LORENZ WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, a public hearing was held on the 18th day of May, 1983 at 2 : 00 o' clock p.m. for the purpose of hearing the appli- cation of Fred E. and Mary L. Lorenz, 13730 Weld County Road 251, Platteville, Colorado 80651, requesting a Change of Zone from C-1 (Commercial District) to I-1 (Industrial District) for a par- cel of land being more particularly described as follows: A tract of land located in the NEaNWa of Sec. 30, T3N, R66W of the 6th P.M. in the County of Weld, State of Colorado, more particularly described as follows: Commencing at the NaCor of said Sec. 30, and considering the North line of NWq of said Sec. 30 to bear N 89°36 ' 36" W and with all bearings contained herein being relative thereto; Thence N 89°36 ' 36" West, along the North Line of the NWa of said Sec. 30 , a distance of 119 . 80 feet to a point on the west Right-of-Way Line of U. Lorenz WHEREAS, the Board of County Commissioners heard all the testimony and statements of those present, has studied the request of the applicant and the recommendations of the Weld County Planning Commission, and having been fully informed finds as follows: 1. The applicant has complied with Section 21.7 et, seq. of the Weld County Zoning Ordinance application requirements. 2 . The request is in conformance with Section 21.5 .1. 1 of the Weld County Zoning Ordinance as follows: a. It is the opinion of the Board of County Com- missioners that the proposed zone change is consistent with the Weld County Comprehensive Plan, and the proposed district will be com- patible with the existing surrounding land uses and future development; b. U. S. Highway 85 Business Route will provide adequate access to the site; c. The proposed Change of Zone is not located within any overlay district; d. The proposed rezoning would not interfere with extraction of any known commercial mineral deposits; e. Soil conditions do not appear to present construc- tion limitations on the site; f. The existing septic system will provide an adequate means of sewage disposal; g. Well water will serve as the domestic water source. 3. The town of Platteville has recommended approval of this request on March 15, 1983. NOW, THEREFORE, BE IT RESOLVED by the Board of County Com- missioners of Weld County, Colorado that the application of Fred E. and Mary L. Lorenz, for a Change of Zone from C-1 (Commercial District) to I-1 (Industrial District) on the above referenced parcel of land be, and hereby is granted subject to the follow- ing conditions : 1 . That the applicant shall apply for a "Permit for Access" from the Colorado State Highway Department before the issuance of any building permits. 2 . That the applicant shall submit evidence to the Depart- mentof Planning Services ' staff that the existing well on the two (2) acre parcel has been properly registered with the Division of Water Resources and evidence that this well will provide an adequate supply of water for the industrial zoned parcel before the issuance of any building permits. Frank Stewart, representing the applicants, came forward and explained the accesses on the property. He said permits had been obtained from the State Highway Department and registrations to have water supplied. After further discussion and questions by the Board, Commissioner Brantner moved to approve this Change of Zone with the conditions as listed. The Town of Platteville is growing rapidly and changes in the ose of land is becoming the rule of the times. a. The Exeter property adjoining this plot on the North has been rezoned Industrial . Areas of like use and zoning designation tend to expand in _growth areas like the Colorado Front Range. b. U.S. Highway 85 i3usiness Loop adjoining the west boundary provides a very desirable access for movenent to major highways nr to the balance of the farm. c. If this land should become too expensive to continue as the shop area for the farm, it would be logical to have the property zoned for Industrial activities. 2. Farm equipment is expensive and should be stored in an area free from the -effects of the elements to prolong the life of She expensive equipment. 3. Farm equipment has _gotten larger as each farm operator farms larger areas to be an efficient producer. Shops must be larger. The 3,000 square foot limit placed on C-1 is no longer practical , therefore Industrial zoning is requested. 4. Asparagus is being raised nn the property. The number of plants are to be increased as time goes on. This building is expected to be used for packing the Asparagus. The personel involved would need restrooms and a lounge to comply with the law. 5. If the land should be sold at some future date the larger -building would have much greater value to a propective buyer than would the 3,000 square foot building permited under Commercial zoning.
