( RE: APPROVAL OF SUBDIVISION EXEMPTION NO. 116 - MR. AND MRS.
LARRY GITTLEIN AND MR. AND MRS. KEN CHRISTIANSON

WHEREAS, the Board of County Commissioners of Weld County,
O Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the

WHEREAS, the Board of County Commissioners of Weld County,

Larry Gittlein
and Mr. and Mrs. Ken Christianson for an exemption from the
definitions of "subdivision" and "subdivided land" in Section

Weld County Subdivision Regulations, and
WHEREAS, the Board of County Commissioners finds that Mr.
and Mrs. Larry Gittlein and Mr. and Mrs. Ken Christianson are
the owners of certain parcels of land located in the Southwest
Quarter of Section 34 , Township 4 North, Range 64 West of the
6th P.M. , Weld County, Colorado. Subsequent to the adoption
of the current subdivision regulations, a 22. 042 acre parcel
was exchanged for a 9. 370 acre parcel. This exemption will
correct an existing subdivision violation on the property.
The subdivision exemption will simply change the property lines
in accordance with the prior property transfers. No additional
parcels are being created by this exemption, and

of land are as follows :

NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado that the above described
parcels of land be, and hereby are, declared to be exempt
from the definitions of "subdivision" and "subdivided land"
as set forth in Section 30-28-101 (10) , CRS 1973 , as amended,
and Section 2-1 of the Weld County Subdivision Regulations.
BE IT FURTHER RESOLVED by the Board that the resulting
tracts of land as described above be, and hereby are, consi-
dered to be single lots.
The above and foregoing Resolution was, on motion duly made
and seconded, adopted by the following vote on the 16th day of
July, A.D. , 1980.

The owners of the property described above have requested an exemption from
Section 2-1 of the Weld County Subdivision Regulations adopted August 30, 1972.
The Department of Planning Services staff has reviewed this request and
reccmnends that the request be Approved for the followings reasons:

Subsequent to the adoption of the current subdivision regulations a 22.042 acre
parcel was exchanged for a 9.370 acre parcel. This exemption will correct an
existing subdivision violation on the property.
The applicants have submitted a letter dated June 27, 1980 which explains why
the transfer of property was done.
The subdivision exemption will simply change the property lines in accordance
with the prior property transfers. No additional p rctfl are being created by
this exemption.
