WHEREAS, the Board of County Commissioners of Weld County, Colorado,

with the authority of administering the affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners of Weld County, Colorado
received the December 22, 1982 notice from the City of Greeley regarding the
creation of Local Improvement District #428 because the County owns real
property in the district, specifically the County Courthouse and Centennial
Complex, and
WHEREAS, the creation of Local Improvement District #428 is for the
of financing the construction of improvements generally consisting of
purpose P
modifying streets and alleys for use primarily as pedestrian malls or parking
areas, related landscaping improvements and related street improvements in the
downtown Greeley area adjacent to the real property owned by Weld County, and
Ilq WHEREAS, Weld County owns 160,000 square feet of property in the district
and would be assessed in the range of One Hundred Sixty to One Hundred Seventy
Thousand Dollars ($160,000 - $170,000) for the project which could be paid at
the time of completion of the project or result in a Forty Thousand to
Forty-five Thousand Dollar ($40,000 - $45,000) annual assessment fee for
fifteen (15) years, and

WHEREAS, County staff has indicated that if the assessed value increased
approximately 25% the increased assessed value would result in added property
tax dollars to the County at the current mill levy in excess of Forty-five
Thousand Dollars ($45,000) per year, and

WHEREAS, the City of Greeley has demonstrated that all Weld County .
citizens would benefit from the downtown development of Greeley through
improved economic development, improved employment base, parking in the area,
and enhanced appearance of the core city area of the County Seat.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County that they hereby reaffirm their full cooperation and support of
the Greeley downtown development activities.
BE IT FURTHER RESOLVED by the Board of County Commissioners that it
hereby adopts the policy to support and financially participate in Local
Improvement District #428 by committing to pay the associated assessment upon
completion of the project.
BE IT FURTHER RESOLVED by the Board of County Commissioners that it
hereby directs the Director of Finance and Administration to accommodate the
total County assessment in the 1984 and 1985 capital budget to avoid
committing future boards to the annual assessment amounts beyond fiscal year
1985.
The above and foregoing resolution was, on motion duly made and seconded,
adopted by the following vote on the 17th day of January , A.D. , 1983.

ordinance for the creation of Local Improvement District No. 428. It appears
from information made available to the City that you own real property within
this proposed Local Improvement District. It is for that reason that you are
being furnished a copy of the Notice and of the proposed ordinance. if the
ordinance passes, the work referred to in the ordinance will be completed and
the cost of the project will then be assessed against the property in the
Local Improvement District, as described in the proposed ordinance, including
assessment of a portion of such cost against your property.

NOTICE OF PUBLIC HEARING
REGARDING LOCAL IMPROVEMENT DISTRICT NO.
NOTICE IS HEREBY GIVEN TO THE OWNERS OF LAND PROPOSED FOR INCLUSION IN
LOCAL IMPROVEMENT DISTRICT NO. 428 (The "District") that there will be a public
hearing on this matter before the Greeley City Council at its regularly scheduled
meeting on Tuesday, January 4, 1983, beginning at 7:30 p.m. in the Council Chambers,
Greeley Civic Center Complex, 919 - 7th Street, Greeley, Colorado.
The owners of the lands and lots proposed to be included in the District
are hereby invited to attend the public hearing, and those persons are hereby informed
that their failure to do so may prejudice their rights. Any action brought to
challenge the creation of the District must be brought within (30) days from
the final passage of the ordinance creating the District.
The public hearing shall be concerned with the question of whether or not
the Greeley City Council should create the District for purposes of financing the
construction of improvements generally consisting of modifying streets and alleys
for use primarily as pedestrian malls or parking areas, related landscaping
improvements and related street improvements , in the City of Greeley, Colorado. The
cost of the improvements will be assessed against each piece of property in the
District .
"A COMMUNITY OF PROGRESS"
The anticipated maximum cost of the construction, exclusive of the
incidental costs, is $ 3,660,000 and the anticipated maximum cost of incidentals
is $ 757,000 . Such anticipated maximum costs shall not constitute a limitation
on the actual cost of the improvements or incidentals, the amount of the assessments
to be levied therefor, or any other purpose.
The ordinance creating the District has been considered favorably on
first reading and that ordinance will come before the Greeley City Council for
final passage on second reading at the same regularly scheduled City Council
meeting referred to above.

