HomeMy WebLinkAbout830919.tiff RESOLUTION RE: APPROVAL OF ADDENDUM CONTRACT OF PSYCHOLOGICAL AND/OR PSYCHIATRIC SERVICES AGREEMENT BETWEEN RICHARD DELANEY, PH.D. AND THE DEPARTMENT OF SOCIAL SERVICES AND AUTHOR- IZATION FOR CHAIRMAN TO SIGN WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, an agreement for psychological and/or psychiatric services between Weld County and Richard Delaney, Ph.D. was approved by the Board of County Commissioners on December 20, 1982, for the term, January 1, 1983, to June 30, 1983, and WHEREAS, an addendum to this contract has been presented to the Board of County Commissioners, for a term to be from June 1, 1983, to June 30, 1983 , in the amount of $60. 00 per hour and not to exceed $1, 000. 00, and WHEREAS, after review, the Board deems it advisable to approve said addendum to the agreement, a copy being attached hereto and incorporated herein. NOW, THEREFORE, BE IT RESOLVED by the Board of County Com- missioners of Weld County, Colorado that the addendum to the agreement between Richard Delaney, Ph.D. and the Department of Social Services be, and hereby is, approved. BE IT FURTHER RESOLVED by the Board that the Chairman be, and hereby is, authorized to sign same. Cleveland, hereinafter referred to as "Provider." Loveland, Colorado 80537 ' 1 . This Contract shall be effective from June 1 , 1983 to June 30, 1983 but shall automatically terminate with the removal of the child or the expiration date of the facility license, whichever is earlier. This contract is in lieu of and supersedes all prior purchase contracts between the parties hereto relating to the services herein described. 2. The County agrees to purchase and Provider agrees to provide therapeutic services as described below to the child/children Jeffery Wachsmuth, Richard Rivera. John Hall , Robert Nelson, Eugene Mott and Daniel Duran. (Children may be added to, or deleted from this list as they enter or leave Therapeutic Foster carp.) 3. The Provider holds a current valid state license and is in compliance with the terms and conditions thereof. SECTION I. Provider shall : 1 . Cooperate with a team of professionals in providing therapeutic foster."_ care. 2. Utilize therapeutic skills in controlling child's/children's behaviors-. 3. Support the caseworker's treatment and educational goals for the child/children. 4. Cooperate in providing other services, as necessary, to meet the special needs of the child/children. SECTION II . County shall : in addition to the $3,600.00 contracted for 1 . Pay an amount not to exceed $1 ,000.00/ for services satisfactorily 1-1-83. performed hereunder. Payment shall include: A. Psychotherapy geared toward resolving personality defects in the child. Rate of therapy: $60.00 NOT TO EXCEED: $4,600.00 for Jan. 1 , 1983 thru June 30, 1983. 2. Determine client eligibility for services purchased under this contract. 3. Assess and collect fees in accordance with the rules and regulations of the Colorado Department of Social Services. 4. Pay Provider within 30 days of receipt of provider billing statement for satisfactorily completed purchased services included in the billing statement. 5. Monitor and provide supervision and consultation as needed or required to assure satisfactory performance of the purchased services under this contract. Section III. Tne Provider ',all: - 1. Not charge any fees to clients for services provided under this contract nor assign the obligations under this contract or enter into any sub- contracts without the express written approval of the Director of the County Department of Social Services or his appointed designee. 2. Comply with the requirements of the Civil Rights Act of 1964. 3. Safeguard the confidentiality of information regarding the child/children • and his parents in accordance with rules of the Colorado State Department of Social- Services. 4. Indemnify County, Colorado State Department of Social Services and the State of Colorado against any liability and loss against all claims and actions based upon or arising out of damage or injury, including death, to persons or property caused or received in connection with the performance of this Contract. 5. Keep such records as are necessary for review, inspection, or audit by Federal, State Department, County, or other authorized personnel for a period of five (5) years. 6. Adhere to applicable Federal, State, and local laws that have been or may hereafter be established. Section IV. General Provisions: 1. The parties to this contract intend that the Provider stand in a relationship of independent contractor to the County. No agent, employee or servant of contractor shall be deemed an employee, agent or servant of the County. provider will be solely and entirely responsible for its acts and the acts of its agents, employees, and servants during the performance of this Contract. 2. Payment pursuant to this Contract is in County, State of Colorado, or Federal funds, whether in whole or in part, and is subject to and contingent upon the continuing availability of County, State of Colorado, or Federal funds - - for the purpose thereof. 3. Either party may terminate this Contract by giving thirty (30) days prior written notice. The County Department reserves the right to terminate this - - Contract without prior notice in the event of an emergency affecting either the child or the Provider, but the parties shall not be released from the duty to perform their obligations up to the date of termination. 4. In the event this Contract is terminated, final payment to the Provider may be withheld at the descretion of the County until final audit. Incorrent payments to the Provider due to emission, error, fraud, or defalcation shall be recovered from the Provider by deduction from subsequent payments under this Contract or by the County as a debt to the County. comm nt-aeRH' r , .eer eut3k Leerningm !rc. Weld County Attorney Date May 23, 1983 COLORADO From Gene McKenna Director Weld CountyDepartment of Social Services subject: Purchase of Service Contract for Psychological or Psychiatric Services - Addendum Dear Tom: Request your review of the attached addendum to the psychological services contract for Richard Delaney, Ph.D. and submittal to the County Board for approval . This amounts to an increase of $1 ,000 to the previous contract for the 1982-1983 fiscal year of $3,600. We have the budget funds available; this would merely increase the ceiling by the $1 ,000 figure so that services can be continued for several youth through June 30, 1983.
