RESOLUTION
RE: APPROVAL OF USE BY SPECIAL REVIEW FOR AN ALCOHOL PRODUCTION
FACILITY FOR COLHALAR COMPANY, INC.
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners held a public
hearing on the 28th day of October, 1981, at the hour of 2 : 00
o'clock p.m. in the Chambers of the Board of County Commissioners
for the purpose of hearing the application of Colhalar Company, Inc. ,
c/o Mr. K. R. Colgan, 2024 Clarkson Street, Denver, Colorado
80205, for a Use by Special Review for an alcohol production
facility, on the following described real estate, to-wit:
Part of the Southeast quarter, Section 13,
Township 3 North, Range 66 West of the 6th
P.M. , Weld County, Colorado.
WHEREAS, Section 24. 4. 2 of the Weld County Zoning Ordinance
provides standards for review of said Use by Special Review, and
WHEREAS, the Board of County Commissioners heard all of
the testimony and statements of those present, has studied the
request of the applicant and the recommendations of the Weld
County Planning Commission and all of the exhibits and evidence
presented in this matter, and having been fully informed,
finds that:
1. The submitted materials are in compliance with the
application requirements of Section 24. 7 of the Weld
County Zoning Ordinance.
2. It is the opinion of the Board that the applicant has
shown compliance with Section 24.4 .2 of the Weld
County Zoning Ordinance as follows:
The proposal is consistent with the Comprehensive Plan
in that policies of the plan promote agribusinesses so
long as they do not create negative impacts on the
environment or the County. No such impacts have been
identified with this proposal.
The proposal is consistent with the intent of the
Agricultural Zone District in that the use does not
constitute an interference of agricultural activities;
in fact, it can support crop production activity due
to its need for grain products and creation of feed stuffs
for livestock comsumption.
The use is both compatible with existing agricultural
activity and with land use which is contemplated to be
agriculture in the Comprehensive plan.

- No Overlay Districts affect the site;
- The proposed site is in an area of moderate to low productive soils;
furthermore the site is located to affect the least amount of usable
farm ground; and
- Operation and Design Standards provide adequate protection of the
health safety and welfare of the neighborhood and County.
The following conditions are felt necessary for the proposal.
1. The attached Standards for Use by Special Review be adopted;
2. The plat for the use permit be placed of record by the Department of
Planning Service's staff prior to any building permits being issued on
the site;
3. A soils and foundation investigation should be made prior to building
permit applications to determine any special requirements for foundation
design (see Colorado Geological Survey letter dated August 21, 1981) .
This condition need not apply to permits for placement of the mobile
home; and
4 Scheduling before the Weld County Board of Commissioners shall not
commence until final determination has been made by the Division of
Water Resources, State Engineer's Office regarding ground water supply.

SUMMARY OF THE WELD COUNTY PLANNING COMMISSION MEETING
September 15, 1981
A regular meeting of the Weld County Planning Commission was held on
September 15, 1981 at 1:30 p.m. in the Commissioners' Hearing Room, 915
10th Street, Centennial Building, Greeley, Colorado. The meeting was
called to order by the chairman, Fred Otis.

APPLICANT - Erie Water and Sanitation District
SUBJECT - Wastewater Treatment Plant - Continued from August 18, 1981
LEGAL DESCRIPTION - NW4, Section 6, T1N, R68W of the 6th P.M. , Weld County,
Colorado
LOCATION - 11/2 miles north of Erie
APPEARANCE: Richard Lyons, Attorney for the District, reported the district
wishes a new sewer system for the town. The current sewer
system has received complaints from the State that they are
not in compliance with the state standards. They are either
going to upgrade the present sewer system, or put in a new
sewer system. If upgraded it would only allow for approximately
twenty-five new sewer taps, which the town feels is inadequate.
There has been new growth and development in the town of Erie,
and the old system is no longer adequate. They have not
arranged for funding of any kind at this time, understanding
that a special use permit is the first step to be taken in
the process of putting in a new sewer.
Keith Bell, Engineer for the Erie Water and Sanitation District
appeared before the Planning Commission.

