RE: APPROVAL OF RECORDED EXEMPTION NO. 682 - EARL ANDERSON AND
DORIS ANDERSON
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners, pursuant to its
authority under Section 30-28-101 (10) (d) , CRS , as amended, did
determine at a public meeting held in the Chambers of the Board,
that a certain parcel of land, to be divided into two parcels,
as shown on the plat known as Recorded Exemption No. 682 , does
not come within the purview of the definition of the terms,
"subdivision" and "subdivided land" , and
WHEREAS, the request for Recorded Exemption No . 682 was sub-
mitted by Earl Anderson and Doris Anderson for property being
located in Part of the NWo, Section 13, Township 6 North, Range
65 West of the 6th P.M. , Weld County, Colorado, being more par-
ticularly described in the plat which shall be provided by the
applicant and known as Exhibit "A" , said plat to be recorded, and
WHEREAS , this request is to divide the property into par-
cels of 91 acres and 17 . 032 acres, more or less .
NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado that the hereinabove de-
scribed parcel of land be, and hereby is, exempt from the defi-
nitions of the terms, "subdivision" and "subdivided land" .
BE IT FURTHER RESOLVED by the Board that this approval is
conditional upon the applicants submitting a mylar plat to the
Department of Planning Services to be recorded in the office of
the Weld County Clerk and Recorder. The plat shall be drawn in
accordance with the requirements of Section 9-2C. (4) of the Weld
County Subdivision Regulations . The plat shall be submitted
within ninety days from the date of approval by the Board of
County Commissioners

Re: Recorded Exemption #682
Dear Commissioners:
The attached application, plat and related items are in reference to a request
from Earl Anderson and Doris Anderson for a recorded exemption. The parcel of
land on which this request is being made is described as Part of the NIA
Section 13, T6N, R65W of the 6th P.M. , Weld County, Colorado.
The property is located 4.5 miles northeast of Lucerne on WCR 47. The
property contains approximately 108.032 acres of Class IIe(prime) , IIIe
(prime) , IIw (prime) and IVs irrigated and IVe VIs nonirrigated soils. The
parcel of land under consideration is the total contiguous land holdings of
the applicant.
The request is to divide the property into parcels of 91 acres and 17.032
acres, more or less. Proposed Lot A consists of a house, mobile home, large
garage and dog kennel area. Special Review Permit 100 for a dog kennel
(maximum 30 dogs) was approved for this site June 23, 1971. Proposed Lot B
has an approved Special Use Permit 313 for a dog training track. The balance
of Lot B is used for agricultural production.
Based upon the submitted information and policies of the County, the
Department of Planning Services staff recommends the request be approved for
the following reasons:
1. The request complies with Section 9-2C. of the Weld County
Subdivision Regulations submission requirements; and
2. The request complies with Section 9-2E. of the Subdivision
Regulations as follows:
The 108.032 acres, more or less, under consideration will
be compatible with the existing surrounding area and with
future development of the surrounding area as permitted by
the existing Agricultural Zone.

- The proposal is in compliance with Section 1-3 of the Weld
County Subdivision Regulations and the proposed land
division complies with the Weld County Comprehensive Plan.
Therefore, the proposed use is consistent with efficient
and orderly development.
- The proposal does not exist in an overlay district area.
- The proposed lots meet minimum lot size requirements for
land division.
- The proposed lots are not part of a recorded exemption
within the last five (5) years.
- The two lots proposed will have adequate access from WCR
47 and WCR 70.
The Department of Planning Services staff recommendation for approval is
conditional upon the following:
1. The applicant shall submit a mylar plat to the Department of Planning
Services to be recorded in the office of the Weld County Clerk and
Recorder. The plat shall be drawn in accordance with the requirements of
Section 9-2C. (4) of the Weld County Subdivision Regulations. The plat
shall be submitted within ninety (90) days from the date of approval by
the Board of County Commissioners.

RE: Anderson recorded exemption application
Dear Commissioners :
I represent Doris Anderson, who together with her
ex-husband , is applying for a recorded exemption to operate
a greyhound kennel northeast of Greeley at a location more
specifically detailed in the application. Doris and Earl
Anderson have been operating a kennel on the site upon
which they are applying for a recorded exemption for years .
They had previously undertaken the procedure for use by
special review and now, because of the enactment of a new
law, and because they have had irreconcilable differences
in their marriage , they need a recorded exemption in order
to subdivide their property in accordance with the use
previously obtained .
The uses which Doris Anderson would be putting the
greyhound kennel to will certainly be compatible with the
surrounding area as previously permitted by the existing
zoning and with future development as projected by the Weld
County Comprehensive Plan. Inasmuch as the Weld County
Commissioners had previously granted to the Andersons a use
by special review, Doris Anderson believes that the
proposed land provision is in compliance with the Weld
County Comprehensive Plan. The proposed division will not
be inconsistent with orderly and efficient development ; the
lots resulting from the land division will be both
accessible from existing public roads , Road 47 ; each of the
lots are serviced by an adequate water supply and have
means for disposal of sewage in compliance with Health
Department regulations . Doris Anderson believes that the
health , safety and welfare of the inhabitants of the
neighborhood have not been adversely afffected throughout
the years and will continue not to be adversely affected .
We would apprecate it if you would let both Doris
Anderson and myself and Bob Ray and Earl Anderson know when
you will have a hearing on this application.
