RE: APPROVAL OF USE BY SPECIAL REVIEW FOR AN OIL FIELD SERVICE
BUSINESS - MARTIN EXPLORATION MANAGEMENT COMPANY
WHEREAS , the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners held a public
hearing on the 6th day of October, 1982, at the hour of 2 : 00
o' clock p.m. in the Chambers of the Board for the purpose of
hearing the application of Martin Exploration Management Company,
c/o Bill McCoy, 1919 14th Street, Suite 400, Boulder, Colorado
80302, for a Use by Special Review for an oil field service
business, on the following described real estate, to-wit:
Part of the NW4 of Section 5, Township 1 North,
Range 67 West of the 6th P.M. , Weld County,
Colorado
WHEREAS, Section 24. 4. 2 of the Weld County Zoning Ordinance
provides standards for review of said Use by Special Review, and
WHEREAS , the Board of County Commissioners heard all of
the testimony and statements of those present, has studied the
request of the applicant and the recommendations of the Weld
County Planning Commission and all of the exhibits and evidence
presented in this matter, and having been fully informed, finds
that:
1. The submitted materials are in compliance with applica-
tion requirements of Section 24.7 of the Weld County
Zoning Ordinance.
2. It is the opinion of the Board of County Commissioners
that the applicant has shown compliance with Section
24_4. 2 of the Weld County Zoning Ordinance as follows :
a. The proposal is consistent with the Comprehensive
Plan policies in that the use does not infringe on
continued agricultural use in the vicinity or County.
The proposal does not appear to have any adverse im-
pacts on the agricultural interests of the County
or the environment.
b. The proposal is consistent with the intent of the
Agricultural Zone District; and is provided for as
a Use by Special Review.

c. The Town of Dacono had no objections to this pro-
posal in the beginning, but subsequently, on October
4, 1982, a letter was received from the Town of
Dacono recommending denial of the Use by Special
Review permit.
d. The Tri-Area Planning Commission has no objections
to this site.
e. It is the opinion of the Board of County Commissioners
Development Standards will minimize impacts on sur-
rounding uses and the area to the greatest extent
possible and provide adequate protection of the health,
safety and welfare of the inhabitants of the area
and the County.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado that the application far a
Use by Special Review for an oil field service business on the
hereinabove described parcel of land be, and hereby is , granted
subject to the following conditions :
1. The attached Standards for Use by Special Review be
adopted.
2. The plat for the use permit be placed of record by the
Department of Planning Services staff prior to any build-
ing permits being issued on the site.
The above and foregoing Resolution was, on motion duly made
and seconded, adopted by the following vote on the 6th day of
October, A. D. , 1982.

DEVELOPMENT STANDARDS
1. The permitted use on the hereon described parcel of land shall be an oil
field service business for the storage of completion rigs , tubing, rods ,
valves, fittings, small equipment and equipment trailers.
2. The major facilities shall be one office, and four buildings for storage as
described in the submitted application materials.
3. All accesses shall have the approval of the Weld County Engineering Depart-
ment. All accesses shall be constructed in accordance with the recommenda-
tions and/or requirements of the Weld County Engineering Department.
4. Recommendations of the subsurface investigation completed by Mr. Gaz and
submitted with the application materials shall be followed for construction
on the site.
5. The appearance of the facility shall be maintained in a neat and orderly
condition through periodic painting and maintenance.
6. A wooden fence, a minimum of six feet in height, shall be constructed on the
west, and south sides in order to visually screen the proposal from existing
surrounding land uses. The fence shall be kept free of all debris and
constructed within 90 days. The fence shall be located as shown on the
plat. Russian Olives shall be planted within ninty (90) days to visually
screen the proposal on the north side of the property.
7. A dust abatement program shall be developed and implemented on Weld County
Road 15 from Weld County Road 12 to Highway 52.
8. The Special Use Permit area shall be maintained in such a manner so as to
prevent soil erosion, fugitive dust, and the growth of noxious weeds.
9. All phases of the operation shall comply with all County and State Health
Standards and Regulations pertaining to air quality, water quality, noise
emission, and sanitary disposal systems.
10. Safety and fire protection will be prescribed by the Frederick Fire Protection
District.
11. The Special Use Permit shall be limited to the plans shown hereon and
governed by the Development Standards stated above and all applicable Weld
County Regulations. Any material deviations from the plans and/or Develop-
ment Standards , as shown or stated above, shall require the approval of an
amendment of the Special Use Permit by the Planning Commission and the Board
of County Commissioners before such changes from the plans and/or Development
Standards shall be permiteed. Any other changes from the plans and/or
Development Standards shall be filed in the office of the Department of
Planning Services.
12. The property owner and/or operator of this operation shall be responsible
for complying with all of the above stated Development Standards. Non-
compliance with any of the above stated Development Standards may be reason
for revocation of the Special Use Permit by the Board of County Commissioners.