Mr. Bell explained the various locations investigated for
locating this site, the soils composition of each site and
the location of each site. He explained the process of
treatment, purification of liquid effluents and disposal
of waste solids planned for the plant.
Discussion from the members of the Weld County Planning Commission was
directed to Mr. Bell and Mr. Lyons.
Tom Honn, Zoning Administrator read the recommendations of the Department
of Planning Service's staff and the Development Standards. The chairman,
Fred Otis asked Mr. Lyons and Mr. Bell if they were aware of the recommenda-
tions and if they felt they could live with these standards; to which they
replied they had copies of these documents and felt they were reasonable.
Discussion from the Audience:
Bennie Bruntz, Westview Estates expressed the views of himself and other
residents of this subdivision. He felt there were surely other areas a
sewer could be located except right next to a subdivision. The residents
are concerned that:
1. their water table would be lowered because of the dewatering
process;
2. most of the properties have shallow wells for domestic use;
3. who would be responsible for odor control; and
4. who would be responsible for weed control, etc.
While it has been stated a full-time employee would be provided to take
care of the plant, the town of Erie sewer site is a "sad mess" now with
weeds overgrowing the property. If they cannot afford to maintain this
site properly, how can they afford to maintain the new site according to
specifications? Many residents of Westview Subdivision are too low to be
able to hook onto the sewer, therefore, they will not benefit from it.
Also, this subdivision is extremely swampy and there is concern that the
wells will be contaminated, or if it rains the sewer may overflow.
Roelof Elting, a farmer, who lives on County Line Road stated County Line
road was built up three or four feet and, therefore, acts as a dyke to
hold any overflow of water from Coal Creek where it crosses County Line Road
rather than letting it drain into Boulder Creek and run-off as a natural
course of events. Because of this Coal Creek floods the area, including
the Westview Subdivision. If the sewer were to drain into Coal Creek and
flood this area, what would the consequences be?

John Heffner of Westview Estates expressed his concern about the location
of the sewer next to Westview Subdivision. He also wondered why other
areas with a gravel base could not have be used for the sewer site.

Ron Stow, Weld County Health Department reported he had spoken to Mr. Sam
Cooper of the State Health Department, but did not receive a comment.
Therefore, the Weld County Health Department is withholding their recommenda-
tions pending the recommendations of the State Health Department and the
State Board of Health.
Lee Morrison, Assistant County Attorney explained the process this applica-
tion would have to go through and be approved by, following the Weld
County Planning Commission recommendation. Even if the Planning Commission
were to recommend denial, the Statetakes final action on this and could
override their decision.
The Planning Commission inquired about another expert opinion from some
source, perhaps the Weld County Engineering Department, as to whether this
is the best site in regard to soils tests, etc.
Tom Honn, Zoning Administrator stated the Department of Planning Service's
staff does not have expertise in all areas, therefore, they rely on areas
with that expertise to give them an opinion when referrals are made up on
a particular case. In instances such as this, the staff relies on the
Weld County Health Department and the State Health Department for expertise
in their areas.

George Montano appeared from the audience. He stated he had lived in the
town of Erie all his life and has been watching it go backwards. Erie
water is bad. A few years ago when a new water system was installed they
were assured this would solve most of their problems, then it was discovered
it was installed improperly. It was his feeling the Engineer, Mr. Bell,
was much like a new car salesman. His primary interest is to sell the
town of Erie this project.
MOTION:
Jerry Keifer moved that the Weld County Planning Commission continue the
Erie Wastewater and Sanitation District application for a Special Use
Permit until the next regular meeting, Tuesday, October 6, 1981, at 1:30 p.m.
The motion was seconded by Bette Kountz.
Discussion was called for from the members of the Planning Commission.
Don Billings felt a decision should be made today and not postponed until
the next meeting.
The Chairman asked the secretary to poll the members for their decision.
Jerry Keifer - yes; Wilber Wafel - no; Betty Kountz - yes; Don Billings - no;
Bob Ehrlich - yes; Fred Otis - yes. Motion carried with four voting for
continuance and two voting against.

