C..c: 4(,`_, C.J il II I I I • • RESOLUTION RE : AUTHORIZATION ,OR CHT=IRMAN TO S I-CN LEASE BETWEEN WELD COUNTY AND THE UNION PACIFIC RAILROAD WHEREAS , the Road of County Commissioners of Weld County , Colorado , pursuant to Colorado statute and the Weld County Home Rule Charter , is vested with the authority of administering the arnirs of Weld County , Colorado , and WHEREAS , on December 15 , 1980 , the Board of County Commis- sinners of Weld County voted to renew the Union Pacific Railroad lease for a portion of road right-of-way for County Road 33 north of Pierce where it intersects with County Road 90 , and WHEREAS , the term of said lease is for 25 _years and the rental fee is $1 , 165 . 00 for the 25-year term, and WHEREAS , the Board of County Commissioners deems it advisable to authorize the Chairman of the Board to sign said lease . NOW, THEREFORE, BE IT RESOLVED by the Board of County Com- missioners of Weld County , Colorado that the Chairman of the Board be, and hereby is , authorized to sign the lease agreement between Weld County and the Union Pacific Railroad for the leasing of a portion of road right-of-wav as described above . Box 758 \ ` o‘P Greeley, Colorado 80631 • Attention : Ms . Keitha White Dear Sir : Agreement Covering Lease of Right of Way at Pierce , Colorado This refers to agreement C. D. No. 5845-3 , covering lease of right of way for highway purposes at Mile Post 66 . 23 at Pierce , Colorado. Ms . White of your office telephoned Ms . Okelberry of this office concern- ing several clerical errors made in the preparation of the subject agreement. The County had not received its original counterpart of the agreement , but had received an incorrect invoice for the amount of $3 , 495. 00 . Upon review of the subject agreement and cor- respondence file , it was discovered that the rental , as contained in Section 2 of the agreement , had been typed to read "$1,165 . 00 for the term hereof per annum; " rather than the advised rental of "$1 ,165 . 00 for the term hereof . " Ms. White , also, noted that the state of incorporation in the preamble of the agreement was "Utah" instead of "Colorado. " The correspondence file indicated that the fully executed counterpart for the County was mailed to Pierce, Colorado, rather than Greeley, Colorado. Since the agreement was fully executed and filed with our auditor , it is necessary to execute an addendum to correct the rental . I have prepared , and 1 enclose herewith , the addendum , which also she.,as the proper state name ; however , a new resolution will not be needed since the original resolution contained the correct rental amount and term. The County ' s original counterpart has not been returned to this office , therefore , I am enclosing a copy of the Railroad Company ' s original counterpart for your records . After execution of the addendum, please return it to the attention of Ms . 0kelberry, in the enclosed self-addressed envelope . Yours very truly, Valerie W. The Original Agreement is identified in the records of the Lessor as Audit No. A-104380 . IT IS MUTUALLY AGREED by and between the parties to the Original Agreement as follows : Section 1. DECREASE IN RENTAL. Effective as of August 1 , 1978 , the Lessee agrees to pay to the Lessor as rental for the use of the leased premises the sum of one thousand one hundred sixty-five dollars ($1 , 165 . 00) for the term hereof, payable annually in advance, in lieu of the rental heretofore stipulated. Section 2 . AGREEMENT SUPPLEMENTAL.
