HomeMy WebLinkAbout810478.tiff RESOLUTION RE: APPROVAL OF LOT SIZE VARIANCE NO. 127 : 81: 5 - EDMOND MOREHOUSE WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners has determined, at a public meeting held on the 13th day of May, 1981 in the Chambers of the Board of County Commissioners of Weld County, Colorado, that a certain tract of land is owned by Edmond More- house, which land is more particularly described as follows: Part of the Northwest Quarter of Section 17 , Township 3 North, Range 68 West of the 6th P.M. , Weld County, Colorado WHEREAS, the owner of said tract of land desires to obtain a variance from the minimum lot size requirement so that he may apply to the Board of County Commissioners for a recorded exemp- tion, as set forth in Section 9-4 .A. ( 6) of the Subdivision Regulations, and WHEREAS, the Board of County Commissioners of Weld County, Colorado feels that the applicant has shown good cause for granting a lot size variance under Section 9-4 .A. (6) of the Weld County Subdivision Regulations. NOW, THEREFORE, BE IT RESOLVED by the Board of County Com- missioners of Weld County, Colorado that a variance from lot size requirements be, and hereby is, granted to Edmond Morehouse for the above described parcel of land. COLORADO May 12, 1981 Board of County Commissioners Weld County, Colorado 915 10th Street Greeley, Colorado 80631 RE: Lot Size Variance #127:81:5 The attached letter and related materials are in reference to a request for a lot size variance from Edmond Morehouse. The property on which this request has been made is described as part of the NEq of Section 17, T3N, R68W of the 6th p.m. , Weld County, Colorado. This property is located 3/4 miles west of Mead. The property under consideration contains approximately 55 acres of irrigated agricultural land. The request is to obtain a variance from the minimum lot size requirement, Section 9-4.A. (6) of the Weld County Subdivison Regulations, so that the applicant may make application for a recorded exemption. Based upon the information submitted and the adopted policies in the County, the Department of Planning Services Staff recommends the request be approved for the following reasons: 1. The request conforms to the intent clause of the Recorded Exemption Procedure (Section 9-2 of the Weld County Subdivision Regulation) , the intent clause of the Agricultural Zone District (Section 3.3.A. of the Weld County Zoning Resolution) , and the Weld County Comprehensive Plan in that the uses will be compatible with the surrounding agricultural uses. The request will allow agricultural and related uses to be the predominant land uses. There will be no reduction in the amount of land currently being used for agricultural production. 2. The Town of Mead has no objections. 3. This request complies with the provisions of Section 9-4 A. of the Weld County Subdivision Regulations. The Department of Planning Services Staff is concerned with the number of small lots in Section 17. There are nine lots of ten acres or less in Section 17 and eight of these lots are in the Northeast quarter of Board of County Commissioners May 12, 1981 Page 2 the Section. One irrigation ditch boarders the property on the south and one irrigation ditch boarders the property on the east. The Mead raw- water and treated water storage facilities are located across the road to the north of the property. ',/e bought our 5.5 acre far:' about nine years ago and took possession at the end of the year. The first time my wife and 1 seen the inside of the house, there was a young couple living in it. As wv walked in and through the kitchen into the livin'z room the man pointed to one section of the floor and wall and said it was unsafe, that the floor might go in. The house was Lathe and plaster and one night some sections of the ceiling; fell. The condition of the whole house was about the same way. The person we bought the farm from never had any insurance on any of the buildings believ.in they were not worth the money. After we got possession l replaced needed s _11 timbers , replaced needed floor ,joits , put new flooring down, removed. the Lathe and plaster and replaced with sheetrock, put new modern windows in , removed the old s{din.. and shinles and put new on. Also replaced the kitchen cupboards and :;l :`,.. Outside i cleaned up around the buildings , tore down some bui idinas and built .a new 2t '' 30 garage-workshop. "y wife and T did all the work ourselves , not hiring anyone else to do the work. The farm ground in the spring was badly covered with thistle and over a good e-e- er of years using 2- -D - a trazine and corn two years be- fore rotating, we Aot rid of most of the thistle. The man we bought the fa-m from lived in 3outder and he put on turkey manure, which is good fertilizer , only every load there was a =.00d 1/9 of rock. Some rock as large as `? inches also pieces of cement. I have picked up `?'a": as of this spr{rig but T don' t remember or even tried to count how many pick-up loads pi•^_'red up ever the last n ine years . I have been told. by people that far'e_d the ?rout; years a o that there 'gas not a rock on the 21 ac . c The farm ground has a slope away from the head gate and right down the center of the farm. ;.fie had a very fast trri ;ation ditch that was 3 to 3 deep. You could not trust a dam to stay no matter how well you put it in and it would erode every year . '+ie put in 700 feet of cement ditch to end the problem. The farm today is very clean and a good producer . It will match any ground in 'Jeld County acre for acre. I 'm asking for a 125' by 200' piece of ground to build a house on because t , helieve we have earned it. %.le are not trying to bust up the farm or even asking to build on a more desirable place on the farm.
