HomeMy WebLinkAbout840328.tiff RESOLUTION RE: APPROVAL OF USE BY SPECIAL REVIEW FOR A CHURCH IN A RESI- DENTIAL-FOUR (R-4) ZONE DISTRICT - STEVEN SEARS WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS , the Board of County Commissioners held a public hearing on the 30th day of May, 1984 , at the hour of 2 : 00 o' clock p.m. in the Chambers of the Board for the purpose of hearing the application of Steven Sears , 1221 8th Avenue, Greeley, Colorado 80631 , for a Use by Special Review for a church in a Residential Four (R-4) Zone District on the following described real estate, to-wit: Lots 1 and 2 , Block 1 , Carriage Estates Sub- division, 1st filing, being part of the SW4j Section 24 , Township 5 North, Range 66 West of the 6th P.M. , Weld County, Colorado WHEREAS , Section 24 . 4 . 2 of the Weld County Zoning Ordinance provides standards for review of said Use by Special Review, and WHEREAS , the Board of County Commissioners heard all of the testimony and statements of those present, has studied the re- quest of the applicant and the recommendations of the Weld County Planning Commission and all of the exhibits and evidence presented in this matter, and having been fully informed, finds that this request shall be approved for the following reasons: 1 . The submitted materials are in compliance with the application requirements of Section 24 . 7 of the Weld County Zoning Ordinance. 2 . It is the opinion of the Board of County Commissioners that the applicant has shown compliance with Section 24 . 4 . 2 of the Weld County Zoning Ordinance as follows: a. The proposal is consistent with the Weld County Comprehensive Plan. The plan supports proposals for residential uses requiring special review as long as the use adjoins existing municipali- ties and the proposal conforms to the desires of the municipalities as expressed in its com- prehensive plans. The subject site is within the City of Evans' Preliminary Master Plan area and the City of Greeley' s Comprehensive Plan area. The City of Evans approved the proposal on April 26 , 1984 . The Greeley Planning Commission approved the proposal on May 8 , 1984. 1, 340328 Page 2 RE: USR - SEARS b. The proposal is consistent with the intent of the :Residential-Four (R-4) Zone District. The purpose of the R-4 District is to provide areas for high density residential use. The R-4 Dis- trict is also intended to accommodate nonresi- dential land uses compatible with residential uses allowed by right in the district. c. The use permitted will be compatible with exist- ing surrounding uses . Existing surrounding uses include a church, duplexes, single family dwell- ings and a mobile home park. d. The use is compatible with the future develop- ment of the surrounding area as permitted by the existing zoning and with future development as projected by the comprehensive plans and master plans of affected municipalities . e. No overlay districts affect the site. f. Use by Special Review Operation and Design Stan- dards provide adequate protection of the health, safety and welfare of the neighborhood and County. NOW, THEREFORE, BE IT RESOLVED by the Board of County Com- missioners of Weld County, Colorado, that the application for a Use by Special Review for a church in a Residential Tour (R-4) -Zone District an the hereinabove described parcel of land be , and hereby is, granted subject to the following conditions: 1 . The attached Standards for Use by Special Review be adopted and placed on the Use by Special Review plat prior to recording. 2 . The permitted use shall be a church as described in the submitted application materials and U.S.R. maps on file in the Weld County Department of Planning Services Office. 2. The building shall be designed and constructed to meet the requirements of the Western Hills Fire Protection District as outlined in a latter dated May 1, 1984 -from the fire district. 3. The applicant shall comply with the design standards for the Use by Special Review, Section 24.5 et seq. , of the Weld County Zoning Ordinance. 4. The applicant shall comply with the Operation Standards for Uses by Special Review, Section 24.6 -et seq. , of the Weld County Zoning Ordinance. 5. Representatives or members of the Weld County Health Department and Weld County Department of Planning Services shall be granted access onto the site at any reasonable time in order to insure the operations carried out on the sits comply with the -Development Standards stated hereon and all applicable Weld I;onnty Regulati-ons. 6. The Use by Special Review area shall be limited to the plans shown hereon and governed by the Standards as stated above and all applicable Weld County Regulations. Any material deviatians -From the plans and/or Standards as shown or stated above shall require the approval of an amendment of the Permit by the Weld County Planning Commission and the Board of County Commissioners before such changes from the plans and/or Standards are permitted. Any other changes shall be filed in the office of the -Department of Planning Services. 