The City Council of the City of Greeley, in the County of
Weld and State of Colorado, met in a duly called, open regular ses-
sion pursuant to due notice and in full conformity with law and the
ordinances and rules of the Council, at the Civic Center, 919 - 7th
Street, Greeley, Colorado, being the regular meeting place of the
Council, on Tuesday, December 21, 1982, at 7:30 p.m. Upon roll call,

The following ordinance was introduced, presented and

ORDINANCE NO. , 1982
AN ORDINANCE CREATING LOCAL IMPROVEMENT DISTRICT
NO. 428 , FOR THE CONSTRUCTION OF IMPROVEMENTS
GENERALLY CONSISTING OF MODIFYING STREETS AND
ALLEYS FOR USE PRIMARILY AS PEDESTRIAN MALLS OR
PARKING AREAS, RELATED LANDSCAPING IMPROVEMENTS
AND RELATED STREET IMPROVEMENTS, WITHIN THE
GREELEY GENERAL IMPROVEMENT DISTRICT NO. 1 AND
THE CITY OF GREELEY, COLORADO; DESCRIBING THE
IMPROVEMENTS; SETTING FORTH THE ANTICIPATED MAX-
IMUM COST OF THE IMPROVEMENTS; SETTING FORTH THE
LEGAL DESCRIPTIONS OF THE LANDS AND LOTS TO BE
INCLUDED WITHIN THE DISTRICT, AND THE NAMES AND
ADDRESSES OF THE APPARENT OWNERS THEREOF; PRO-
VIDING OTHER DETAILS CONCERNING THE DISTRICT;
AND RATIFYING PREVIOUS ACTIONS.
WHEREAS, the City of Greeley (the "City") , in the County of
Weld and State of Colorado, is a municipal corporation, duly orga-
nized and existing as a home rule city under Article XX of the
Constitution of the State of Colorado; and
WHEREAS, pursuant to Section 5-20 of the Charter of the
City (the "Charter" ) and Chapter 13 . 44 of the Greeley Code of
Ordinances, as amended (the "Code") , the City Council (the "Council")
of the City has determined, and hereby determines, to create, on its
own initiative, the City of Greeley, Colorado, Local Improvement
District No. 428 (the "District") , for the purpose of making certain
local and special improvements as hereinafter described; and
WHEREAS, such improvements will be located entirely within
the Greeley General Improvement District No. 1, created by Ordinance
No. 26 , 1968 (the "Greeley General Improvement District No. 1") .
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF
GREELEY, COLORADO:

Section 1 . There is hereby created and established within
the corporate limits of the City, and entirely within the boundaries
of the Greeley General Improvement District No. 1, a local improve-
ment district to be known and designated as "City of Greeley,
Colorado, Local Improvement District No. 428 , " for the purpose of
making certain local and special improvements, as described in
Section 3 of this ordinance (the "improvements") , and to assess the
costs of the improvements to the property benefited thereby, as pro-
vided in Sections 4 and 5 of this ordinance.
Section 2. All action (not inconsistent with the provi-
sions of this ordinance) heretofore taken by the City or its officers
directed toward the creation of the District and the planning, design
and construction of the improvements, be, and the same hereby is,
ratified, approved and confirmed.
Section 3 . The location and type of the improvements
(consisting of eight components) shall be as follows :
1 . Pedestrian Mall
The project area for the Pedestrian Malls shall be the area
within the 100 foot right-of-way (R.O.W. ) of 8th Street,
from 20 feet east of the west R.O.W. of 8th Avenue to the
west R.O.W. of 9th Avenue ; and within the 100 foot R.O.W.
of 9th Street from 20 feet east of the west R.O.W. of 8th
Avenue to 20 feet west of the east R.O.W. of 9th Avenue.
This project component includes the removal of existing
asphalt , curb-and-gutter , fixtures and construction of
pedestrian malls on each street as generally illustrated in
the approved Schematic Design dated September 7, 1982. The
malls will include :

