The applicant has complied with the application re- o quirements of Section 21 . 7 et seg. , of the Weld County w m Zoning Ordinance. 2 . The request is in conformance with Section 21 . 6 of the Weld County Zoning Ordinance as follows : a. It is the opinion of the Board of County Com- missioners that the proposed Change of Zone is consistent with the Weld County Comprehensive Plan, and the proposed Industrial Two District (I-2) will be compatible with existing surround- ing land uses and with future development of the area. Land to the east of the subject property, east and west of U.S . Highway 85 , is zoned In- dustrial Three (I-3) . The Fort Lupton and Brighton Planning Commissions are recommending approval of this request. The subject property is located within Brighton' s industrial develop- ment area. b. Mr. Morrison also commented on the fact that only three Commissioners were present and the applicant could request that this hearing be continued to a date when all Commissioners will be present. Verna Sigg, resource planner for C & M Ready Mix Concrete Canpany,came forward and stated that she wished to proceed with this hearing today. Jim Mayerl, Planning Department representative, read the favorable recommendation of the Planning Commission into the record. Ms. Sigg then presented the request of the applicant, stating that they intend to develop this area as an industrial park. She exhibited a large map of the area showing the parcel being rezoned and discussed current zoning of adjacent parcels. Ms. Sigg requested that Conditions 2 and 3 be altered, eliminating references to the Colorado Geological Survey. Considerable discussion was held concerning this request. It was suggested that Condition 2 read "Building foundations shall be designed by a registered engineer"; and Condition 3 read, "Any plans or designs for fill sections shall be supervised by a registered engineer before ccmnencing with a use on the subject site." Commissioner Martin moved to approve. the Change of Zone, from A to I-2, requested by C & M Ready Mix Concrete Canpany, with Conditions 2 and 3 amended as discussed. We do have the following comments: SOILS: This soil has a severe limitation for septic tank absorption fields due to potential floods and wetness. The report by C&M Companies states that the dike has been designated as the floodway line by FEMA. In case of a flood the water level would probably raise on this site. Therefore any septic sys- tem should be carefully designed or engineered. This too could depend on the amount of fill material planned for the area. DRAINAGE: The water table is at or near the surface early in spring and re- cedes to as deep as 48 inches late in the fall in some years. This, as pointed out in the above mentioned report, could possibly be a problem,again depending on use and amount of fill . As the land is developed into other uses surface drainage could become a pro- blem. A surface drain system should be designed and installed. EROSION AND SEDIMENT CONTROL: The drainage system should be a part of the ero- sion and sediment control system. As more hard surfacing is placed on the land the more water will run off the property requiring a control or control structures. Possibly a pond should be considered to catch sediment. Clean pond as needed to keep it working effectively. Any bare area on the property should be landscaped and vegetated to prevent water and wind erosion. Mayeri: Thank you for allowing us to comment on the application from C & M Ready Mix Concrete Company (case number 2-405:84:6) for a change of zone from Agriculture to Industrial-Two. As mentioned in the application, the Central Colorado Water Conservancy District currently has an easement through the site for six augmentation wells and a concrete-lined delivery system to the South Platte River for _operation in our plan of augmentation. The system was installed in 1974 and has been used annually since that time. Our concerns, naturally, would focus on any interference to our operation from the proposed change in land use. Future gravel mining operations in this area could seriously reduce the amount of water available to our swells. Mitigation would have to occur under this situation. Also, access -to our wells and ditch, currently from Highway 85 near our well #3 on the -east, and from Weld County Road #6 on the north, must be maintained. I have visited with Verna Sigg, of C & M Ready Mix, and these concerns were discussed at length. 's 30, 31, T1N, R66W We have reviewed the plats, aggregate resource evaluation, geotechnical evaluation and attendant information for the proposed rezonings. The aggregate resource evaluation indicates that 15 percent of the de- posit is coarse aggregate. These terrace deposits are Broadway Alluvium which is composed of sand. We concur with the resource evaluations con- clusion that these deposits are uneconomic at this time. We have no objection to this rezoning. We do have several recommendations concerning the development of this site. The seasonally shallow groundwater levels will require special foundation and utility designs. We recommend that building foundations be designed by qualified engineering personnel . If large fill sections are proposed, we recommend that fill placement also be supervised by qualified engineering personnel . The rezoning application indicates that on-lot wells and septic systems -may be used on these sites. The shallow groundwater levels and porous sand and gravels in this area will preclude the use of standard on-lot septic systems. It may not be feasable to use on-lot leach fields in some locations. We recommend that an alternate method of sewage disposal , such as holding tanks or portable facilities be used for these sites.
