RE: AUTHORIZATION FOR THE TREASURER TO PROVIDE INTEREST ON TRUST FUND.
WHEREAS, the Board of County Commissioners of Weld County, Colorado,
pursuant to Colorado Statute and the Weld County Home Rule Charter, is vested
with the authority of administering the affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners, on April 16, 1979, created
a Trust Fund for monies held concerning Antelope Hills Subdivision Roads, and
WHEREAS, THREE THOUSAND DOLLARS ($3,000.00) was deposited April 16, 1979,
and
WHEREAS, in the final settlement concerning Weld County versus Ponton
an additional FIVE THOUSAND DOLLARS ($5,000.00) was received in settlement
concerning the matter and placed into the Trust Fund on July 9, 1979.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners that
the Treasurer shall credit interest accruing to the funds beginning July, 1979
at the average interest rate received on County funds.
BE IT FURTHER RESOLVED by the Board of County Commissioners that the
interest accrued on the EIGHT THOUSAND DOLLARS ($8,000.00) from July, 1979 be
transferred from the General Fund to the Trust Fund prior to the close of 1981
fiscal year, and
BE IT FURTHER RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that interest on an annual basis be credited to the funds
until used at the average interest rate received by the County Treasurer.
The above and foregoing resolution was, on motion duly made and seconded,
adopted by the following vote on the 6th day of January, A.D. , 1982.

ASSIGNMENT AND RELEASE
I , Daniel Ponton, named in the Cashier' s Check for the
amount of $3, 000 . 00, a copy of which is attached hereto and
incorporated herein by reference, for a good and valuable
consideration, the receipt of which is hereby acknowledged, by
these presents assigns , transfers, and sets over to the Weld
County Commisioners, their heirs and assigns, the Cashier ' s
Check, and all his right, title and interest to the same and
releases the Weld County Commissioners from all liability regarding
the same.