7. The property owner and/or operator of this operation shall be responsible for complying with all of the above stated Standards. Noncompliance with any of the above stated Standards may be reason for revocation of the Permit by the Board of County Iommissioners. Chairman N. Carlson commented on the fact that only four Commissioners were present, and the procedure which would hp used in the event of a tie vote. He also stated that the applicant could ask for a continuance to a date when all Commissioners will be present. The applicant chose to continue with the hearing today. Lee Morrison, Assistant County Attorney, read the application into the record. Rod Allison, Planning Department repre- sentative, read the favorable reczumendation of the Planning Commission into the record, stating that seven Operation Standards have been proposed. Leo Newell, representative of the church to be built on the property, came forward to answer questions of the Board. He stated that both Greeley and Evans are in agreement with this application. After further discussion, Commissioner C. Carlson moved to approve this Use by Special Review for Steven Sears, including the Operation Standards and conditions. Commissioner Johnson seconded the motion which carried unanimously. The maxium capacity of the church is two hundred and fifty (250) seats. The number of off-street perking spaces required is one (1) apace for every four (4) -seats of rated seating capacity. She mu Cher of off-street parking spaces required and the expected maximum trips (oneway) is sixty four (64) or one hundred ' twenty-eight (128) round trips per session. It is the Planning staffs position that a church at this location would not create a -significantly more amount of traffic than a twenty (20) unit condominium complex, a use ₹;y right in the Residential Four "R-4" Zone District. For example; a twenty (20) unit complex generates an average of 6.1 trips per day per unit or a total of one hundred twenty-two (122) round trips. The difference between the two uses is the apartment complex would have peak trip generation going to and from work, whereas, the church would have peak trip generation according to meeting times. _Data from the Institute of Traffic Engineers was used to determine trip generation for the apartment -complex. The city of Evans has reviewed this proposal and indicated they led no objections to this proposal. -The city of Evans has first right to annex this property according to an agreement between the cities of Greeley and Evans. The city of Greeley has not reviewed this proposal at the time the Planning Commis- sion packets were prepared. Please review the intent section of the residential four "R-4" district in the Weld County Zoning Ordinance; Section 32.5.1, listed on page 30-11. The -Department of Planning Services staff has not received -any objections from surrounding property owners. Most of the requirements do not directly affect this referral but can be dealt with once the building permit is issued with the exception of item #1. If the proposed building needs to comply with the sprinkler requirement, approval measures should be taken before a building permit is sought. 1. If the building is to have a basement that is 1500 sq. ft. or larger, a sprinkler system must be installed in the basement and coverage provided for the stairs to the basement. If the area under the stairs is useable for storage, sprinkler protection must also be provided there. (UFC 10.309 (c) 2 & 4 ) . 2. All exit doors must have panic hardware. The main entrance door may be excepted if it is a single door and a key locking device is used and a sign, conforming to code, is posted adjacent to the door stating "This Door Must Remain Unlocked During Business Hours". Also when unlocked the door must be free to swing without operation of any latching device. (UFC 12.104, 25.106 (b) 2). 3. All exits must have illuminated exit signs. (UFC 12.114) . 4. At least two separate exits shall be provided that are remote from each other. (NFPA 101 - 8--2.5.1 & 8-2.4.3) 5. Travel distance to an exit shall be no more that 150 feet from any point. (UFC 25.107 (c)). 6. Exits must have emergency exit illumination lights. (UFC 12.113). 7. Not less than 12 inches of space shall be provided from the back of one seat to the forward most projection of the seat immediately behind it. (UFC 25.108 (a)) (NFPA 101 - 8-2.5.3 (a)). 8. Rows of seats between aisles shall have not more than 14 seats. Rows of seats opening onto an aisle only on one side shall have no more than 7 seats. If benches or pews are to be used, the number of seats per bench or pew will be based on one person per 18 inches of pew or bench. (UFC 25.107 (d), 25.108 (d) (NFPA 101 - 8-2.5.3 (b & c)). Page 2 -9. Aisles shall not be less than 3 feet wide when serving seats on only one side and not less than 3 feet 6 inches when serving seats on both sides. (UFC 25.107 (b) 3) (NFPA 101 - 8-2.5.4) . 