RESOLUTION RE: APPROVAL OF USE BY SPECIAL -REVIEW FOR A BIRD HUNTING OPER- ATION - DEARAL W. BEDDO WHEREAS , the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS , the Board of County Commissioners held a public hearing on the 20th day of June, 1984 , at the hour of 2 : 00 o' clock p.m. in the Chambers of the Board for the purpose of hearing the application of Dearal W. Beddo, 11154 Highway 6-6 , Platteville, Colorado 80651 , for Use by Special -Review for a bird hunting operation on the following described real estate, to-wit: Tarts of Sections 24 and 25 , Township 3 North, -Range 67 West of the 6th P.M. , Weld County, Colorado WHEREAS , Section 24. 4 . 2 of the Weld County Zoning Ordinance provides standards for review of said Use by Special Review, and WHEREAS , the Board of County Commissioners heard all of the testimony and statements of those present, has studied the re- quest of the applicant and the recommendations of the Weld County Planning Commission and all of the exhibits and evidence presented in this matter, and having been fully informed, finds that this request shall be approved for the following reasons : 1 . The submitted materials are in compliance with the application requirements of Section 24 . 7 of the Weld County Zoning Ordinance. 2 . It is the opinion of the -Board of County Commissioners that the applicant has shown compliance with Section 24 . 4 . 2 of the Weld County Zoning Ordinance as follows : a. The proposal is consistent with the Comprehensive Plan policies in that the use does not infringe on continued agricultural use in the vicinity or County. The proposal does not appear to have any adverse impacts on the agricultural interests of the County or the environment. b. The proposal is consistent with the intent of the Agricultural Zone District and is provided for as a Use by Special Review. c. The proposed Use by Special Review Permit area is located in a floodplain district. Any future building development will require compliance with Section 54, Flood Hazard Overlay District Regu- lations of the Weld County Zoning Ordinance. e. Use by Special Review Operation and -Design Stand- ards provide adequate protection of the health, safety and welfare of the neighborhood and County. NOW, THEREFORE, BE IT RESOLVED by the Board of County Com- missioners of Weld County, Colorado, that the application for a bird hunting operation on the hereinabove described parcel of land be, and hereby is, :granted -subject to the following conditions : 1. A revised mylar plat shall be submitted to the Depart- ment of Planning Services showing areas restricted to hunting on the Beddo Farm, and reservation of an -addi- tional twenty-five feet of right-of-way south of the centerline of State Highway 66 . 2. The attached Standards for Use by Special Review be adopted and placed on the Use by Special Review plat prior to recording. 3. The prescribed Use by Special Review activity shall not occur nor shall any building or electrical permits be issued on the subject property until the Use by Special Review plat has been delivered to the Department of Planning Services Office and the plat has been recorded in the office of the Weld County Clerk and Recorder. 4 . Prior to recording the Use by Special Review mylar plat, the applicant shall submit a detailed plot plan -showing all existing structures on the Beddo Farm. The uses permitted shall be a Bird Hunting operation as described in the application materials on file with the Department of Planning Services, but not including the dog kennel facility. 2. The operation of USR-626:84:22 shall be under the auspices of the Colorado Fish and Game Department which have the authority to license such activities. The applicant shall maintain a valid Colorado Commercial Hunting Park License. 3. The applicant shall comply with the design -standards for the Use by Special Review, Section 24.5 et seq. , of the Weld County Zoning Ordinance. 4. The applicant shall comply with the Operation Standards for Uses by Special Review, Section 24.6 et seq. , of the Weld -County Zoning Ordinance. 5. Representatives or members of the Weld County Health Department and Weld County Department of Planning Services shall be granted access onto the site at any reasonable time in order to insure the operations carried out on the site comply with the Development Standards stated hereon and all applicable Weld County Regulations. 6. The Use by Special Review shall be limited to the plans shown hereon and governed by the Standards as stated above an-d all applicable Weld County Regulations. Any material deviations from the plans and/or Standards as shown or stated above shall require the approval of an amendment of the Permit by the Weld County Planning Commission and the Board of County Commissioners before such changes from the plans and/or Standards are permitted. Any other changes shall be filed in the mffice of the Department of 3lanning Services. 7. The property owner and/or operator of this operation shall be responsible for complying with all of the above stated Standards. Noncompliance with any of the above stated Standards may be reason for revocation of the Permit by the Board of County Commissioners. 8. The Use by Special Review Permit shall be restricted to the applicant of record. The Use by Special Review Permit shall not be transferable to any other owners and/or operators. 9. Adequate liability insurance shall be maintained by the applicant insuring against claims of adjacent land owners or in accordance with State law. HEARING CERTIFICATION DOCKET NO. 84-36 RE: USE BY SPECIAL REVIEW, BIRD HUNTING OPERATION, DEARAL W. BEDDO A public hearing was conducted on June 20 , 1984, at 2:60 P.M. , with the following present: Commissioner Norman Carlson, Chairman Commissioner Jacqueline Johnson, Pro-Tem Commissioner Gene Brantner Commissioner Chuck Carlson Commissioner John Martin Also present: Acting Clerk to the WMrd, Mary Reiff Assistant County Attorney, Lee D. Morrison Planning Department Representative, Michael Mullen The following business was transacted: + I hereby certify that pursuant to a notice dated June 6, 1984, and duly published in the La Salle Leader on June 7, 1984, a public hearing was conducted to consider the application of Dearal W. Reddo for a Use by Special Review for a bird hunting operation. Lee Morrison, Assistant County Attorney, read this application into the record. Mike Mullen, Planning