RESOLUTION
RE: APPROVAL OF SPECIAL USE PERMIT FOR AN EGG LAYING FACILITY
FOR KENNETH D. HOHNER, 3398 WELD COUNTY ROAD 4 , ERIE, COLO-
RADO 80516
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners of Weld County,
Colorado held a public hearing on the 6th day of May, 1981 at
the hour of 2 : 00 o' clock p.m. in the Chambers of the Board of
County Commissioners for the purpose of hearing the application
of Kenneth D. Hohner, 3398 Weld County Road 4 , Erie, Colorado
80516, for a Special Use Permit for an egg laying facility on
the following described real estate, to-wit:
Lot 3, Block 2 , Ranch Eggs Subdivision,
located in the Northwest Quarter of Sec-
tion 34, Township 1 North, Range 68
West of the 6th P.M. , Weld County, Colorado
WHEREAS, the petitioner was present, and
WHEREAS, evidence was presented in support of the granting
of the Special Use Permit for an egg laying facility on the
above described real estate, and
WHEREAS, Section 3. 3 (E) (2) of the Weld County Zoning Resolu-
tion authorizes such a use in an Agricultural Zone District upon
approval by the Board of County Conmiissioners, and
WHEREAS, the Board of County Commissioners of Weld County,
Colorado heard all of the testimony and statements of those pre-
sent, has studied the request of the petitioner and the recommenda-
tions of the Weld County Planning Commission and all of the exhibits
and evidence presented in this matter, and having been fully
informed, is satisfied that the request for a Special Use Permit
for an egg laying facility on the hereinabove described real
estate, conforms to the purposes o₹ Section 3. 3 (E) (2) of the Weld
County Zoning Resolution.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of -Weld County, Colorado that the application o₹ Kenneth

T. Hohner for a Special Use Permit for an egg laying facility on
the hereinabove described tract of land be , and hereby is, granted
subject to the following:
1. The Development Standards contained in the
Special Use Permit.
C. No building or electrical permits shall be
issued on the Special Use Permit area until
the -Development Standards for the Special
use Permit have been placed on the Special
Use Permit plat and said plat has been
delivered to the office of the Department
Planning Services.
BE IT FURTHER RESOLVED by the Board of County Commissioners
that the reasons for approval contained in the Planning Commis-
sion recommendations dated April 7 , 1981 be, and hereby are,
adopted as the findings of fact of the Board of County Commis-
sioners in this matter.
She above and foregoing Resolution was, on motion duly made
and seconded, adopted by the following vote on the 6th day of
May, A.D. , 1981 .

I hereby certify that pursuant to a notices dated March 23, 1981 and
duly published March 26 and April 23, 1931 in the Johnstown _Breeze a
public hearing was held on the following requests from KENNETH D.
HOHNER:
DOC 'EB1-14 Special Use Permit, -egg laying facility
DOC "81-15 Special Use Permit, manure composting facility
Mr. Honn reviewed the Planning Commission' s favorable recommendation
and development standards for both of the afore mentioned cases .
Ron Stow, Weld County Environmental 3ealth, stated that Mr. Eohner has
applied for and air emission permit from the State :'_ealth Department.
Mr. Hohner reviewed briefly his request for the egg laying facility.
It is to be an -exapnsion of the existing egg laying facility. Mr. Eohner
explained in detail the manure composting facility.
Mr. Paul Vranisic, legal councel for adjacent landowners Frank 4 Margaret
Mihelcich, stated that his clients did not receive a notice on the
manure composting request nor any notice at all of either request when
they were heard by the Planning Commission. -Therefore, Mr. Vranisic
requested a continuance of IDOC 81-15 so that he might have time to
assess its affect on his clients -property.
Mr. Hohner stated he had no objections to granting a 10 day continuance.
Mr. Vranisic stated he would accept notice of this continuance on behalf
of his clients and waive the protect regarding no noticification of the
Planning Commission hearing.
Commissioner Kirby made a notion to approve the special __se permit for
an egg laying facility for Kenneth Hohner. Commissioner Martin seconded
the motion and it carried unanimously.
Commissioner Steinmark made a motion to table the SUP request for a
composting facility _until May 20, 1981 at 2 : 00 PM. Commissioner Kirby
seconded the -notion and it carried unanimously.

1. It is the opinion of the Planning Commission that this request is in agreement
with the Weld County Comprehensive Plan in that the plan states that the
expansion and development of agribusiness and agriculturally oriented
industry will be encouraged, provided these enterprises do not adversely
affect the total economy or environment. It is the opinion of the Planning
Commission that the proposed use would not appear to have any adverse
impacts on the agricultural interests of the County, the total economy, or
the environment.
2. It is the opinion of the Planning Commission that the proposed operation
is in compliance with the provisions of Section 3.3.E.(2) of the Weld
County Zoning Resolution.

This determination is based, in part, upon a review of the information submitted
by the applicant, other relevant information regarding the request and the
responses of the referral entities which have reviewed this request.
The Planning Commission recommendation for approval is conditional upon the
following:
1. The attached Development Standards being recommended and adopted for
the Special Use Permit.
2. No building or electrical permits shall be issued on the Special Use
Permit area until the attached Development Standards for the Special
Use Permit have been placed on the Special Use Permit plat and said
plat has been delivered to the office of the Department of Planning
Services.

