RE: APPROVE AMENDMENT TO RECORDED EXEMPTION NO. 659 - MELVIN
AND OLA FAE BRUG
WHEREAS , the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, on December 28 , 1983, the Board did, by Resolution,
approve Recorded Exemption No. 659 , and
WHEREAS, Melvin and Ola Fae Brug are requesting an amend-
ment to said Recorded Exemption No. 659 , and
WHEREAS, said amendment would change the size of the created
parcels from 20 . 26 acres and 19 . 7 acres, more or less, to 20 . 01
acres and 10 acres, more or less, with the west one-half of Lot B,
RE 659 being added to the NW4 SE4, Section 29 , Township 5 North,
Range 67 West of the 6th P.M. , Weld County, Colorado, and
WHEREAS, the parcel of land for which this request is being
made is described as the NE4 SE4, Section 29, Township 5 North,
Range 64 West of the 6th P.M. , Weld County, Colorado, being more
particularly described in the plat which shall be provided by the
applicants and known as Exhibit "A" , said plat to be recorded, and
WHEREAS, the Board deems it appropriate to approve the amend-
ment to Recorded Exemption No. 659 for Melvin and Ola Fae Brug
on the above described parcel.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado that the above mentioned
amendment to Recorded Exemption No. 659 requested by Melvin and
Ola Fae Brug on the hereinabove described parcel of land be, and
hereby is, approved, subject to the following conditions: 1) the
applicant shall submit a mylar plat to the Department of Planning
Services to be recorded in the office of the Weld County Clerk
and Recorder. The plat shall be drawn in accordance with the re-
quirements of Section 9-2C. (4) of the Weld County Subdivision
Regulations. The plat shall be submitted within ninety days from
the date of approval by the Board of County Commissioners; and

2) the mylar plat shall show a forty (40) foot wide access and
utilities easement as shown in the submittal application materials .
Evidence of the easement document shall be submitted to the De-
partment of Planning Services .
The above and foregoing Resolution was, on motion duly made
and seconded, adopted by the following vote on the 28th day of
March, A.D. , 1984 .

Re: Recorded Exemption #Amended RE659
Dear Commissioners:
The attached application, plat and related items are in reference to a request
from Melvin and Ola Fae Brug for a recorded exemption. The parcel of land on
which this request is being made is described as NE1, SE', Section 29, T5N,
R64W of the 6th P.M. , Weld County, Colorado.
The property is located 1 miles south of Kersey on Weld County Road 53. The
property contains approximately 40 acres of Class IVe, VIe irrigated and VIe
nonirrigated soils. The parcel of land under consideration is not the total
contiguous land holdings of the applicant.
This request is being done in conjunction with a Subdivision Exemption. Mr.
and Mrs. Brug would like to amend RE659 so that the newly created parcels are
20.01 and 10 acres in size. Both properties would continue to be used as
rural residential. The west one-half of Lot B RE659 would be added to the
SEA, Section 29, T5N, R67W, increasing the size of that parcel from 39.96
acres to 49.91 acres, more or less.
Based upon the submitted information and policies of the County, the
Department of Planning Services staff recommends the request be approved for
the following reasons:
1. The request complies with Section 9-2C. of the Weld County
Subdivision Regulations submission requirements; and
2. The request complies with Section 9-2E. of the Subdivision
Regulations as follows:
The 40 acres, more or less, under consideration will
be compatible with existing surrounding land uses and with
future development of the surrounding area as permitted by
the existing agricultural zoning. The proposal is also
consistent with the intent of the Agricultural zone
district in which it is located.

- The proposal was reviewed by the city of Kersey and was found
to comply with their long-range Comprehensive Plan.
- The proposal is in compliance with Section 1-3 of the Weld
County Subdivision Regulations and the proposed land
division complies with the Weld County Comprehensive Plan.
Therefore, the proposed use is consistent with efficient
and orderly development.
- The proposal does not exist in an overlay district area.
- The proposed lots meet minimum lot size requirements for
land division.
- Central Weld has indicated adequate water service is
available for this proposal.
- The proposed lots are not part of a recorded exemption
within the last five (5) years.
- The two lots proposed will have adequate access from Weld
County Road 53.
The Department of Planning Services staff recommendation for approval is
conditional upon the following:
1. The applicant shall submit a mylar plat to the Department of Planning
Services to be recorded in the office of the Weld County Clerk and
Recorder. The plat shall be drawn in accordance with the requirements of
Section 9-2C. (4) of the Weld County Subdivision Regulations. The plat
shall be submitted within ninety (90) days from the date of approval by
the Board of County Commissioners.
2. The mylar plat shall show a forty (40) foot wide access and utilities
easement as shown in the submittal application materials. Evidence of
the easement document shall be submitted to the Department of Planning
Services.

COMMENTS:
Access to the subject site is from Weld County Road 53, a paved road. There is one
s t of improvements (a single family residence) on Lot "A" of RE-659. The site slopes
to the east and is currently in use as _pasture land. The subject site is situated on
sandy soils. Poor range management could cause "blowout" of the soils. Access to
the proposed fifty (50) acre parcel to the west of existing Lot "B" is proposed to be
via a forty (40) foot wide access and utilities easement as shown on the submitted
maps.