Department representative, read the recommendation of the Planning Commission into the record. Mr. Beddo came forward and made can- ments to the Board concerning his application. He said this operation would be subject to numerous State regulations. Jack Miller, a neighboring landowner, came forward to protest this application. James Peyton, attorney, came forward to represent Gary Magness who owns property south of the applicant's property. He stated that his client is concerned about the Arabian horses and Limousin cattle which graze on his land and also about a jointly-owned pond. Mr. Peyton spoke about the applicant's plans and questioned the future development of this area. Mr. Beddo stated that he wants to operate this as a private club similar to one TAPE which is in the area around Mead. Commissioner C. Carlson commented about the CHANGE number of farms in Weld County which are leased for hunting without being granted 84-56 a Use by Special Review and questioned why this operation needs a Use by Special Review. Mr. Mullen said that Section 31.4.3 of the Weld County Zoning Ordinance applies to this situation. Mr. Morrison also pointed out that this facility will be licensed by the State and individual hunters will not have to be licensed. Considerable discussion was held about this request. Mr. Morrison suggested that the application could be clarified by amending Operation Standard #1 by adding, "but not including the dog kennel facility." Mr. Mullen also suggested the addition of another operation standard stating, "The Use by Special Review Permit shall be restricted to the applicant of record. The Use by Special Review Permit shall not be transferred to any other owners and/or operators." Mr. Morrison then recommended that Operation Standard #2 be amended by adding, "The applicant shall maintain a valid Colorado Commercial Hunting Park License.", and that another Operation Standard YIP added: "Adequate liability insurance shall be maintained by the applicant insuring against claims of adjacent land • owners or in accordance with State law." Mr. Mullen stated that the Planning staff would probably recommend the addition of a fourth condition for approval: "Prior to recording the Use by Special Review mylar plat, the applicant shall submit a detailed plot plan showing all -existing structures on the Beddo farm." After reviewing Ur recommendations of changes and additions to the Operation Stand- ards which had been submitted by the Planning staff, Commissioner Johnson moved to approve this Use by Special Review for Dearal Beddo, based upon the Planning staff recommendations and comments, incorporating the above mentioned changes to the Operation Standards and conditions. Stating that he felt the amended Operation Standards provide for safety of the surrounding owners, Commissioner Brantner seconded the motion. The motion carried with Commissioners Brantner, Johnson and Martin and Chairman N. Carlson voting aye and Commissioner C. Carlson voting nay. Commissioner C. Carlson explained that he opposed this because hunters would be allowed to hunt without a Colorado hunting license and because of the extended season which would be allowed. Commissioner Martin commented that he felt that the stringent regulations which have been set up will protect the neighbors. He further commented that the Use by Special Review can be revoked if the Operation Standards are not kept. How will this be compatable to adjacent owners? The area along the Platte River is already being used for hunting and farming. Every place adjacent to my farm, except the Miller and Piz farms have been leased in the past to hunting and gun clubs for hunting purposes. Bird hunting in Colorado normally starts September 1st and ends in mid January. The hunting club members will hunt seven days a week. My place has been hunted for the last eight years during this same time of year. Also, the previous owner let people hunt this same farm. Other farms around my farm also allow people to hunt. The Piz farm permits hunting. The 160 acres south of the Miller farm has also been used for hunting. I plan on still using my farm for hunting whether this special use permit is approved or not. At this time there isn ' t any state or county ordinance that doesn ' t permit hunting on farm land. Below is a comparison of what I can currently do on my farm and what a special use permit would allow me to do. Current State Regulations Special Use Permit 1 . This license is controlled under Colorado Code Chapter 33• Below is an excerpt from this regulation. 1 . No shooting is allowed within 150 feet of any public road. 2. Only 80% of the birds that are planted can be shot. 3. A complete record of operations must be furnished to the state annually, which should include the number, of birds that were planted, the number of birds that were shot , and where the birds were purchased. 4. All birds must be banded. 5 . Both cocks and hens can be shot. 6. All holding pens for birds will be inspected by the state. 7. Signs will be posted 100 yards apart around the whole farm. 8. Hunter Safety cards are required if born after 1950. 9. No Hunting License is required. My current plans are to have fifty members which I will charge an annual fee of $500. 00 per member, plus an additional fee of $10 .00 for each bird that is shot. Hunting will be in organized in groups of four plus one employee guide to handle the dog. There will be one three hour hunt in the morning and one in the afternoon. We will hunt six days a week with no hunting on Monday. A member can bring a guest, but the member Mr. Mike Mullen May 5 , 1984 Page 3 must be present at the time. Appointments must be made to schedule the day the member wants to hunt . There is addtional information that I would like to include, feeling that it is pertinent. First , the closest point that hunting will be allowed to the Piz farm is 750 feet, 500 feet to the Miller farm, and 300 feet to one area of the Waddle farm. The remaining land of the Waddle farm is up to 1500 feet from the hunting area. Second, the type of ammunition that will be used will be #6 shot field load. These shots will carry approximately 100 yards or 300 feet if shot at a 45° angle in the air. I have personally checked for this information for my own satisfaction. And third, the plan is to have all hunting in the east-west direction, which means there will be no shooting in the direction of Hwy. 66.