The following business was transacted:
I hereby certify that pursuant to a notice dated September 20, 1982,
duly published September 23, 1982 in the LaSalle Leader, a public hearing was
held on the request of Martin Exploration Management Company for a Use by Special
Review for an oil feild service business. The Planning Commission recommended
that the request be granted. The motion by the Planning Commission received
a tie vote. The Town of Dacono recommended that the request be denied.
Steven McGlaughlin was present representing Martin Exploration Management
Company. Mr. McGlaughlin reviewed their request and each of the development
standards. In summary, Mr. McGlaughlin stated that they will not increase the
number of employees at this site, the site will not be used at night except during
emergencies they will post 35 mile per hour speed limit signs, and they fully
intend to comply with the development standards. Mr. McGlaughlin stated that
there will not be any fabrication occurring at this site. The Mayor for the
City of Dacono, Everitt Connors, stated that the city does not at the present
time have the dollars to participate in thier share of the raving of the road
in question. The City of Dacono recommended that the request be denied.
Larry Swin, owner of the first lot along the road to the north of the site,
stated that the site is unsightly, the compressor runs 24 hours per day, and
he would like more than a chain link fence installed along the north side.
Mrs. Hall presented numerous petitions in opposition to the request. All the
petitions were from residents within 500 feet of the proposed site. Mr. Dustin
complained about the noise and dust problems. Mr. McGlaughlin stated that they
are in compliance with the state and county noise standards. Lois Kidd questioned
how they could know that they are in compliance when they do not have the meters
to measure the noise levels. She questioned why Martin Exploration Management
Company does not improve their industrial site in the City of Dacono. She
commented on the weed control and asked that the soil not be sterilized because
the sterilization can travel underground for over two blocks. She suggested that
moving the weeds must be done more than once yearly. She contended that their
property values are decreasing because of the Martin Exploration Management
Company's operation. Mr. McGlaughlin stated that it would be impossible to
move this operation to their industrial site in the City of Dacono. He added
that they have other plans for that property. Charlie Chism complained about
the additional dust if this request is granted. The accesses to the site were
discussed. A council woman from the City of Dacono stated that the employees
of Martin Exploration Management Company do not travel 15 miles per hour to this
site. Therefore, the dust is a real problem and a health hazard. She asked that
this request be denied. Edward Dustin pleaded that the applicant use their
industrial site for this operation in the City of Dacono. Betty Hall, a resident
within 500 feet, stated that she is very much opposed to this request. Iva
Runner, Dacono Planning Commission President, stated that she would like to agree
with Martin Exploration Management Company, however, she must agree with the
citizens and oppose this request. The location of other oil wells in the area
owned by Martin Exploration Management Company was discussed. Mr. McGlaughlin
stated that they will drive around the city in order to service their wells
south of the City of Dacono. Larry Swin stated that the mobile home court,
Glens of Dacono, runs down to the Stanley Ditch just as the Martin property does
across the road. Commissioner C. Carlson stated that the concerns in the area
were there before Martin was, he continued by discussing the status of the road
and the traffic in the area. He was of the opinion that Martin will take care of
their property and he does not think that Martin is above the noise level, therefore,
he made a motion to approve this Use by Special Review for an oil field service
business, and included the development standards. Commissioner N. Carlson seconded
the motion. Commissioner Steinmark did not think that storage of materials on this
site will cause much more of a problem than is already there and it is not an
offensive use in the area. Edward Dustin questioned what good it did to present
petitions in opposition and, further, why bother to come to the hearing if the residents
are not heard. Commissioner Steinmark said that the fence around three sides should
help to control the dust problem. Commissioner N. Carlson called for the question.