APPLICANT - Windsor Assembly of God
SUBJECT - Sanctuary and Parsonage
LEGAL DESCRIPTION - Part of the SW%, Section 17, T6N, R67W of the 6th P.M. ,
Weld County, Colorado
APPEARANCE - The Reverand James Dunn, Pastor of the Windsor of God Church
reported the church had made an application for a Conditional
Use Permit to build a sanctuary and parsonage for the church.
At a later date they also hope to build a church school, but
these plans are not imminent. The town of Windsor has no
objection to this request, except they have requested they
be connected to the town of Windsor water supply. They would
prefer using North Weld water, as it would be much more
economical for them. Both water services are available to
them.
Tom Honn, Zoning Administrator, read the recommendations of the Department
of Planning Service's staff and reviewed the Development Standards. He
wished to call to the Planning Commission's attention that three entities
have requested soils reports and subsurface water tables be checked to
determine special needs (if any) prior to any building foundation design
being done.
The Chairman called for discussion from the audience. There was none.
MOTION:
Bob Ehrlich moved CUP-70:81:13 be recommended for approval to the Board of
County Commissioners along with all conditions and standards as outlined
by the Department of Planning Service's staff. Motion was seconded by
Betty Kountz.
Discussion by the Planning Commission.
Jerry Keifer informed the applicant the Planning Commission tries to go
along with the town's recommendation when an application for use is within
their comprehensive plan, which this obviously is. Therefore, the recommenda-
tion regarding use of Windsor water has not been changed.
The Chairman asked the secretary to poll the member for a vote.

APPEARANCE - Douglas Howard appeared in his own behalf. He explained he
and his wife can run this business from their home if their
application for a Special Use Permit is accepted. There
would probably never be more than ten or fifteen trailers on
the lot at any one time. Much of their business is wholesale
and done by telephone sales. They have a large lot, with
adequate lighting already installed. There would be little
increase in traffic.
The Chairman called for discussion from the audience. There was none.
Tom Honn, Zoning Administrator reviewed the recommendation of the Department
of Planning Service's staff, along with the Development Standards and Comments.
He asked the Planning Commission to be aware of ##3 of the staff's recommenda-
tions concerning the recommendation of the city of Greeley regarding additional
right-of-way.
The Chairman asked Mr. Howard if he was aware of the contents of the
recommendations and development standards. He stated he was.
MOTION:
Jerry Keifer moved the Planning Commission accept the recommendations and
Development Standards for use by Special Review made by the Department of
Planning Service's staff and that they be forwarded to the Board of County
Commissioners with recommendation for approval. Motion seconded by Bette
Kountz.

APPEARANCE - Ken Colgan who stated they want to build a small alcohol
production plant to use in conjunction with their cattle
feeding business. They are now in the process of obtaining
the necessary permit for their water. This will be quite
a small plant and will only produce about 500 gallons of
alcohol a day.

to the Zoning Ordinance, when making a determination whether to grant
or deny a USR request.
Tom Honn read the Planning Commissions ' favorable recommendation and
the reasons and conditions for said recommendation. He also read
the recommended development standards. Tom stated that the Planning
Commissions ' condition #4 has been satisfied and presented the Board
with a letter from the Office of the State Engineer, Divison of
Water Resources.
The applicant, Mr. Kenneth Colgan, was present and elaborated on
the request and the type of operation.
There was no one present in oppostion to said request.
Commissioner Steinmark stated that due to the dual use of the various
products produced and the need for a supply of grain the installation
seems most suitable to the Agricultural zone district; it also appears
that it is an agribusiness; which in fact, the Weld County Comprehensive
Plan does encourage in the rural areas. Commissioner Steinmark made
a motion to approve the request conditional upon: 1) The plat being
made of record before building permits be issued, 2) Soils investiga-
tion be made prior to building permit applications; and adopted all
the standards for the use as read by Tom Honn. Commissioner Martin
seconded the motion and it carried unanimously.

Mr. Honn stated that this item is to be considered in conjuncation with
the USR. He reviewd the Planning Staffs recommendation for approval.
Commissioner Martin made a motion to approve the mobile home request.
Commissioner Steinmark seconded the motion and it carried unanimously.
Mr. Honn stated, this item was held over from the Commissioners Board
meeting of September 16, 1981.

