RE: CHANGE OF ZONE, C-3 TO- C-4 , MELVIN RAHM
A public hearing was conducted on January 18 , 1984, at 2:00 P.M. , with
the following present:
Commissioner Norman Carlson, Chairman
Commissioner Jacqueline Johnson, Pro-Tem - Excused
Commissioner Gene Brantner
Commissioner Chuck Carlson
Commissioner John Martin
Also present:
Acting Clerk to the Board, Tommie Antuna
Assistant County Attorney, Lee D. Morrison
Planning Department Representative, James Mayerl
The following business was transacted:
I hereby certify that pursuant to a notice dated December 12, 1983, and duly
published in the La Salle Leader on December 15, 1983, and January 5, 1984,
a public hearing was held for the purpose of considering the request of Melvin
Rahm for a Change of Zone from Commercial Three (C-3) to Commercial Four (C-4)
on a parcel of land located in Part of the NW4, Section 26, Township 3 North,
Range 68 West of the 6th P.M. , Weld County, Colorado. Lee Morrison, Assistant
County Attorney, read the request into the record. James Mayerl, representing
the Planning Department, read the favorable recommendation, with conditions,
from the Planning Commission into the record. Mr. Mayerl said that the applicant
had submitted a letter from the Little Thompson Valley Water District, indicating
that water can be supplied to the site, therefore, the applicant has complied
with Condition #5. The Chairman asked what the difference is between a C-3 and
C-4 zoning. Mr. Mayerl said that C-4 is for highway commercial use, e.g. , motels,
hotels, gasoline stations, etc. He said all of these are uses by right in
a C-4 zone, and are not uses by right in a C-3 zone. Mr. Morrison added that
the one other difference is in the formation of the C-4 zone, there is a con-
sideration of need for the zone within the area for those kinds of services.
Mr. Keith Ames, representing the applicant, came forward to explain the pro-
posal and answer questions of the Board. After discussion, Commissioner C.
Carlson moved to approve this request for Change of Zone from Melvin Rehm
with the recommended conditions. Commissioner Brantner seconded the motion
and it carried unanimously.

Weld County, Colorado
LOCATION: 2 miles southeast of Mead; east of I-25 and south of State

SIZE OF PARCEL: 35 acres
POSSIBLE ISSUES SUMMARIZED FROM APPLICATION MATERIALS:
The criteria for review is listed in Section 21.5 of the Weld County Zoning
Ordinance. The applicants are requesting this Change of Zone to allow highway

vehicle rentals, etc.) on the site.
A drainage study submitted by the applicant has indicated there may be some
problems with run-off. Development standards will address this concern.
The Department of Planning Services has received inquiries from surrounding
property owners regarding this application. The Weld County Comprehensive

RE : Rezoning procedural guide ( items 8 & 9 ) Gateway U . S .A .
C Located at I-25 and Colorado 66 , S . E . corner , Weld County ,
Colorado .
Statement on how proposed rezoning is consistent with the policies of
the Weld County Comprehensive Plan ( item 8 of Rezoning Procedural Guide ) .
The property in question is presently zoned C-3 with unit development •
standards . The original zoning was most likely influenced by the fact
that this property is located in a low area causing very wet conditions
most of the time and is not farmed for this reason . Mr . Theo Rademacher
who has farmed this ground along with the adjoining farms has confirmed
to me that without an expensive drainage system this particular area is
not farmable ground .
The new C-4 zoning is requested due to its proximity of the intersection
of Interstate Highway I -25 and State Highway 66 an ideal location for
trafffic orientated services which is presently not available at this
time at this intersection . The original zoning tending more to an agri -
cultural business was granted in 1977 , but as the front range has be-
come more involved with high tech industries and recreation , this inter-
section of I -25 and Colorado 66 has become a very important intersection
as noted by the attached traffic count studies . C-4 zoning does provide
for this Highway business and is in keeping with the Weld County Compre-
hensive Plan .
' Statement on Compatibility with surrounding land uses ( item 9 of Rezoning
Procedural Guide ) .
The property is adjacent to the following businesses : Essex Crane Rental
page two Department of Planning Services November 1 , 1983
C
Corp . , Rancon Equipment Contractors , Arkansas Valley Seed & Truck Sales ,
American Fertilizer & Chemical Co . , and Sekich Equipment Co . The property
would be very compatible as a transitional zone between the Interstate
Highway and Industrial Area listed above .

Dear Mr. Mayerl :
We have reviewed the Melvin Rahm application for a change of zone and
ask that sufficient right of way be protected to accommodate future traffic
on State Highway 66. Based on projected traffic, a minimum 150-foot total
right of way will be necessary, 75 feet each side of the highway centerline.
We ask that any additional width to meet this need be protected by setback,
reservation, or (preferably) dedication as permitted by local regulations.
Please refer any future development plans for this property to us for
review.

Dear Mr. Mayer] :
The area in question has a drainageway through it that is
proposed for abandonment. From the information available,
we cannot find how the water will be controlled.
Should this project be approved, 1 would suggest that an
erosion control plan be developed prior to any construction
permits. Our office would be available to provide assistance
to the applicant on this project.

COLORADO From Ron Stow, Environmental Health
Subject. Rahm, C0Z 394:83:9
Our comments are as follows:
As certain structures are planned for this area and if the project
is approved, we require various approvals for the multitude of facilities.
Restaurant:
Plans must be submitted to our division detailing the kitchen, food
preparation, food storage, restrooms, and dining areas. Our division
will review the plans for adequacy. If approved, construction can
commence after obtaining building permits. Before the restaurant
can open, our division must complete an on-site inspection and give
approval for licensing.
Swimming Pools:
Plans must be submitted to our division for each pool . We will review
the plans for compliance with the Colorado regulations for swimming
pools. We must approve the plans before construction can commence.
Sewage System:
Further explanation of what exactly is proposed is needed. An engineering
firm must determine design, operating, and maintenance needs for such
a system. Approval for the system must be made through five different
review agencies with ultimate approval by the Colorado Health Department's
Water Quality Control Division.
Motel :
Facilities construction must conform to the Colorado Public Accomoda-
tions regulations.