10. Fire extinguisher shall be provided as follows: (UFC 10.301) A floor plan will need to be reviewed before a definite requirement can be made. However, based on the approximate square footage and occupancy type at least 2 2A:20BC (5 lb ABC) extinguisher will be required. 11. All decorative material such as drapes, curtains and hangings must be flame retardent. (UFC 25.103) . 12. An assembly permit must be obtained from this Agency. (UFC 4.101, 25.101). The site is adjacent to both the City of Greeley and the City of Evans; and thus, falls within the targeted objective of controlled urban growth in and around existing municipalities. The land is zoned for multi—family development and has no agricultural benefit. All properties directly abutting the subject property are owned by Sierra Investments and are undeveloped. The only developed lot situated in the same block as the subject property is lot #4 containing a duplex. The block across the cul-de-sac has but one lot developed as well (The Greeley Church of God). As Carriage Estates slowly develops out the location of the existing Greeley Church of God, and the proposed church under this review (along the Western most border of Carriage Estates) creates an excellent buffer between 35th Avenue and the remainder of the residentially zoned subdivision. Traffic and parking should not be a problem with adequate off-street parking on site (determined through seating capacity which far exceeds current size of congregation) and access from both West 34th Street and West 35th Street. The Greeley Church of God utilizes almost exclusively West 34th Street to access their parking lot. This leaves West 35th Street and West 34th Street Road with very little to almost no usage during peak church service hours. The increased traffic generaged by the addition of the church would be limited to those times that formal services or meetings were held. (Time of meetings and approximate number attending is outlined under question #5, Section h. ). The subject site is not located within any of the "overlay districts" of Weld County. The addition of this church to Carriage Estates would be positive for all involved. For those existing and future residents East of our subject site the new church, along with the existing Greeley Church of God, would create an aesthetically pleasing buffer between 35th Avenue and their homes. The increased traffic in the neighborhood would be limited to the Western most portion of the subdivision. The introduction of churches into neighborhoods has in many cases proved to enhance not only the aesthics but also the safety and desirability of the area. Some communities, including Broomfield, have gone so far as to purchase properties in target areas and make them available solely for church development in order to improve desirability and reduce crime rates. The induction of this church would most assuredly work to serve these ends. South Congregation of Jehovah's Witnesses Leo E. Scheel , Greeley Fire Department Subject : Fire Protection Requirements for pronosed Kingdom Hall This building has an occupancy classification of an A-3 and is not required to have a fire alarm system. If the building -meets the requirement of the Uniform Building code for exceptions to sprinkler systems , Chapter 38 , Section 3802 .b. 1 for window openings, this building does not need to have an automatic sprinkler system installed. There is no requirement for smoke detectors in this occupancy. The fire protection required for this building would be three dry chemical fire extinguishers, rated 2-A, 10-BC, Spaced so that there would not be more than 50 feet travel distance to any extinguisher. These would be located in travel areas or by exits. The Western Hills Volunteer Fire Department is the agency that would respond to this location in the event of a fire. In talking to these people, the water pressure is so low that they have determined that a tanker will be dispatched to the scene to assist with the needed water flow to extinguish a fire. The water pressure is adequate for normal usage, but a subdivision prior to this in the feed system seems to drag the pressure down to below acceptable levels for fire suppression purposes. There are other considerations to be weighed about the exiting from the auditorium, but until the final drawings are made, I can not say that all exit requirements are met . From the drawing that I viewed on February 20 , 1984 , there are sufficient exits from this area and placed correctly. Until the seating arrangements are finalized, I can not say that the seating arrangement meets all requirements. This must comply with Uniform Fire Code, Section 25. 107 or 25.?08 , depending on the on the type of seating that is to be utilized. Mr. Willis Gibson went to the County Assessors office and found that no one by name was recorded.