STANDARDS FOR USE BY SPECIAL REVIEW
1. The permitted use shall be for an alcohol production facility capable of
producing up to 500 gallons per day (200,)00 gallons per year) . Typical
equipment will include:
- I Boiler
- 1 Grain crusher
- Fermenters (1,500 gallon capacity)
- Alcohol Storage Tank(s)
- Distillation columns
The operation shall be subject to the regulations of and maintain permits
from appropriate Federal Government Jurisdictions.
2. Design Standards for Uses by Special Review, Section 24.5 et. seq. of the
Weld County Zoning Ordinance shall be complied with.
3. Operations Standards for Uses by Special Review, Section 24.6 et. seq. of
the Weld County Zoning Ordinance shall be complied with.
4. The Use by Special Review shall be limited to the plans shown hereon and
governed by the Standards stated above and all applicable Weld County
Regulations. Any material deviations from the plans and/or Standards as
shown or stated above shall require the approval of an amendment of the
Permit by the Weld County Planning Commission and the Board of County
Commissioners before such changes from the plans and/or Standards are
permitted. Any other changes shall be filed in the office of the Depart-
ment of Planning Services.
5. . The property owner and/or operator of this operation shall be responsible
for complying with all of the above stated Standards. Noncompliance with
any of the above stated Standards may be reason for revocation of the Permit
by the Board of County Commissioners.

This department's comments regarding the proposed alcohol production facility are as follows:
1. Application must be made to the Environmental Health Services Division, Weld
County Health Department for any proposed septic system.
2. For an air quality emmissions permit, application must be made to the Air
Pollution Control Division, Colorado Department of Health, 4210 E. 11th Avenue,
Denver, CO, 80220.
3. The facility must comply with Air Quality Control Regulation No. 2 - Odor, and
thus must not exceed the 7:1 dilution to threshold ration at any property boundary.
4. The facility must comply with 25-12-103, C.R.S. 1973, as amended (the Colorado
Noise Abatement - maximum permissible noise level reference) at all times. If
the area is zoned agricultural, the residential zoning noise levels would be
enforced.
5. If discharge is ever made to waters of the state, a NPDES permit must be obtain-
ed from the Water Quality Control Division, Colorado Health Deaprtment, Denver.

Dear Mr. Honn:
This letter is in response to additional information and communication
concerning the above referenced proposal.
We have received additional information from Ken Colgan concerning
water requirements for the proposed alcohol and livestock feeding operations.
Mr. Colgan has estimated that water requirements are: 5000 gallons per day
for making alcohol. Of this, 25% is lost (1250 gallons) , 2250 gallons for
cooling at a 10% loss (225 gallons), 1800 gallons to supply 150 head of
cattle at 12 gallons/day/head, 160 gallons for employee drinking and sani-
tary needs and 110 gallons for softening. The daily requirement is then
estimated to be 3545 gallons. This is approximately four acre-feet/year.
Our analysis indicates a well in the Laramie-Fox Hills formation at
this location could be allowed in accordance with Colorado Revised Statute
37-90-137(4) . On the basis of this tract of land being 160 acres, we have
determined the supply to be sufficient to allow at least four acre-feet/year.
Based on this, we can recommend approval of this proposal. Mr.
Colgan will have to modify his permit application to better reflect his water
requirements. A well permit will be available to supply at least four acre-feet
provided Mr. Colgan amends his permit application as necessary.

We have received the above referenced applications which calls for a
well to serve an alcohol production facility and a mobile home zoning for
a 160-acre tract. We also have received a well permit application which
is apparently intended to serve both these uses.
Unfortunately, we have not received a water supply plan for this pro-
posal. While there may be water available from the Laramie-Fox Hills aquifer,
it is impossible to determine the adequacy of this resource until we have an
accurate appraisal of water requirements. Such a plan would also evaluate
aquifer characteristics, etc.
This office cannot review this proposal until we have a water supply plan
for review. We recommend this proposal be held in abeyance until that time.
