is, exempt from the definition of the terms, "subdivision" and "subdivided land" . BE IT FURTHER RESOLVED by the Board that this approval is conditional upon the applicants providing for a 30' access ease- ment on the larger parcel (Lot A) from Weld County Road 38 to the smaller parcel (Lot B) for adequate public access. The property is described as the W1, NW' of Section 1, Township 1 North, Range 67 West of the 6th P.M. , Weld County, Colorado. This property is located three and one-half (311) miles southwest of Gilcrest on Weld County Road 38. The property contains approximately 80 acres, more or less, of Class Ile, Class IIs, Class VIIs and Class IIIc, Class VIIs non-irrigated soils. The request is to split the property into two parcels of 55 acres, more or less, and 25 acres, more or less. The applicant wishes to sell the larger parcel to the adjacent property owner across Weld County Road 38 for farming pur- poses, and sell the smaller parcel to another local farmer for pasture. Based upon the information in the adopted policies in the County, the Department of Planning Services staff recommends the request be approved for the following reasons: 1. The request complies with Section 9-2C of the Weld County Subdivision Regulations Submission Requirements. 2. The request complies with Section 9-2E of the Sub- division Regulations as follows: The 80 acres, more or less, under consideration will allow agricultural and related uses to be the predominant uses. No reduction of agricultural land use for production will occur. These facts support the proposal as being consistent with the intent clause of the agricultural district. 820657 ,� Board of County Commissioners Page 2 October 27, 1982 - The proposed use being compatible with existing and surrounding land uses. The proposed use not being in- consistent with efficient and orderly developments. - The proposal being in compliance with Section 1-3 of the Weld County Subdivision Regulations and the proposed land division complying with the Weld County Compre- hensive Plan. - A telephone conversation on October 20, 1982 with Colorado Division of Water Resources identifies that adequate water service can be made available to both proposed parcels. - A letter dated October 11, 1982 from the Weld County Health Department indicates that both parcels will be served by an adequate septic system. - The proposal does not exist in an overlay district area. - The proposed lots are not part of a recorded exemption within the last five years. - The proposed lots meet the minimum size requirements for land division. CONDITIONAL STATEMENT: 1. The applicant shall provide for a 30' access easement on the larger parcel (Lot A) from Weld County Road 38 to the smaller parcel (Lot B) for adequate public access. We feel this request is concictant with the Weld County Compre- hensive Plan as this area : has not been designated for any other purpose than agricultural . Likewise , the district we are located in is also designated as remaining primarily agriculture . The existing land uses around this property are also primarily agricultural . The future plans for this area should not be affected by this change as both these parcels will remain in agriculture use . Our purpose for requesting this Recorded Exemption is that the larger 55 acre parcel is very well-suited for crop land and is level and has wa g adequate er for irrigation. This parcel is now being 9 (Boos) farmed by a neighbor4who owns his farm and plans to continue to farm this farm along with his own. He also may have future plans to purchase it . Similarly, the smaller parcel of 25 acres containing the improvements existing on the property, is now under contract to be purchased by another party, Mel Odenbaugh , who is the son of the land owners adjoining that parcel to the South . They wish to use this parcel , which is chiefly suitable for pasture , as an extension of the farm adjoining and raise dairy calves for use of the dairy operation on the other Odenbaugh farm to the South .