- The town of Dacono has no objections to this proposal.

- It is the opinion of the Planning Commission Development Standards will

These determinations are based, in part, upon a review of the information submitted
by the applicant, other relevant information regarding the request, and the
responses of the referral entities which have reviewed this request.
The Planning Commission recommendation is conditional and based upon the follow-
ing:
1. The attached Standards for Use by special Review be adopted;
2. The plat for the use permit be placed of record by the Department of
Planning Services staff prior to any building permits being issued on
the site.

REASONS FOR VOTING:
Fred Otis - yes because the wells are already there. There is nothing we can do about
the wells and those seem to be the real problem from the testimony we have heard. The
things Mr. McCoy is asking to do are not going to be that bad. The surrounding property
owners will have the Development Standards to go along with the use. While the Planning
Commission cannot guarantee that these will be abided by, they will have a place to
complain, and something fairly rigid to complain about, when the Development Standards
are violated. When these are violated the property owners can call the County, the
Health Department or the places where it is proper to complain. We have to surmise
the Development Standards will be complied with and if they are not complied with you
have a place to complain. You have no place to complain at this point other than what
may be in violation of state law.
Jerry Kiefer - no because he is not sure this is the proper place for the storage part
of this activity and therefore, he is voting no. A tie vote basically constitutes a
denial and the County Commissioners should know our vote and our reasons for voting
in this manner.
Jack Holman - No because it is just across the road from a residential area and he
realizes the noise and activity that go on, not just with the wells themselves, but
with the storage activity and because of all the different hours that it is necessary
to make noise.
Norm Peterson - No because he has mixed emotions regarding agricultural, cities, and
the whole scope that we deal with. He did not hear any alternate proposals by Mr.
McCoy and his company. He feels Dacono was there long before the activity that is
going on there now. He appreciates the oil wells there, but he cannot justify the
storage area at this particular time. He felt there should have been some alternatives
for the Planning Commission to look at. He realizes there is a world of thievery and
there was no mention of any study that could help this company by having their storage
yard in this area.

DEVELOPMENT STANDARDS
1. The permitted use on the hereon described parcel of land shall be an oil
field service business for the storage of completion rigs, tubing, rods,
valves, fittings, small equipment and equipment trailers.
2. The major facilities shall be one office, and four buildings for storage as
described in the submitted application materials.
3. All accesses shall have the approval of the Weld County Engineering Depart-
ment. All accesses shall be constructed in accordance with the recommenda-
tions and/or requirements of the Weld County Engineering Department.
4. Recommendations of the subsurface investigation completed by Mr. Gaz and
submitted with the application materials shall be followed for construction
on the site.
5. The appearance of the facility shall be maintained in a neat and orderly
condition through periodic painting and maintenance.
6. A wooden fence, a minimum of six feet in height, shall be constructed on the
west, and south sides in order to visually screen the proposal from existing
surrounding land uses. The fence shall be kept free of all debris and
constructed within 90 days. The fence shall be located as shown on the
plat. Russian Olives shall be planted within ninty (90) days to visually
screen the proposal on the north side of the property.
7. A dust abatement program shall be developed and implemented on Weld County
Road 15 from Weld County Road 12 to Highway 52.
8. The Special Use Permit area shall be maintained in such a manner so as to
prevent soil erosion, fugitive dust, and the growth of noxious weeds.
9. All phases of the operation shall comply with all County and State Health
Standards and Regulations pertaining to air quality, water quality, noise
emission, and sanitary disposal systems.
10. Safety and fire protection will be prescribed by the Frederick Fire Protection
District.
11. The Special Use Permit shall be limited to the plans shown hereon and
governed by the Development Standards stated above and all applicable Weld
County Regulations. Any material deviations from the plans and/or Develop-
ment Standards, as shown or stated above, shall require the approval of an
amendment of the Special Use Permit by the Planning Commission and the Board
of County Commissioners before such changes from the plans and/or Development
Standards shall be permiteed. Any other changes from the plans and/or
Development Standards shall be filed in the office of the Department of
Planning Services.
12. The property owner and/or operator of this operation shall be responsible
for complying with all of the above stated Development Standards. Non-
compliance with any of the above stated Development Standards may be reason
for revocation of the Special Use Permit by the Board of County Commissioners.

