BROOMFIELD, COLORADO 80020. WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners held a public hearing on the 7th day of October, 1981 at the hour of 2 : 00 o'clock p.m. in the Chambers of the Board of County Commissioners for the purpose of hearing the application of Turnpike Construction Company, Highway 287 & Midway Blvd. , Broomfield, Colorado 80020 , for a Use by Special Review for an amendment to Special Use Permit #249, on the following described real estate, to-wit: Part of the Southwest Quarter, Section 30, and part of Section 31, Township 2 North, Range 68 West, of the 6th Principal Meridian, County of Weld, State of Colorado. WHEREAS, Section 24. 4. 2 of the Weld County Zoning Ordinance provides standards for review of said Use by Special Review, and WHEREAS, the Board of County Commissioners of Weld County, Colorado heard all of the testimony and statements of those present, has studied the request of the petitioner and the recom- mendations of the Weld County Planning Commission and all of the exhibits and evidence presented in this matter, and having been fully informed, finds that: 1. The requested changes do not substantially differ from the original Special Use Permit approved by the Board of County Commissioners. 2. This proposed operation is in compliance with the provisions of Section 24 . 4 . 2 of the Weld County Zoning Ordinance. The proposed use will be compatible with the surrounding area, in harmony with the character of the neighborhood and existing agricultural uses, compatible with the future development in the area and will not adversely affect the health, safety and welfare of the inhabitants of the area and the County. This determination is based upon the following responses from the referral entities listed below. Each of the following referral entities have reviewed this request and have set forth no objections to it: A. Town of Erie Planning Commission B. State Highway Department NOW, THEREFORE, BE IT RESOLVED by the Board of County Com- missioners that the application of the petitioner for an amendment to Special Use Permit #249 , on the hereinabove described tract of land be, and hereby is, granted subject to the following conditions: 1. The amendments to the Development Standards being recommended and approved for the Special Use Permit. Original standards remain intact with the following exceptions: a. Standard A9 shall be amended in total to read: During all phases of the development, crusher and stock pile location may remain in the phase 1 configuration and/or as work progresses may change to the configuration as set forth in Phase 2 and 3. It will not be necessary to complete one phase prior to the commencement of a second phase. Rehabilitation, however, shall commence as soon as reasonable practical after the completion of any of the three phases. Any such facility locations shall be made in such a manner so that no significant increase to the present flood hazards results. b. Standard A10 shall be amended to read: Ingress and Egress in and to the subject property shall be from Colorado State Highway No. 52 and/or County Road No. 1. Any construction of haul road or access facilities shall be made in such a manner so that no significant increase to the present flood hazards results. c. A Standard All shall be added to read: The Mined Land Reclamation Board has authority to issue permits for mining and reclamation activities. Activities related to mining and reclamation are therefore under the jurisdiction of the Mined Land Reclamation Board. However, Weld County has jurisdiction of those matters outlined in the Operational Standards. d. Development Standard A7 will be deleted. 2. Prior to advertisement for the Board of County Commissioners hearing, a traffic study shall be completed and its results and subsequent access design submitted to Boulder County Public Works Department for review. Boulder County has expressed the need to insure safe ingress and egress for the proposed County Line Road access point. This may in- clude warning signs or may require accel/decel land construction. Boulder County further indicated traffic volumes from the gravel operation were needed to identify the safety needs of the access. 3. Required safety improvements shall be listed on the plat prior to recording; the approved plan shall be submitted to the Weld County Department of Planning Services to become part of the file documents; and, any required construction or installation shall be made no later then June 15, 1981. Tom Honn responded to a question concerning access to the property by the Planning Commission. General discussion of access to the property and the location of the crusher followed. Interested neighbors expressed their concerns about weed control , dust control , reclaimation and who will be responsible for these things . The Planning Commission asked Mr. Anson about the relevancy of these questions . Mr. Anson responded that the questions were relevant to the discussion. Another interested neighbor, Roger Drotar expressed his concerns regarding erosion of the land by water and the dust problems . Planning Commission Minutes . Commission agread to hear the new engineering information but informed Mr. messner that they will not make a recommendation with out the approval from the Weld County Engineering Department. In response to a phone conversation that we had, it was indicated by you that perhaps a formal traffic study was not particularly what was the object of Boulder County' s real requirement in response to special use permit change application. As you know, at the time at which the original application was approved in 1974 , all exits from the gravel pit area operated by Turnpike Construction Co. , required to exit upon Highway 52 which is to the south of the subject area. No exits were to be made or entered through or entrances made upon county line road due to, as I understand, the impact upon the bridge which was existing at that time, together with concerns about the potential impact upon County Line Road. It is my understanding that the bridge has now been redone or reinforced and it was my client' s request that, of Weld County, they allow an additional exit allowing the trucks to exit upon County Line Road. They had been, previous to the time at which we made our request, going ahead and exiting on to County Line Road and had done so for a period of time which was, as I am able to discern, the result of a lack of communication between those in authority at the plant and those in authority at the office as to the prohibitive access to County Line Road. Nevertheless, in response to the Memorandum and the questions asked therein in our phone conversation, I have talked to Mr. Dan Hughes at Turnpike Con- struction and he indicates, based upon his best knowledge, the answers to your questions are as follows: 1. No. of existing and projected trips per day Answer: The presumption is that we are considering working days only - on to County Line Road - general average is from five to ten exits and entrances from that