HomeMy WebLinkAbout840037.tiff AR1957114 RESOLUTION RE: GRANT CHANGE OF ZONE FROM COMMERCIAL THREE (C-3) TO COM- MERCIAL FOUR (C-4) FOR MELVIN RAHM WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS , a public hearing was held on the 18th day of January, 1984 , at 2 : 00 o 'clock p.m. for the purpose of hearing the applica- tion of Melvin Rahm, 24 South Main Street, Longmont, Colorado 80501 , requesting a Change of Zone from Commercial Three (C-3) to Commercial Four (C-4) on Part of the NW4, Section 26 , Township 3 North, Range 68 West of the 6th P.M. , Weld County, Colorado being more particularly described as follows: Commencing at the North One-Quarter Corner of said Section 26 ; Thence S00°13 ' 00"W a distance of 40 . 00 feet to a point on the South Right-of-Way Line of Colorado State Highway 66; Thence S89°25 ' 00"W and along the South Right-of-Way Line of Colorado State Highway 66 a distance of 1270 . 76 feet to the True Point of Beginning; Thence S00°13 ' 00"W a distance of 1279 . 93 feet; Thence S89°25 ' 10"W a distance of 1325 . 86 feet to a point on the East Right-of-Way Line of Interstate 25; Thence Northeasterly along the East Right-of-Way Line the following 3 courses: 1) N00°25 ' 30"E a distance of 206 . 37 feet. 2) N16°00 ' 00"E a distance of 1088 . 80 feet. 3) N85°59 ' 42"E a distance of 500 . 89 feet to a point on the South Right-of-Way Line of Colorado State Highway 66 . The applicant has complied with the application require- ments listed in Section 21 . 7 et seq. , of the Weld County Zoning Ordinance. 2 . The request is in conformance with Section 21 . 5 of the Weld County Zoning Ordinance as follows: a) It is the opinion of the Board of County Commissioners that the applicant has shown that changing conditions in the area warrant a Change of Zone; b) The uses which would be allowed on the subject pro- perty by granting the Change of Zone will be compat- ible with the surrounding land uses. The subject site is currently zoned Commercial Three (C-3) . Surrounding property is zoned Commercial Three (C-3) to the east and Planned Unit Development (the PUD Sekich Farms contains 22 lots on 114 acres and was approved by the Board of Commissioners on February 15 , 1983, to the northeast) Interstate I-25 is west and State Highway 66 is north of the site. There is also a Commercial (C-3) zone one half mile to the north of the site on I-25 Frontage Road; c) State Highway 66 will provide adequate access to the site; d) The proposed Change of Zone is not located within any overlay district. NOW, THEREFORE, BE IT RESOLVED by the Board of County Com- missioners of Weld County, Colorado that the application of Melvin Rahm for a Change of Zone from Commercial Three (C-3) to Commercial Four (C-4) on the hereinabove described parcel of land be , and hereby is , granted subject to the following conditions : 1 . All buildings , structures and land located in the C-4 District shall be located, designed, used and occupied in such a manner that the design and Operation Standards contained in Section 33 . 6 of the Weld County Zoning Ordinance: Performance Standards , are met. 2. The applicant shall apply to the Colorado State Highway Department for a "Permit for Access" prior to the issuance of any building permits. 3. The applicant shall meet all the requirements of the State Highway Access Code at the time they apply for an access permit. 4 . The Farmers Mart Subdivision recorded October 24 , 1977 , in Book 812 , recording number 1733938 shall be vacated. 5 . The applicant shall submit evidence that the Little Thompson Valley Water District can supply adequate water service to the site to serve the uses permitted within the Commercial Four (C-4) Zone District. Morrison Planning Department Representative, James Mayerl The following business was transacted: I hereby certify that pursuant to a notice dated December 12, 1983, and duly published in the La Salle Leader on December 15, 1983, and January 5, 1984, a public hearing was held for the purpose of considering the request of Melvin Rahm for a Change of Zone from Commercial Three (C-3) to Commercial Four (C-4) on a parcel of land located in Part of the NW4, Section 26, Township 3 North, Range 68 West of the 6th P.M. , Weld County, Colorado. Lee Morrison, Assistant County Attorney, read the request into the record. James Mayerl, representing the Planning Department, read the favorable recommendation, with conditions, from the Planning Commission into the record. Mr. Mayerl said that the applicant had submitted a letter from the Little Thompson Valley Water District, indicating that water can be supplied to the site, therefore, the applicant has complied with Condition #5. The Chairman asked what the difference is between a C-3 and C-4 zoning. Mr. Mayerl said that C-4 is for highway commercial use, e.g. , motels, hotels, gasoline stations, etc. He said all of these are uses by right in a C-4 zone, and are not uses by right in a C-3 zone. Mr. Morrison added that the one other difference is in the formation of the C-4 zone, there is a con- sideration of need for the zone within the area for those kinds of services. Mr. Keith Ames, representing the applicant, came forward to explain the pro- posal and answer questions of the Board. After discussion, Commissioner C. Carlson moved to approve this request for Change of Zone from Melvin Rehm with the recommended conditions. Commissioner Brantner seconded the motion and it carried unanimously. Restaurant: Plans must be submitted to our division detailing the kitchen, food preparation, food storage, restrooms, and dining areas. Our division will review the plans for adequacy. If approved, construction can commence after obtaining building permits. Before the restaurant can open, our division must complete an on-site inspection and give approval for licensing. Swimming Pools: Plans must be submitted to our division for each pool . We will review the plans for compliance with the Colorado regulations for swimming pools. We must approve the plans before construction can commence. Sewage System: Further explanation of what exactly is proposed is needed. An engineering firm must determine design, operating, and maintenance needs for such a system. Approval for the system must be made through five different review agencies with ultimate approval by the Colorado Health Department's Water Quality Control Division.
