COLLINS WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, it has been determined by the Board of County Commissioners at a public meeting held on the 24th day of February, 1982 , in the Chambers of the Board, that the division into two parcels of land, as shown on the plat known as Recorded Exemption No. 537 , being the property of Mrs. Velma L. Collins , described as the E1/2, NEn, Section 27 , Township 7 North, Range 65 West of the 6th P.M. , Weld County, Colorado, being more particularly described as follows : Attached is Exhibit "A" incorporated herein by reference does not come within the purview of the definition of the terms , "subdivision" and "subdivided land" , pursuant to its authority under Section 30-28-101 (10) (d) , CRS 1973 , as amended. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado that the hereinabove described parcel of land owned by Mrs . Velma L. Collins be, and hereby is, exempt from the definition of the terms "subdivision" and "subdivided land" . Collins for a recorded exemption. The parcel of land on which this request is being made is described as the E' , NE1, Section 27, T7N, R65W of the 6th P.M. , Weld County, Colorado. This property is located approximately three (3) miles northeast of the town of Eaton. The property contains approximately 82 acres, more or less. The applicant wishes to sell 78 acres, more of less, of the farm land to the adjacent landowner and retain 41 acres, which contains the existing improvements for a personal residence. The 78 acres, more or less, will continue to be farmed. Based on submitted information and policies of the County, the Department of Planning Services staff recommends the request be approved for the rollowing reasons: 1. The request complies with Section 9-2 C. of the Weld County Submission Requirements of the Subdivision Regulations. 2. The request complies with Section 9-2 E. of the Subdivision Regulations as follows: The 82 acres, more or less, under consideration will allow agricultural and related uses to be the predominant uses. The use will be compatible with existing and surrounding agricultural uses. These facts also support the proposal as being consistent with the intent clause of the Agricultural District. Weld County, CO Dear Mr. Hohn: Under paragraph 4, subparagraph B, procedural guide for recorded exemption and subparagraphs 2, 3, 4, 5, and 6 of paragraph 4, subparagraph B, sub- paragraph 2 requests that the proposal be consistent with the Weld County Comprehensive Plan. It is my understanding that the proposal is consistent with the Weld County Comprehensive Plan in the effect that it is located in a rural agricultural area. The recorded exemption does meet the stand- ards and requirements of the Weld County Comprehensive Plan in that Parcel "A" is approximately 41/2 acres in size and parcel "B" is approximately 78 acres in size. Parcel "A" which is being retained does include improvements. There is a letter in the file explaining that the adjoining land owner is purchasing Parcel "B" to increase the size of his unit. He has no need or requirement for the improvement site. The party retaining the improvement site will continue to live there. Subparagraph 3 of paragraph 4, subparagraph B states that the proposal be consistent with the intent of the district in which the property is located. The intent of the use of the property is consistent with the district in which the property is located. The use of the property will continue as it presently is - a farming operation, with the improvement area used as living quarters for the present owner of the property. Subparagraph 4 of Paragraph 4, subparagraph B explains the uses which are permitted. The property will continue to be used as it is compatible with the existing surrounding land use. It will also continue to be used as agricultural property for the use and benefit of the adjoining neighbor who is purchasing the larger parcel which will enlarge his present farming operation. 820619 k February 8, 1982 Page 2 Subparagraph 5 of paragraph 4, subparagraph B explains the uses which would be permitted with the future developments of the surrounding area by the existing zone and it explains future development projected by the Comprehensive Plan of the County and the adopted master plans of the effected municipalities. It appears that in the future very little development will come about in this area because it is surrounded by agricultural zoned properties and is in compliance with the present Comprehensive Plan of the County. In the general area, the property is all zoned agricultural . I do not know of any adopted master plans of any municipalities in this area, and to the best of my knowledge there should be no effect on municipalities. Subparagraph 6 of paragraph 4, subparagraph B states under the procedural guide that a statement is requested if the proposal is inconsistent with the efficient and orderly development. I am selling my farmland land to an adjoining land owner and retaining approximately 4%2 acres with my improvements for my personal use and the use of my daughter, Linda Will . In the last 10 months, I have undergone two major surgeries as well as other major treatments. Due to these circumstances, I am selling my land and retaining my home to live in. I have placed the 42 acre site in a life estate for my daughter. We did this between my stays in the hospital . However, since that time, my neighbor has agreed to buy the farmland. In order for him to put a sprinkler on the land, I am adjusting the boundaries of the life estate area to the boundaries we have agreed upon.