As part of our Use By Special Reveiw Application, we would like
to explain why we feel the special use we are seeking will com-
ply with the standards of the Weld County Zoning Ordinance.
Presently the parcel that we are requesting a special use for
is surrounded on three sides by agricultural use and by Weld
County Road #15 . Because this parcel is relatively small, we
feel a productive agricultural land will be conserved. We
have used the tract in question for the last year as a site
for our mobile home office with little or no impact on surround-
ing agricultural uses .
We also believe our requested use will be compatible with Weld
County ' s Comprehensive Plan. The plan encourages urban develop-
ment near towns with an emphasis on business and commercial uses
for future development. Our tract is located next to the town
of Dacono so that future development in and near the town would
more than likely be compatible with our proposed use.
Although our proposal is located within an Overlay District
Area, we feel that by following the recommendations found in
the Geologic Report (submitted as part of application) , the re-
quirements of Section 50 of the County Zoning Ordinances will
be met. In addition, Martin Exploration will ensure adequate
provision is made for the protection of the health and safety
of the inhabitants of the neighborhood and county.

RE: Martin Exploration Management Corporation Request for
Oil Field Service Business Special Use Permit.
Dear Commissioner:
Martin Exploration Management Corporation is seeking a Special
Use Permit to develop an Oil Field Service Business on a ten
acre tract of land located in Section 6 , Township 1 North,
Range 67 West. (Please see accompanying plat) .
In the winter of 1979-1980 Martin Exploration drilled four oil/
gas wells on the north five acres of the ten acre tract. Since
that time we have been producing these wells under a Use by
Right permitted by the State and County.
On August 26 , 1981 the Board of County Commissioners of Weld
County approved a request by Martin to locate a mobile home as
an accessory office and storage facility on the tract. This
mobile office was used until April 12 , 1982. At that time Martin
made application to Weld County for permit to place a new modu-
lar facility. The application was approved in May, and the
move was made to the new facility.
Recently, Weld County approved a Special Use Catagory which
would allow an oil field service business to be conducted on
our tract by a Special Use Permit. Martin Exploration made
application this summer under this new Special Use Catagory.
Development standards were prepared by Weld County Planning
Services, and a hearing was held before the Weld County Planning
Commission. The Commission has recommended that our proposal be
approved by the Board of Weld County Commissioners . The recom-
mendation was made contingent on a showing by Martin that it
will meet the development standards.