DEVELOPMENT STANDARDS
SUP-461 :81 :7
1 . The egg production facility on the hereon described parcel shall be
limited to the facilities shown hereon which are designed to house a total
of 42,000 laying hens and all other uses permitted by right under Section
3.3.B. of the Weld County Zoning Resolution.
2. The Special Use Permit area shall be maintained in such a manner so as to
prevent soil erosion, fugitive dust, and the growth of noxious weeds .
3. All phases of the operation shall comply with all County and State Health
Standards and Regulations pertaining to air quality, water quality, noise
emission, and sanitary disposal systems. Control of flies must be maintained
on a year round basis.
4. Lagoons for wastewater retention shall be installed as per Rules and Guide-
lines for Water Pollution Control at Livestock Confinement Areas issued by
the Colorado Department of Health, May 1968. The applicant shall be respons-
ible for any additional applicable directives or guidelines issued by the
Colorado Department of Health, Water Pollution Control Division.
5. -All accesses shall have the approval of the Weld County Engineering Depart-
ment. All accesses shall be constructed in accordance with the recommenda-
tions and or requirements of the Weld County Engineering Department.
6. An opening shall be installed in the 8,000 gallon underground storage tank
for fire protection purposes .
7. The Special Use Permit shall be limited to the plans shown hereon and
governed by the Development Standards stated above and all applicable Weld

1 . It is the opinion of the Department of Planning Services staff that this
request is in agreement -with the Weld County Comprehensive Plan in that the
plan states that the expansion and development of agribusiness and agriculturally
oriented industry will be encouraged, provided these enterprises do not
adversely affect the total economy or environment. It is the opinion of
the Department of Planning Services staff that the proposed use would not
appear to have any adverse impacts on the agricultural interests of the
County, the total economy, or the environment.
2. It is the opinion of the Department of Planning Services Staff that the
proposed operation is in compliance with the provisions of Section 3.3.E. (2)
of the Weld County Zoning Resolution.
3. It is the opinion of the Department of Planning Services staff that the

health, safety and welfare of the inhabitants of the area and the County.
This determination .is based, in part, upon a review of the information submitted
by the applicant, other relevant information regarding the request and the
responses of the referral entities which have reviewed this request.
The Department of Planning Services staff recommendation for approval is
conditional upon the following:
1 . The attached Development Standards being recommended and adopted for
the Special Use Permit.
2. No building or electrical permits shall be issued on the Special Use
Permit area until the attached Development Standards for the Special
Use Permit have been placed on the Special 'Use Permit plat and said
plat has been delivered to the office of Department of Planning Services .

1 . The egg production facility on the hereon described parcel shall be
limited to the facilities shown hereon which are designed to house a total
of 42,000 laying hens and all other uses permitted by right under Section
3.3.8. of the Weld County Zoning Resolution.
2. The Special Use Permit area shall be maintained in such a manner so as to
prevent soil erosion, fugitive dust, and the growth of noxious weeds.
3. All phases of the operation shall comply with all County and State Health
Standards and Regulations pertaining to air quality, water quality, noise
emission, and sanitary disposal systems. Control of flies must be maintained
on a year round basis.
4. Lagoons for wastewater retention shall be installed as per Rules and Guide-
lines for Water Pollution Control at Livestock Confinement r� eas issued by
the Colorado Department of Health, May 1968. The applicant shall be respons-
ible for any additional applicable directives or guidelines issued by the
Colorado Department of Health, Water Pollution Control Division.
5. All accesses shall have the approval of the Weld County Engineering Depart-
ment. All accesses shall be constructed in accordance with the recommenda-
tions and or requirements of the Weld County Engineering Department.
6. An opening shall be installed in the 8,000 gallon underground storage tank
for fire protection purposes .
7. The Special Use Permit shall be limited to the plans shown hereon and
governed by the Development Standards stated above and all applicable Weld
County Regulations. Any material deviations from the plans and/or Develop-
ment Standards, as shown or stated above shall require the approval of an

Our staff has reviewed the above zoning change request and make the
following comments:
1 . The soil is classified as Ulm clay loam, 0-3% slopes.
This is a deep, well drained soil . Permeability is
slow with a high available water capacity. Surface
runoff is medium and the erosion hazard is low. Soil
capability subclass is Ile irrigated, and IVe non-
irrigated. This soil has poor potential for urban and
recreational development. Slow permeability and high
shrink-swell cause problems in dwelling and road con-
struction. A more detailed description can be found on
page 43 of the Weld County soil survey.
2. There are no major irrigation systems affected by this
activity.
3. The site is not in a defined floodplain.
4. The activity is also compatible with the adjoining agricultural
land uses.

I see no problems as far as we are concerned with the proposal
of Kenneth & Sherry Hohner, Lot 3, Block 2 , Ranch Eggs Sub-
division.
The only consideration I would ask to have, would be that on
the 8000 gallon underground water storage tank, there be an
opening or connection or some method we could use to get the
water to a pumper in case of fire on this property.
This could be accomplished by merely installing a removable
8 or 10 inch lid, having a 3 inch pipe from the bottom of the
tank to the top with a cap on it or any number of no cost meth-
ods.
This would be of great assistance to us in the event of a fire
on this property and in the event of our using this water for
emergency, we would be willing to assist the owners in refilling
the storage by tanker so as not to leave them without sufficient
water for their operations.
