HomeMy WebLinkAbout820638.tiff RESOLUTION RE: APPROVAL OF RECORDED EXEMPTION NO. 558 - GARY AND SUSAN ALLES WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, it has been determined by the Board of County Com- missioners at a public meeting held in the Chambers of the Board, that the division into two parcels of land, as shown on the plat known as Recorded Exemption No. 558 , being the property of Gary and Susan Alles, described as part of the NE4 SEa, Section 22 , T5N, R65W of the 6th P.M. , Weld County, Colorado, being more particularly described in the plat which shall be provided by the applicants and known as Exhibit "A" , does not come within the purview of the definition of the terms , "subdivision" and "sub- divided land" , pursuant to its authority under Section 30-28-101 (10) (d) , CRS 1973, as amended, said plat to be recorded. NOW, THEREFORE, BE IT RESOLVED by the Board of County Com- missioners of Weld County, Colorado that the hereinabove described parcel of land owned by Gary and Susan Alles be, and hereby is , exempt from the definition of the terms, "subdivision" and "sub- divided land" . BE IT FURTHER RESOLVED by the Board that this approval is conditional, upon the recommendation of the Department of Planning Services, that prior to the house on the one acre parcel being in- habited, evidence of an adequate sewage disposal system should be submitted to the Department of Planning Services. The parcel of land on which this request is being made is described as part of the NE1 SE4, Section 22, T5N, R65W of the 6th P.M. , Weld County, Colorado. The property is located two miles east of Greeley on Weld County Road 45 and 541 . The property contains approximately forty (40) acres of Class II and VI irrigated soils. The request is to divide the property into parcels of thirty-nine (39) acres and one (1) acre, more or less. The applicant wishes to sell off the one (1) acre tract which has the existing residential improvements. Based upon the submitted information and policies of the County, the Department of Planning Services staff recommends the request be approved for the following reasons: 1. The request complies with Section 9-2 C. of the Weld County Subdivision Regulations submission requirements. 2. The request complies with Section 9-2 E. of the Subdivision Regulations as follows: The forty (40) acres, more or less, under consideration will allow agricultural and related uses to be the pre- dominant uses. The uses will be compatible with existing surrounding agricultural uses. These facts support the proposal as being consistent with the intent clause of the Agricultural Zone District. 820638 Board of County Commissioners June 16, 1982 Page 2 - The proposal was reviewed by the city of Greeley Planning Commission and was found to comply with the long-range Comprehensive Plan. It also is in compliance with Section 1-3 of the Weld County Subdivision Regulations and the proposed land division complies with the Weld County Comrehen- sive Plan. Therefore, the proposed use is not inconsistent with efficient and orderly development. - Both proposed parcels will be adequately served by Weld County Road 45. - A letter dated June 2, 1982, from the Division of Water Resources indicates that both proposed lots will have an adequate water source. - A letter dated June 2, 1982, from the Weld County Health Department indicates that both proposed parcels will have an adequate sewage disposal system. - The proposal does not exist in a overlay district area. - The proposed lots are not part of a recorded exemption within the last five years. - The proposed lots meet the minimum size requirements for land division. The Department of Planning Services staff recommendation for approval is conditional based upon the following: 1. Prior to the house on the one (1) acre parcel being inhabited evidence of an adequate sewage disposal system should be submitted to the Department of Planning Services. (2) The one acre tract is Improved with an old brick house. The entire site is considerably higher in elevation than the surrounding farm land, this would make it very difficult to incorporate it with the adjoining field. (3) The approval of this request is consistent with the comprehensive -?an in that it will not cause an increase in the number of homes in the area, as the owners of the property do not contemplate any constru- ction on the remaining acreage, as there farming headquarters are loca- ted approximately one mile east of this site. (4) This exemption request is consistent with the intent of the district as it will not change the agricultural character of the area, and rather will enhance the area as it is not only advantagious to have attractive and well maintained farms, but also neeIssary to have a sound financial operation. (5) Use of the tract would be the same as any other agricultural residence. (6) Existing zone is agriculture, this is in compliance. (7) This proposal will not change the character of the neighborhood, and certainly will not interfere with the orderly development of the area should this occur in future years. (3) Proposed site is not in an overlay district. (9) Copy of deed is attached. (10) Site has domestic well, and Central Weld water is available with a pipeline in the county road # 45, there are entrances to the property from county road 45 at the present time. (11 ) The final consideration is the fact that at present time this parcel is unproductive, if sold it will increase the financial stability of the owners, and in turn the well being of the county. The Planning Commission recommended no objection to this request with the special reservation of the GO' access to 18th Street to serve both Lot "A" and Lot "B" of the recorded exemption. The Greeley Planning Commission also reviewed the Weld County Referral for a Recorded Exemption (Case No. RE 558) for the NE* SE* Section 22, T5N, R65W at the June 8 meeting.