DEVELOPMENT STANDARDS
1. The permitted use on the hereon described parcel of land shall be
an oil field service business for the storage of completion rigs,
tubing, rods , valves, fittings , small equipment and equipment
trailers .
Martin ' s Proposal : Martin plans to utilize the oil field service
business for storing tubing, rods , valves , fittings , small equip-
ment and equipment trailors including collapsed completion rigs .
These rigs when stored will be kept to the east half of the tract.
2 . The major facilities shall be one office , and four buildings for
storage as described in the submitted application materials .
Martin' s Proposal : The major facilities on the tract will be one
office which was previously permitted by Weld County, and one
building for storage. The location of these facilities are
shown on the submitted plat.
3 . All accesses shall have the approval of the Weld County Engineering
Department. All accesses shall be constructed in accordance with
the recommendations and/or requirements of the Weld County
Engineering Department.
Martin's Proposal : There will be no additional accesses required
for our proposal. All vehicles will enter through the existing
access . (See Plat)
4 . Recommendations of the subsurface investigation completed by Mr.
Gaz and submitted with the application materials shall be followed
for construction on the site.
Martin ' s Proposal: The recommendations in the subsurface investi-
gation completed by Mr. Gaz were followed by Martin during the
placement of the modular office building. (Exhibit A)
5 . The appearance of the facility shall be maintained in a neat and
orderly condition through periodic painting and maintenance.
Martin' s Proposal : Martin shall maintain the facility in a neat
and orderly manner by providing periodic painting and maintenance.
6. A wooden fence, a minimum of six feet in height, shall be con-
structed on the west and south sides in order to visually screen
the proposal from existing surrounding land uses . The fence
shall be kept free of all debris and constructed within 90 days .
The fence shall be located as shown on the plat. Russian Olives
shall be planted within ninty (90) days to visually screen the
proposal on the north side of the property.
Martin' s Proposal : Martin proposes to construct within 90 days ,
a wooden fence a minimum of six feet in height on the north and
south sides of our existing yard. A wooden fence on the west
side is already in existance. The fence will be kept free of
all debris , and will visually screen the proposal from existing
surrounding land uses . (See Plat)
7 . A dust abatement program shall be developed and implemented on
Weld County Road 15 from Weld County Road 12 to Highway 52.
Martin' s Proposal : At n Feting with the Weld County Planning Office and
representatives of the town of Dacono, it was agreed by all parties that the
dust abatement program would be implemented in two stages. Initially Martin
will agreed to adhere to a program designed by the Weld County Planning Office
and Engineering Department. This program would involve using an oil application
on the road. It was further agreed that if financing can be arranged by Dacono
and Weld County, Martin will share in the cost of paving the road. Martin
wishes to make clear that its responsibilities under the program cover County
Road #15 from County Road #52 South, to Martin's existing access.
8 . The Special Use Permit area shall be maintained in such a manner
so as to prevent soil erosion, fugitive dust, and the growth
of noxious weeds.
Martin' s Proposal : Martin Exploration intends to follow the
recommendation of the Colorado State University Cooperative
Extension Service and control the growth of noxious weeds by
periodic mowing. The use of a soil sterilant would bare the
soil and make it vulnerable to dust blowing and water erosion.
Martin will use an annual application of Spike or Banvel to
Control weeds under pipe racks and along the fences . (Exhibit B)
9 . All phases of the operation shall comply with all County and
State Health Standards and Regulations pertaining to air quality,
water quality, noise emission, and sanitary disposal systems.