- concrete and masonry unit paving
- benches, kiosks, trash containers, bike racks and
flagpoles
- decorative and functional lighting
- fountains
play areas
- an amphitheater seating area
- a "Long House" shelter for seating, displays, or
commercial uses
- a "Pavillion" covered seating area
- planting areas for trees, shrubs and flowe-s (with
associated irrigation)
It will also include storm drainage provisions and minor
relocation of utilities where conflicts occur with the Mall
elements.
2. Mid-Block Connections
The project area for this component will be right-of-way to
be determined which will be located in Block #57 and Block
#74.
This project component includes acquisition of right-of-
way, necessary demolition, and associated improvements.

3. Off Street Parking
A. Parking Lot 1
The project area for this component is an area which
includes the 100 foot R.O.W. of 9th Street between the
7th Avenue and 8th Avenue R.O.W. and that portion of
Block 58 south of the alley R.O.W.
This project component includes removal of curb-and-
gutter and asphalt in 9th Street, grading to match the
area north of 9th Street (south portion of Block 58) ,
final site grading, gutter and storm drainage, asphalt
paving, planting areas, irrigation, lighting (re-use
of street fixtures) , and lane and parking striping and
signage.
B. Parking Lot 2
The project area for this component is the area within
Block 36 to the south of Greeley City Complex.
This project component includes the removal of parking
striping and signs and restripping.
C. Parking Lot 8
The project area for this component is an area within
Block 64 generally to the rear of existing buildings,
more specifically illustrated on the Framework Plan
dated August 25 , 1982.

This project component includes final site grading,
gutter and storm drainage, asphalt paving, lighting
(re-use of street fixtures) , planting areas, irriga-
tion, utility relocation, lane and parking striping
and signage.
4. In-Street Parking Lots
A. Lots 5 and 6
The project area for this component is from the east
R.O.W. of 9th Avenue to a line 15 feet west of the
west R.O.W. of 9th Avenue, from the south R. O.W. of
7th Street to the north R.O.W. of 8th Street, and from
the south R.O.W. of 8th Street to the north R.O.W. of
9th Street.
This component includes removal of curb and gutter and
approximately 10 feet of asphalt along thl west side
of 9th Avenue, removal of sidewalk, sod and lighting
along the easternmost 15 foot of Lincoln Park. New
curb and gutter will be placed 15 feet west of its
present location. The present sidewalk will be
replaced by a new 5 foot sidewalk constructed just
west of the curb. New asphaltwill be laid where the
lot is widened. Lighting, planting areas (including
islands to save healthy trees in the 15 foot expansion
area) and irrigation are included. Pavement striping
and signage will be included.

B. J,ot 4
The project area for this component is the 100 foot
R. O.W. of 9th Street from 20 feet west of the east
R.O.W. of 9th Avenue to the east R.O.W. of 10th
Avenue.
This component consists of lighting (re-use street
lights) ; and crosswalks, planting areas and irrigation
in the 9th Street/9th Avenue intersection and a park-
ing collection booth and planting (with irrigation)
near the 9th Street/10th Avenue intersection. Parking
striping and signage will be removed and re»_aced.
C. J,ot 7
The project area for this component is the 100 foot
R.O.W. of 9th Avenue from the south R.O.W. line of 9th
Street to the north R.O.W. line of 10th Street.
This component includes a parking collection booth,
crosswalk and planting near 10th Street and lighting
(re-use street lights) , planting and irrigation.
Parking striping and signage will be removed and
replaced.
5 . Loop Modifications
The project area for this component is curb-to-curb dis-
tance of the following streets :
8th Avenue, from the north R.O.W. line of 7th Street
to the south R.O.W. line of 10th Street.