road per day On Highway 52 - two to four trips per day. This is, of course, an average figure and would increase markedly during periods where there is a heavy haul to a particular location. It would decrease also markedly during the winter months where there is little activity. IIIMOw Letter to Bruce Johnson Dated: May 14, 1981 Page 2 2. Designations of existing and future trips. Answer: To the best we are able to determine, 900 of the trips leaving both locations find their way to Highway 52. Approximtely one half of those trips go east to I-25 and approximately 50% west to Highway 287 . It is a very rareo occurrence when one would go north and none go Erie as a permit is required to haul through Erie. 3. Identification of specific haul routes and the percentage of distribution of trips. Answer: The general haul routes generally are on the exit on County LIne Road to Highway 52 or the exit on Highway 52. Again approximately one-half of those trucks, after finding their way to Highway 52 east to I-25 and approximately one-half of the trucks go west to Highway 287 . Basically, the reason for this is, of course, as previously mentioned, the requirement of the permit to Erie and it is simply easier to go over to Highway 287 and not try to meander up County Line Road and get to any location that way. I would hope this would be helpful to you in determining the traffic impact on County Line Road. This is, of course, based upon the best recollection and knowlede of Danny Hughes who is Superintendent for Turnpike Construction Co. and is based upon past experience and his knowledge. We do not keep any particular and concise records of how many trips and, in fact, actual destinations of trips. However, the information should be pretty accurate. Of significance in the proposal is the request to allow an additional equipment access onto Boulder - Weld County line. The basis for the applicant's request, as stated, is that the object of Boulder County's original objection at the time of approval in 1974 has been removed by replacement of the restricted bridge over Boulder Creek. It is acknowledged this was accomplished in 1976-77. Our concerns at this time extend to the area of traffic impact. It is suggested by the applicants that the requested changes will have minimal impact based upon actual operations of the gravel pit. Further information from Weld County is needed to substantiate this claim. As you are aware, on more recent special use applications, Boulder County has expressed concern over the potential impact of utilizing County Line Road as a specific haul route where significant truck traffic is involved. In order to assess the possible impact of this proposed change, a brief analysis of the following is needed: 1. Number of existing and projected trips per day. 2. Destinations of existing and future trips. 3. Identification of specific haul routes and the percentage distribution of trips. Trip information should be substantiated by company records. R 68 W) and have no objections to the proposed operation. However, we would like to make the following com- ments. 1. Inasmuch as there will be considerable turning movements from and onto State Highway 52 by large gravel trucks, we would request that provisions be provided and funded by the developers for the con- struction of accel and decel lance along State Highway 52 at the proposed approach onto State Highway 25. This we feel should be done as a safety feature and reinforcement of the traveling lanes and shoulders of the present highway. 2. The present right of way width along State Highway 52 is approximately 120'. Our 20-year traffic projection for this section of State High- way 52 indicates a need for a minimum of 150' (75' from centerline) of right of way for construction of a four lane highway. We would request that if possible the additional right of way (approximately 15') be made either by reservation, set-back, or dedication. In an on-site review of the proposed plan made earlier with Carol Lee and representatives of the Turnpike Construction Company, it was brought out that there was sone concern by the owners of the hods fronting onto State Highway 52 of the possibility of flood- ing by backwaters with the construction of the proposed haul road. A review of the contour lines and 100-year flood boundary line would indicate hardly any possibility of flooding of the homas due to construction of the haul road; however, in view of the concerns of the homeowners and to minimize land damage due to flooding, it would seem that the haul road should be constructed as near to present ground level as possible, particularly in the vicinity of the center of Section 31. 4. Insofar as possible, the present stream elevation should be maintained to prevent degradation of the stream channel or abut- ment to eliminate possible exposure of pier footers of structures upstream of the gravel pits. Floodplain Information Available for Review A. "Flood Insurance Study, Weld County, Colorado, Unincorporated Areas and Town of Eaton, Colorado" prepared in December, 1979 by Gingery Associates, Inc. , under FEM1 -FIA contract. This study was designated by the Colorado Water Conservation Board on March 17, 1980 (#156) and thus is available to local governments for regulation purposes. B. "Floodplain Information, St. Vrain Creek, Boulder Creek and Idaho Creek, Weld County, Colorado". This study is presently in progress by the U.S. Army Corps of Engineers, Omaha District, and will provide detailed information in this area when completed. C. "Map of Floodprone Areas, Erie, Colorado 7.5 Minute Quadrangle" prepared by the U.S.G.S. for HUD-FIA in 1974. These maps are approximate studies and have never received any formal designation; however, they are very useful in identifying approximated flood hazard areas. The Flood Insurance Study contains the presently designated flood hazard information for the area, which is different from the information contained on the original permit. The information on the original permit appears to have been taken from the floodprone area map (reference IIC) . B. The Flood Insurance Study identifies the entire area as a "Zone Ti", which means it is an area within an approximate 100-year floodplain, but for which no base flood elevations or flood hazard factors have been determined. This also means that the flood outline could change upon completion of the detailed study by the Corps. C. Standard A9 should remain the same unless the applicant can show that the proposed amendment and change in operation will not increase the flood hazard to others. D. The Amendment to Standard Al0 is acceptable only if the road is not elevated and the creek crossing is not improved unless such improvement is capable of handling 100 year discharges without increasing the flood hazard to others. Recommendations: The amendments to Standards A9 and A10 should not be granted unless through consultation with the Army Corps of Engineers it can be shown that the proposed changes will not significantly increase the flood hazard to others.