10 . Safety and fire protection will be prescribed by the Frederick
Fire Protection District.
Martin ' s Proposal : Martin has had our proposal reviewed by the
Frederick Fire Protection District, and it will meet all the
district ' s protection standards. (Exhibit C)
11. The Special Use Permit shall be limited to the plans shown hereon
and governed by the Development Standards stated above and all
applicable Weld County Regulations. Any material deviations from
the plans and/or Development Standards , as shown or stated above,
shall require the approval of an amendment of the Special Use
Permit by the Planning Commission and the Board of County Com-
missioners before such changes from the plans and/or Development
Standards shall be permitted. Any other changes from the plans
and/or Development Standards shall be filed in the office of the
Department of Planning Services .
Martin' s Proposal: Martin' s proposal will be limited to the
plans and Development Standards as shown and stated above.
Martin agrees not to deviate from these plans/development stand-
ards.
12 . The property owner and/or operator of this operation shall be
responsible for complying with all of the above stated Develop-
ment Standards. Noncompliance with any of the above stated
Development Standards may be reason for revocation of the Special
Use Permit by the Board of County Commissioners .
Martin' s Proposal : Martin understands that noncompliance with
any of the Development Standards may be reason for revocation
of the Special Use Permit.
SUMMARY :
The number of employees working out of this yard will remain the
same. The newly proposed activities should only increase activity
and traffic by 5% to 10% . Martin can not justify the development
of a complete new yard in another area at this time. We have
spent considerable sums on the present location, and to move the
location only to accomodate our Special Use request would not be
a sound business decision.
Activities under this permit will be limited to between 7 : 30 A.M.
and 5 : 00 P.M. Monday through Saturday. It is possible that on
rare occassions the yard would be used at night, but only for
a very brief time.
Martin Exploration believes that this proposal will be compatible
with the surrounding neighborhood. In fact, Martin feel conditions
will improve in the area for the following reasons :
The dust abatement program should not only control any
additional dust caused by this proposal , but the program
will probably reduce significantly, the dust problem as
it exists today.
By constructing fences on all sides of the tract, Martin
will visually screen the proposal from anyone using the
road or living directly across from the yard.
The speed limit signs which will be posted along County
Road #15 should help to reduce excessive noise by vehicles
which are presently using the road.
Please be assured that Martin fully intends to comply with all
the practices and procedures discussed above. We have received
approval of our proposal from the Weld County Planning Office
and the Weld County Planning Commission, and we now respectfully
request your final approval.

At the request of Steven Mclaughlin of Martin Exploration
Co. of Boulder, Colorado, a parcel of land located in the SW/4 ,
NW/4, Section 15, T1N, R67W, of the 6th P. M. Weld Co. , Colo.
was examined for its Geological Hazard potential. A Special
Review and Rezoning application of the parcel is required by
Weld County Planning Department as outlined in their procedural
guide.
The parcel is located in a Gelolgical Hazard and known
Mineral Resourse area of the Boulder-Weld Coal Field , Colorado.
The parcel is located in the upthrown (Horst) northeasterly
trending fault block, which had faulted off the abandoned Sterl-
ing Coal Mine to the west. Available mine maps of the Sterling
Mine show that the mining was stopped at a nearly vertical geolog-
ical fault, which offsets the coal seam. Faults in the Boulder-
Weld Coal Field are generally vertical, trending northeasterly,
with a narrow shear zone less than a foot wide. The surface pro-
jection of the northeasterly trending fault goes through near the
northwest corner of the parcel. Field inspection and aerial
photographic interpetation of the area doesn 't exhibit any unusal
surface features.
A mine fire in the Sterling Mine to the west, was one of the
reasons for the abandonment of the mine. Very few pillars had
been removed before the abandonment.

The 25O-35o angle of draw from the edge of the underground
mining, which normally is used to determine the danger zone adja-
cent to the underground workings does not apply in this case.
The geological fault boundary at the easterly edge of the workings,
decrease the angle of draw almost to vertical along the fault
zone, and doesn' t extend very far into the parcel being examined.
Since the geologic hazard maps prepared by Amuedo and Ivey
show the trianglar corner approximately 200 feet on a side as an
area of low geologic hazard and since the vertical fault crossing
near the northwest corner, reduces the angle of draw to almost
zero, the parcel has a very low hazard potential.
Structural precautions against subsidence damage should be
considered before a structure is designed and built. Most struc-
tural precautions take one of the following forms , either alter-
natively or in combination with one another.
1. Strengthening of foundation or super structure by
rigid design.
2. Flexible design, enabling a structure to adapt itself
to deformation transmitted without losing its strength.
3. Reducing the forces transmitted by ground deformation.
This can be accomplished by following
a. Small plan area of building.
b. Controll height of structure, because of
tilt damage.
c. Reducing the bond between the ground and
structure, to allow for horizontal strain
and curvature caused by subsidence troughs.