10th Avenue, from the north R.O.W. line of 7th Street
to the south R.O.W. of 10th Street.
7th Street, from the west R.O.W. of 8th Avenue to the
east R.O.W. of 10th Avenue; and
10th Street, from the west R.O.W. of 8th Avenue to the
east R.O.W. of 10th Avenue.
This component consists of pavement overlay on 10th Avenue
between 9th and 10th Streets (to meet State Highway
Department Standards) , curb neck-downs and ramps as indi-
cated on the Framework Plan; and pavement markings, signage
and signalization removal/replacement to accomplish loop
circulation movements identified in the Circulation
Concepts Study dated June, 1982.
6. Peripheral Sidewalks
The project area for this component is:
The sidewalk area from R.O.W. line (or building facade) to
back of curb for the following:
Both sides of 8th Street, from the east R.O.W. of 8th
Avenue to the west curb line of 7th Avenue;
Both sides of 8th Avenue, from the south curb line of
7th Street to the north curb line of 10th Street,
excluding the curb-to-curb street areas of 8th Street
and 9th Street;
The east side of 9th Avenue, from the south curb of
7th Street to the north R.O.W. of 8th Street, from the
south R.O.W. of 8th Street to the north R.O.W. of 9th
Street, and from the south R.O.W. of 9th Street to the
north curb of 10th Street;
The south side of 7th Street from the west R.O.W. of
8th Avenue to the east R.O.W. of 9th Avenue ; and

The north side of 10th Street from the west R.O.W. of
8th Avenue to the east R.O.W. of 9th Avenue.
This component shall include street trees and/or planting
areas (except where trees currently exist) , irrigation
lines and a decorative paving band in the sidewalk. It
also includes decorative lighting fixtures on the west side
of 8th Avenue between 8th and 9th Streets, and along the
east side of 9th Avenue between 8th and 9th Streets.
7 . Lincoln Park
The project area for this component is:
The 100-foot R.O.W. of 8th Street, from the west R.O.W. of
9th Avenue to the east R.O.W.. of 10th Avenue; and a 6-foot
R.O.W. to be determined around the perimeter of Lincoln
Park.
This component shall include removal of curb-and-gutter,
asphalt, fixtures, and signage (existing sidewalks and
Gazebo to remain) ; and new soil backfill , sod, and
irrigation. A 6-foot wide jogging path around the perime-
ter of Lincoln Park (meandering alignment) shall also be
included.
8. Bus Transfer Facility
The project area for this component is:
On R. O .W. to be determined within Greeley General
Improvement District #1 area.

This component will include paving, curb and gutter,
signage, or other improvements.
The Schematic Design ; the Framework Plan and the
Circulation Concepts Study referred to above are on file in the
office of the City Clerk and are available for inspection.
Section 4. The anticipated maximum cost of the improve-
ments, exclusive of incidental costs, is $3,660,000.00 Such antici-
pated maximum cost shall not constitute a limitation on the actual
cost of the improvements nor upon the amount of the assessments to be
levied therefor, nor for any other purpose. Incidental costs in con-
nection with the District, which are in addition to the anticipated
maximum cost set forth above, shall include engineering, architec-
tural, design and legal fees, and the expenses of inspection, adver-
tising, abstracting, publishing, posting, collection and any other
incidental costs directly related to the creation of the District and
the making of assessments therein (including, without limitation,
interest on local improvement district bonds to be issued until com-
mencement of assessment installment payments and other costs and
expenses related to such bonds) . The anticipated maximum amount of
incidental costs is $ 757,000.00 . Such anticipated maximum cost shall
not constitute a limitation on the actual costs of incidentals nor
upon the amount of assessments to be levied therefore, nor for any
other purpose. The amounts to be assessed against the lots and lands
in the District shall be established by ordinance after substantial
completion of the improvements. Such assessments shall be based upon
the total cost of the improvements and such incidental costs. All of
such total construction and incidental costs shall be assessed
against the lands and lots within the District, as provided in
Section 5 of this ordinance.

