Re: Amended Recorded Exemption #287
Dear Commissioners:
The attached application, plat and related items are in reference to a
request from Shig Nakagawa for a recorded exemption. The parcel of land on
which this request is being made is described as part of the N1 NWZ, Section
21, TIN, R67W of the 6th P.M. , Weld County, Colorado.
The request is to amend the plat so that Lot B will be 48 acres and Lot A
will be 12 acres, more or less. This request would allow Mr. Nakagawa to
expand his existing four (4) acre parcel to twelve (12) acres. The
additional 8 acres will be put into pasture. Lot B would predominantly
remain as dry land pasture. Both parcels have existing homesites.
Based upon the submitted information and policies of the County, the
Department of Planning Services staff recommends the request be approved for
the following reasons:
1. The impact on surrounding agricultural land uses does not appear to be
significantly different than the original request approved on November
23, 1977.
2. The request complies with Section 9-2E. of the Subdivision Regulations.
The Department of Planning Services staff recommendation for approval is
conditional upon the following:
1. The applicant shall submit a mylar plat to the Department of Planning
Services to be recorded in the office of the Weld County Clerk and
Recorder. The plat shall be drawn in accordance with the requirements

Dear Mr . Mayerl:
At the monthly meeting of the Tri-Area Planning Commission (TAPC)
which was held on August 7, 1984 , the application from Shig
Nakagawa for Amending a Recorded Exemption was discussed .
Description of Land: Part of the N 1/2, NW 1/4 , Sec .
21 , T1N R67W of the 6th P.M. , Weld County Colorado.
The decision of this Commission was to deny application for the
following reason .
Mr. Nakagawa came before this Commission on September 6 , 1983 and
requested a Use by Special Review Permit for a kennel . At that
time he indicated he wanted to start a kennel and setup a mobile
home to house the caretakers of the kennel on his property. The
Commission at that time gave approval for the dog kennel but
denied the request for setting of the mobile home . Weld County
Commissioners gave approval to his entire request. We would like
to direct a question to you . Has Mr. Nakagawa complied with the
mobile home setting requirements setforth by Weld County?
It is the feelings of this Commission that the idea to alter
meaning modify, delete or add to for the purpose he wishes to
amend the recorded exemption we denied his application.

The enclosed amendment for Recorded Exemption Application is
submitted for the purpose of adjusting property lines between two
contiguous parcels. The two parcels are made up of one 4 acre par-
cel with residential building and the other is 8 acres of pasture
land which we recently purchased.
The purpose of joining these two parcels is for investment
purposes and to increase property value for the future.
The additional 8 acre parcel will be put into pasture (which
would permit the purchase of livestock) or wheat, which would be
consistant with the policies of the Weld County Comprehensive Plan.
All surrounding areas are either in pasture or grain, therefore this
would be compatible with existing surrounding areas since this dis-
trict is zoned Agricultural.
The property under consideration for a Recorded Exemption is
not located in a flood plain, geologic hazard, and/or Weld County
Airport overlay district.
The legal description of the 8 acre parcel is shown on the
attached Warranty Deed.
The legal description of the parcel which will result upon
approval of the Recorded Exemption is: The West Five hundred Twenty
Eight Feet (528 ' ) of the North Nine Hundred Ninety Feet ( N990' )
of the North Half of the Northwest On' Quarter (N1/2 NW1/4) of