to choosing utility lines for a ground
movement situation, certain preferences
can be recognized. Basically the aim
should be to provide a utility line which
has the requisite degree of flexibility
either in material properties or in an
arrangement to suit the anticipated ground
movement. Suitable joints should be used
which will accommodate the necessary ang-
ular and telescopic movement.
Mineral resources include the known oil and gas reserves,
which are presently being produced. A mineable coal seam is
located 400 to 500 feet below the surface in a narrow (1500 ' wide)
northeasterly trending horst (upthrown) block. This seam is
uneconomical at the present time, because of deep, narrow width
and high mining start up cost.
Summary and Conclusions
The triangular area (200' on a side) , which is located at the
northwesterly corner of the parcel is designated as low hazard by
Amuedo and Ivey. This area is also bound by a vertical geological
fault, which reduces the hazard, because the mining was on the
west side of the fault.
The effected area is very small and probably doesn' t extend
very far into the parcel, therefore buildings or structures built

in the hazardous area should not be adversely effected by sub-
sidence movements of strain, slope1curvature, tilt, etc. Struc-
tural and utility lines built in or near the hazardous area
should be designed for possible damage due to subsidence forces.

Dear Sir:
At the request of Bill McCoy of your corporation, I was asked
to make an assessment of weed control on your property at 5700 Weld
County Road 15, near Dacona, Colorado. I made a personal inspection
of this property on September 15, 1982, accompanied by Mr. McCoy.
The weed control on this multi-wellhead facility for this year
had been mowing of the property. At this time the weeds are well
controlled as to height of growth. There is an adequate ground
cover of the mowed weeds to prevent wind and water erosion through
the Winter months.
I would recommend the practice of mowing to control the weeds
within the fenced area. To control weeds under pipe racks and for
a three foot strip along the fences, an annual application of Spike
or Banvel would be advisable :to control weeds the mower couldn't
reach. The Spike will control all vegetative growth. The Banvel
may not control some perenial grasses if any are present. These
products should be applied at the recommended rates on the label
before June 1 of each year.
A few perennial noxious weeds, namely Canada Thistle and Field
Bindweed were noticed and they can be controlled with either Spike
or Banvel herbicides.
I hesitate to recommend the use of a soil sterilant on the en-
tire property as it would bare the soil and make it vulnerable to
dust blowing and water erosion.

In regards to your request for a fire safety inspection on your
premises located east of the City of Dacono on Weld County Road
15, Approximately 1/2 mile south of Colo Hiway 52, I submit the
following.
On September 27, 1982, myself and the assistant fire marshal went
to the property and made a walk through inspection. We found
everything to be in very fine condition, well arranged and meeting
all of our requirements.
We would only ask that you obtain one more extinguisher for the
office building and place it at the north entry way in a simular
manner as the one in the south end. A 10 lb ABC or BC would be
satisfactory for this.
I would also recommend two extinguishers in the yard, located
one to the north and one to the south in case of an accidental
ignition in the engine rooms or at one of the units. Each of
these should be 15 lb ABC and could be placed in any accessable
area where you could provide protection for them.
Beyond these requirements your area is very well spaced, and has
negligible fire hazards. We are very comfortable with the type
installation you have here.
If I can be of any further assistance, please feel free to call
us.

REs Application for Use by Special Review for
Martin Exploration.
The Dacono Planning Commission met September 30, 1982,
upon request of the citizens of the area.
After hearing complaints and receiving the enclosed
petition, the Planning Commission recommended to the City
Council, the denial of the Use by Special Review Permit.
The City Council met following the Planning Commission
meeting and listened to the recommendation. One cacern of
both council and commission is why Martin does not put this
operation in the industrial area of the City.
The City Council voted unanimously to accept the recommend-
ation of the Planning Commissidn. We now recommend to the
County Commissioners, that we oppose and request denial of the
Use by Special Review Permit,