Section 5. The costs of the improvements to be assessed
against the lands and lots within the District shall be assessed on a
zone basis, as follows:
The District shall be divided into five zones as follows:
Zone 1 : North 1/2 of Block 64 , all of
Block 57 and the south 1/2 of Block 44.
Zone 2: South 1/2 of Block 64, west 1/2 of
Blocks 43 , 58 , and 63 , and north 1/2 of
Block 44.
Zone 3 : All of Blocks 45 , 56 and 65, and
east 1/2 of Blocks 43 , 58 and 63.
Zone 4: North 1/2 of Blocks 76, 77 and 78,
north 1/2 of east 1/2 of Block 75, east 1/2
of Blocks 46, 55 and 66, south 1/2 of east
1/2 of Block 35, and south 1/2 of Blocks
36, 37 and 38.
Zone 5: South 1/2 of Blocks 75, 76, 77 and
78, west 1/2 of north 1/2 of Block 75, west
1/2 of Blocks 35 , 46 , 55 and 66, north 1/2
of east 1/2 of Block 35 , north 1/2 of
Blocks 36 , 37 and 38 and all of Block 23 .
The total costs to be assessed shall be assessed as
follows :

The Council has determined, and hereby determines, that
such basis of assessment is equitable and in accordance with the spe-
cial benefits to the lands and lots within the District. In case of
any lands or lots which are irregularly shaped or in any other case
in which an assessment according to the basis hereinbefore described
would be disproportionate to the special benefits, an equitable
adjustment shall be allowed so that the assessment is in proportion
to the special benefits.

The Council has determined, and hereby determines, that all
such lands and lots will be specially benefited by the improvements.
Section 7. Within a reasonable time after final passage
of this ordinance, the City will make the improvements or authorize
the making of the improvements. Any contract or contracts let for
the construction of the improvements shall be awarded to the lowest
bidder in accordance With Section 5-10 of the Charter and all appli-
cable Code provisions and other ordinances and regulations.
Section 8. If any section, paragraph, clause or provision
of this ordinance shall be held to be invalid or unenforceable, the
invalidity or unenforceability of such section, paragraph, clause or
provisions shall in no manner affect any other provision of this
ordinance.
Section 9. All ordinances, resolutions, bylaws and regu-
lations of the City in conflict with this ordinance are hereby
repealed to the extent only of such inconsistency. This repealer
shall not be construed to revive any ordinance, resolution, bylaw or
resolution, or part thereof, heretofore repealed.

Section 10 . This ordinance, immediately on its final pas-
sage, shall be recorded in the City book of ordinances kept for that
purpose, authenticated by the signatures of the Mayor and Clerk, and
shall be published in the Greeley Daily Tribune, a legal newspaper of
general circulation in the City. The Council hereby determines, pur-
suant to Section 3-21 of the City Charter, that such publication
shall be by publication of the title hereof together with a statement
that the text hereof is available for public inspection and acquisi-
tion in the office of the City Clerk.
Section 11. No legal or equitable action shall be brought
or maintained to enjoin or in any way challenge the creation of the
District unless such action is brought within thirty (30) drys from
the final passage of this ordinance.
Section 12. This ordinance shall take effect five (5)
days after its final publication as provided by Section 3-16 of the
Charter.

