RE: APPOINTMENT OF MEMBERS FOR SPANISH COLONY RECREATION BOARD
WHEREAS , the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS , Weld County possesses certain property in the
vicinity of Espanola Subdivision, which is used for recreation
purposes and is more particularly described as follows:
All that part of the Southwest Quarter of the
Southeast Quarter of Section 25 , Township 6
North, Range 66 West of the 6th Principal
Meridian, Weld County, Colorado, lying south
of County Road 64 , being more particularly
described as follows:
Beginning at the Northwest corner of the
Spanish Colony, thence North 00°27 ' 07" East,
128 . 00 feet to a point in the south line of
Weld County Road 64 ; thence along the south
line of County Road 64 North 85°35 ' 25" West,
758. 93 feet; thence South 00°20 ' 19" West ,
195. 72 feet; thence North 89°17 ' 28" East,
757 . 15 feet to the point of beginning; said
parcel containing 2 . 813 acres , more or less.
WHEREAS, various residents and property owners of the Espan-
ola Subdivision, also known as Spanish Colony, have maintained,
operated and constructed softball and/or baseball fields on the
above described property, and
WHEREAS , the Board wishes to have those residents and land-
owners in the area act as caretakers for the ball field, and
WHEREAS , the Board deems it appropriate to create a Recrea-
tion Board for that purpose.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado, that the Spanish Colony
Recreation Board, hereinafter referred to as Recreation Board,
has the right and authority by this Resolution to operate and
maintain a softball/baseball facility on a County-owned property
in accordance with the following provisions :
1 . Such authority is limited to the property previously
described herein.

2 . The authority to charge a fee is to be limited to
organized tournament softball/baseball games .
3. The Recreation Board may charge a reasonable fee in an
amount not to exceed the actual costs of preparation and main-
tenance of the field and the furnishing of bases and other equip-
ment needed in such tournaments and for the general maintenance
and upkeep of the fields , but this provision shall not limit the
charging of a fee in excess of the actual costs where the profits
are to be donated to a bona fide charitable organization.
4. The Recreation Board shall have the responsibility of
seeing that the fields are prepared and bases and other equipment
needed in tournaments furnished.
5. The Recreation Board shall have the responsibility of
controlling weeds and maintaining the ball fields. The Recrea-
tion Board shall also provide toilet facilities.
6 . The Recreation Board shall also have the privilege of
operating a concession stand on such property during tournament
games. The Recreation Board, collectively and individually, shall
have the sole liability and responsibility for such concession
stand.
7 . The Recreation Board shall have the responsibility for
establishing reasonable rules and regulations for the use of the
ball field by the public, but such regulations shall not prohibit
the use of the property by the general public.
8. The designation of individual members of the Recreation
Board and the designation of the Board as caretaker of the ball
fields may be terminated at any time by Weld County, with or
without notice.
9 . The members of the Board shall be as follows:

10. Appointment of members will be by the Recreation Board
according to the Recreation Board By-Laws.
11 . The Recreation Board shall be responsible for making
application for a Use by Special Review for the ball fields on
the above described property and for complying with the terms
and conditions of said USR, if granted.
12. This Resolution shall supersede this Board' s Resolution
of November 26 , 1979 , RE: Designation of Alvin Garcia as Care-
taker of Baseball Diamond.
The above and foregoing Resolution was, on motion duly made
and seconded, adopted by the following vote on the 13th day of
February, A.D. , 1984 .

RE : Alvin Garcia and Colony Improvement Corporation
Dear Commissioners :
I am writing in behalf of Alvin Garcia regarding the ballfields
located near the Colony north of Greeley . As I understand it , the
background is as follows :
The Colony Improvement Corporation was established in approximately
1970 as a non-profit corporation. The present directors are Alvin
Garcia, Jessie Gomez , and Ray Jojola. On September 26 , 1979 the
Weld County Commissioners adopted a resolution which, among other
things , designated Alvin Garcia as a caretaker and prescribed
certain duties for him to perform. That resolution also permitted
Mr. Garcia to charge $5 . 00 per game for tournaments . At one time or
another , Weld County had expressed an intention to level the
playing fields in order to prepare them for ballgames . For whatever
reason, that job got delayed and Mr. Garcia contacted Flatiron
Paving and they leveled the fields free of charge for Mr . Garcia , a
service worth approximately $14 , 000. 00 . Mr . Garcia has also
borrowed money in his own name to purchase the materials and labor
to erect a fence at the ballfields . He has totalled personal
indebtedness for that project in the amount of approximately
$3 , 000 . 00 . He would also like to get Greeley water and sewer
services to the field for a cost of approximately $2 , 000 . 00 . Mr.
Garcia would also like to get electricity to the field which would
be put there at no cost , however , there must be an agreement that
monthly charges would be paid for at least five years .
In behalf of Mr. Garcia , I respectfully ask you to consider the
following:

1 . That Weld County deed the fields to the Colony Improvement
Corporation , OR ,
2 . That Weld County enter into a five , ten year or perhaps
longer lease with the Colony Improvement Corporation .
3 . Either under the auspicus of alternative 1 or 2 , Mr . Garcia
would like the Colony Improvement Corporation to be able to charge
$50 per tournament with an optional charge of $50 per diamond for
lining and raking the fields during tournaments . The last charge
would of course , be optional to the teams and they could elect to
do this themselves out of their own pocket .
4 . Mr. Garcia would like the permission and ability to recover
the cost he has put forward for the fences by means of having the
exclusive right to run the concession stand at the fields .
Your consideration of these matters would be greatly appreciated
and by this letter , I would ask that at the earliest convenient
time , you place this matter on your official agenda for considera-
tion and contact Mr . Garcia and myself so we may be present to
answer any questions you may have .
For your convenience , please find enclosed, a photocopy of
resolution that I have referred to earlier in this correspondence .
Please also be advised that in initially discussing this matter
with Mr . Norm Carlson , he remembered the possibility that the land
on which the fields are situated may have been originally donated
to the County by Mr . Ken Monfort and that any such donation might
have some conditions or restrictions for future use .

Gentlemen :
Around the latter part of November, 1982 I was contacted by Manual
Silva regarding the possibility of constructing a softball complex
in the area west of the Spanish Colony.
At that time James Lauer, president of Flatiron Paving Company,
Manual Silva and myself toured the area and Flatiron Paving Company
agreed to do all removals of existing debris and grading of the site
for drainage . Since then we have completed our agreement plus
numerous other donations such as gravel, sand, etc .
Let it be understood that all work done was only agreed upon be-
tween Flatiron Paving Company representatives and Manual Silva.
At no other time were we contacted by anyone for work performed .
If you have any other questions regarding this matter, please feel
free to contact me at my office (353-2777) .

have the responsibility of controlling weeds Lind
maintaining the baseball diamond. Caretaker shall
also provide toilet facilities .
6. Caretaker shall also have the privilege of operating
a concession stand on such property during tournament
games. Caretaker shall have the sole liability and
responsibility for such concession and shall indemnify
and hold harmless Weld County from any liability
arising from such operation .
7 . Caretaker shall have the responsibility for establishing
reasonable rules and regulations for the use of the
baseball field by the public .
8 . Caretaker shall not prohibit use of the property by the
general public .
9 . This designation may be terminated) at any time by Weld
County with or without notice.
