RESOLUTION
RE: APPROVE CONTINUANCE OF SHOW CAUSE HEARING TO SEPTEMBER 7,
1983 , CONCERNING WELD COUNTY DISPOSAL, INC.
WHEREAS , the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS , a Show Cause Hearing to consider the revocation of
Special Use Permit No. 454 , issued to Weld County Disposal , Inc. ,
was scheduled for May 11 , 1983 , at 2 : 00 p.m. , as stated in the
Notice dated April 18 , 1983 , a copy of said Notice being attached
hereto and incorporated herein by reference, and
WHEREAS, at the hearing of May 11 , 1983 , only four Commis-
sioners were present, therefore, Darrell McKnight, representing
Weld County, Disposal, Inc. , requested a continuance to June 1 ,
1983 , said request being granted by the Board, and
WHEREAS, on June 1 , 1983 , a letter was submitted to the
Board from James W. Smith, Attorney representing Weld County
Disposal, Inc. , requesting a continuance, and
WHEREAS, it was stated in said letter that Weld County Dis-
posal, Inc. would cease operations on June 1 , 1983 , for a period
of ninety (90) days, and
WHEREAS, the Board, after consideration, deems it advisable
to approve the request for a continuance of this matter until
September 7, 1983 , at 2 : 00 p.m.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado that the Show Cause Hearing
to consider the revocation of Special Use Permit No. 454 , issued
to Weld County Disposal, Inc. be, and hereby is, continued to
September 7 , 1983 , at 2 : 00 p.m.

A public hearing was conducted on June 1 , 1983 at 2:00 P. M. , with
the following present:

Also present:

Assistant County Attorney, Lee D. Morrison
Planning Department Representative, Rod Allison
She following business was transacted:
a hereby certify that pursuant to a notice dated April 18, 1983, duly published
on April 21, 1983, in the La Salle Leader, a public hearing was held for the pur-
pose of considering the revocation of Special Use Permit #454 for Weld County
Disposal, Inc. This hearing had been continued from May 11, 1983. Mr. Morrison,
Assistant County Attorney, read this proposal into the record. Rod Allison,
Planning Department representative, stated that a letter had been received from
James W. Smith, Attorney representing Weld County Disposal, Inc. Mr. Allison
said that Weld County Disposal, Inc. was willing to temporarily shut down their
operation for a period of ninety days so that the lining in the evaporation pits
can be examined. This examination will be done by Weld County Disposal, Inc. 's
engineer and, if necessary, by the County and State Health Departments. Mr.
Allison said that the Planning staff does support this idea, therefore, they are
requesting that this matter be continued. Mr. Allison then submitted the letter
to be put into the record. Wes Potter, fion the Health Department, was asked by
the Chairman if he felt that the operation would be up to par by September 7, 1983.
Mr. Potter said it depended upon the evaluation of the liner, especially in Pond A
and Pond C. Mr. Potter said his department also recommended that this matter be
continued. After further discussion, Mr. Allison said this would give Weld County
disposal, Inc. an opportunity to work with the County in regard to other problems
at the site. Mr. Potter concurred with this, saying that this would give Weld
County Disposal, Inc. the opportunity to bring their wells into compliance.
Mr. Morrison pointed out that the letter from Mr. Smith states in paragraph 1,
that the Weld County Health Department shall give permission allowing the re-
opening of the facility. He suggested that the Board consider whether they
want to have the approval allowing the re-opening rather than the Health Department.
Commissioner N. Carlson said their approval could be upon the recommendation of
the Health Department. Commissioner J. Martin said the entire matter is totally
dependent upon the results of the tests. Darrell McKnight, representative from
Weld County Disposal, Inc. , was present. Mr. McKnight questioned why the Health
Department was so concerned about the monitoring wells, saying there were seven
of them there now. Mr. Potter explained his concerns. After further discussion, '
Mr. McKnight said the engineer would be contacted and Weld County Disposal, Inc.
would try to be in compliance by September 1, 1983. Commissioner Johnson moved
to continue this hearing until September 7, 1983, at 2:00 p.m. Commissioner
Martin seconded the motion and it carried unanimously.

NOTICE
Pursuant to the Zoning laws of the State of Colorado and the
Weld County Zoning Ordinance, a public hearing will be held
in the Chambers of the Board of County Commissioners of Weld
County, Colorado, Weld County Centennial Center, 915 10th
Street, Greeley, Colorado, at the time specified. All persons
in any manner interested in the hearing to show cause are
requested to attend and may be heard.
BE IT ALSO KNOWN that the materials pertaining to the Special
Use Permit may be examined in the Office of the Clerk to the
Board of County Commissioners, located in the Weld County
Centennial Center, 915 10th Street, Third Floor, Greeley,
Colorado.

LEGAL DESCRIPTION : Part of the NWq NWa of Section 12 , Township
1 North, Range 66 West of the -6th P.M. ,
Weld County, Colorado.
ISSUES : 1. The appropriateness of the current use of pond "A" .
In particular, is there proper handling of the
waste so that evaporation ponds do not contain oil?
2 . Whether pond "B" has been closed or otherwise used
in accordance with the development standard-s; that
is, is it properly lined or, if it is abandoned,
does it comply with standards for reclamation?
3 . Whether or not there is seepage in the vicinity of
the facility and the source of the seepage. The
adequacy of the monitering wells and information
obtained from the wells will be considered.
4. Whether the freeboard is properly maintained
according to the recommendations of the State and
County Health Departments.