Weld and State of Colorado, met in a duly called, open regular ses-
sion pursuant to due notice and in full conformity with law and the
ordinances and rules of the Council, at the Civic Center, 919 - 7th
Street, Greeley, Colorado, being the regular meeting place of the
Council, on Tuesday, January 4 , 1983 , at 7:30 p.m. Upon roll call,

which ordinance was introduced and passed and approved on first read-
ing on December 21 , 1982, had, as ordered by the Council, been pub-
lished by title in The Greeley Daily Tribune, a newspaper of general
circulation in the City of Greeley, in its issue of December _,
1982 , being at least ten (10) days prior to this meeting; and that
the publisher ' s affidavit of publication of the ordinance is now on
file in the office of the City Clerk. The City Clerk further
announced that, pursuant to Section 13.44.100 of the Greeley Code of
ordinances, a notice of public hearing on the creation of the City of
Greeley, Colorado, Local Improvement District No. 428 had been duly
published in The Greeley Daily Tribune in its issue of December _,
1982, being at least eleven (11) days prior to •this meeting, and that
the publisher' s affidavit of publication of said notice is now on
file in the office of the City Clerk; that said notice had also been
mailed, on December _, 1982, being at least seven (7) days prior to
this meeting, by registered or certified mail, to each apparent owner
of property within the District, at the property address as shown in
the ordinance; that the City Clerk used reasonable efforts to cause
such notice to be delivered to each street address within the
District at least _ days prior to this meeting and that this was the

On motion duly made and unanimously carried, it was ordered
that the affidavits of publication of the ordinance and the notice of
hearing be received, filed and preserved among the records of the
City Clerk. Thereupon, the ordinance was read by the City Clerk in
full for the second time.

The presiding officer declared that, all persons desiring
to be heard having been heard, and the Council having received and
considered all petitions, evidence and arguments pertaining generally
to whether the proposed Local Improvement District No. 428 it neces-
sary or desirable, the public hearing was closed.

nance be finally passed and adopted as read. The question being upon
the passage and adoption of the ordinance, the roll was called with

City be finally published in accordance with Section 3-21 of the City
Charter, by publication of the title of the ordinance, together with
a statement that the text thereof is available for public inspection
and acquisition in the office of the City Clerk in The Greeley Daily
Tribune, a newspaper of general circulation in the City of Greeley,
Colorado, and be recorded according to Charter provision.
The Council then considered other business and took other
action not concerning the City's Local Improvement District No. 428.

posed ordinance for the creation of Local Improvement District
No. 428. It appears from information made available to the City that
you own real property within this proposed Local Improvement
District. It is for that reason that you are being furnished a copy
of the Notice and of the proposed ordinance. If the ordinance
passes, the work referred to in the ordinance will be completed and
the cost of the project will then be assessed against the property in
the Local Improvement District, as described in the proposed ordi-
nance, including assessment of a portion of such cost against your
property.

NOTICE OF PUBLIC HEARING
REGARDING LOCAL IMPROVEMENT DISTRICT NO.
NOTICE IS HEREBY GIVEN TO THE OWNERS OF LAND PROPOSED FOR
INCLUSION IN LOCAL IMPROVEMENT DISTRICT NO. 428 (the "District") that
there will be a public hearing on this matter before the Greeley City
Council at its regularly scheduled meeting on Tuesday, January 4 ,
1983, beginning at 7:30 p.m. in the Council Chambers, Greeley Civic
Center Complex, 919 - 7th Street, Greeley, Colorado.
The owners of the lands and lots proposed to be included in
the District are hereby invited to attend the public hearing, and
those persons are hereby informed that their failure to do so may
prejudice their rights. Any action brought to challenge the creation
of the District must be brought within thirty (30) days from the
final passage of the ordinance creating the District.
The public hearing shall be concerned with the question of
whether or not the Greeley City Council should create the District
for purposes of financing the construction of improvements generally
consisting of modifying streets and alleys for use primarily as
pedestrian malls or parking areas, related landscaping improvements
and related street improvements, in the City of Greeley, Colorado.
The cost of the improvements will be assessed against each piece of
property in the District.

The ordinance creating the District has been considered

Greeley City Council for final passage on second reading at the same
regularly scheduled City Council meeting referred to above.
