RE: APPROVAL OF RECORDED EXEMPTION NO. 538 - MERLE B. AND
JUNE M. LEWIS
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, it has been determined by the Board of County
Commissioners at a public meeting held in the Chambers of the
Board, that the division into two parcels of land, as shown
on the plat known as Recorded Exemption No. 538 , being the
property of Merle B. and June M. Lewis, described as part
of the N1 NWa NWa, Section 18, Township 1 North, Range 68
West of the 6th P.M. , Weld County, Colorado, being more
particularly described as follows :
Attached is Exhibit "A" incorporated herein
by reference
does not come within the purview of the definition of the terms,
"subdivision" and "subdivided land" , pursuant to its authority
under Section 30-28-101 (10) (d) , CRS 1973, as amended.
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners that the hereinabove described parcel of land
owned by Merle B. and June M. Lewis be, and hereby is, exempt
from the definition of the terms "subdivision" and "subdivided
land" .
The above and foregoing Resolution was, on motion duly
made and seconded, adopted by the following vote on the 24th
day of February, A.D. , 1982.

1. We would like to divide this five acres so that we can sell
the house and one acre. The house was built in 1971 and has
since been rental property. We are no longer physically able
to cope with the upkeep of this rental troperty.
2. This proposal is consistent with the Weld County Comprehensive
Plan since the subject plat was developed in 1971, prior to
the 1972 regulations.
3. This proposal is consistent with the intent of the district
in which the use is located. because the five acres of ground
will not take any land out of agricultural production. Acreage
is to small that it is not profitable to farm it.
4. The uses will be compatible with the existing surrounding land
uses which are now small land tracts with homes.
5. Use requested will be compatible with future development of
the area. The change has been approved by the Town of Erie
Planning Commission. It is located within one-half mile of
Erie.
6. This use will not be inconsistent with future growth. The
small parcel is not suitable for agricultural purposes.
7. The subject site is not affected by an Overlay District, as
shown by the Geological Hazard Area Map.

Dear Commissioners:
The attached application plat and related items are in reference to a
request from Mr. and Mrs. Lewis for a recorded exemption. The parcel
of land on which this request is being made is described as part of
the NI NW' NWT, Section 18, T1N, R68W of the 6th P.M. , Weld County,
Colorado. This property is located approximately one-fourth mile
northeast of the town of Erie. The property contains approximately
five (5) acres, more or less. The request is to split the property into
parcels of one (1) acre and four (4) acres, more or less. Both parcels
would have existing residences.
The applicant wishes to continue living at the residence on the proposed
four (4) acre parcel and sell the one (1) acre parcel which contains the
existing rental residence. Based upon the submitted information and
policies of the County, the Department of Planning Services staff recom-
mends the request be approved for the following reasons:
1. The request complies with Section 9-2 E of the Weld County
Submission requirements of the Subdivision Regula-
tions;
2. The request is in compliance with the agricultural
policies of the Weld County Comprehensive plan in
that the development does not utilize productive
agricultural land and each proposed parcel has an
existing dwelling.
3. The request complies with Section 9-2 E. of the sub-
division regulations as follows:
- The proposal was reviewed by the town of Erie and
was found to comply with the long-range comprehen-
sive plan. It also is in compliance with Section
1-3 of the Weld County Subdivision Regulations and
the proposed land division complies with the Weld
County Comprehensive Plan; therefore, the proposed
use is not inconsistent with efficient and orderly 8206VO20
developments.

- The proposal does not exist in an Overlay District
Area.
- The proposed lots meet the minimum size requirements
for land division.
- The applicant will provide for proper access to an
existing public road (Weld County Road 1) .
- A letter dated January 29, 1982, from the Left Hand
Water Supply Company indicates the water supply is
adequate.
- A letter from the Weld County Health Department indicates
an adequate means for the disposal of sewage.
- The proposed lots are not part of a recorded exemption
within the last five (5) years.

At the time we built the rental property it was permissible to i•:_gild
on one acre. However, since we owned all of the land (and it didn't
occur to us that it would be advantn. eous) , we sisrly had it surveyed
and obtained the building, permit. .e made ro effort to break the
property off the five acres. I :;uesa we thought it ,4i.s herdled
by building permits, but when we finally received the taxes e dis-
covered all was assessed as one piece of tro'erty.
For economic reasons, we would ;like :;o make the seraretior of this
east acre from the other four acres. I he Planning:: Office in
Greeley has suggested that we. revie'v this with you before other
steps are taken. ..e cannot be at the meeting Thursday nijht and
would appreciate having: your comments on this proposition. This
property is within the Erie Comprehensive Planning area, hence
our concern.
