RESOLUTION
RE: APPROVAL OF USE BY SPECIAL REVIEW FOR A CRUDE OIL UNLOADING
AND STORAGE SITE - GETTY TRADING AND TRANSPORTATION COMPANY
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners held a public
hearing on the 27th day of July, 1983, at the hour of 2 : 00 o' clock
p.m. in the Chambers of the Board for the purpose of hearing the
application of Getty Trading and Transportation Company, P.O.
Box 5568, Denver, Colorado 80217, for a Use by Special Review
for a crude oil unloading and storage site, on the following
described real estate, to-wit:
Part of the SEa, Section 22 , Township 8 North,
Range 66 West of the 6th P .M. , Weld County,
Colorado.
WHEREAS, Section 24. 4 . 2 of the Weld County Zoning Ordinance
provides standards for review of said Use by Special Review, and
WHEREAS , the Board of County Commissioners heard all of the
testimony and statements of those present, has studied the re-
quest of the applicant and the recommendations of the Weld County
Planning Commission and all of the exhibits and evidence presented
in this matter, and having been fully informed, finds that:
1. The submitted materials are in compliance with the
application requirements of Section 24 . 7 of the Weld
County Zoning Ordinance.
2 . It is the opinion of the Board of County Commissioners
that the applicant has shown compliance with Section
24 . 4. 2 of the Weld County Zoning Ordinance as follows:
a. The proposal is consistent with the Comprehensive
Plan policies in that the use does not infringe
on continued agricultural use in the vicinity or
County. The proposal does not appear to have any
adverse impacts on the agricultural interests of
the County or the environment.
b. The proposal is consistent with the intent of the
Agricultural Zone District; and is provided for
as a Use by Special Review;
c. No overlay districts affect the subject site.
d. The Town of Pierce has found the proposal to com-
ply with their Comprehensive Plan.

e. It is the opinion of the Board of County Commissioners
that the attached Operation Standards will minimize
impacts on surrounding uses and the area to the
greatest extent possible, and provide adequate
protection for the health, safety and welfare of
the inhabitants of the area and the County.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado, that the application for a
Use by Special Review for a crude oil unloading and storage site
on the hereinabove described parcel of land be, and hereby is,
granted subject to the following conditions :
1. The attached Standards for Use by Special Review be
adopted.
2 . The applicant shall submit a revised mylar to the
Department of Planning Services within thirty (30)
days of the Board of County Commissioners ' approval
indicating the location of the prescribed Automatic
Custody Units (skid mounted) .
3. The corrected plat for Use by Special Review Permit
shall be placed of record by the Department of Plan-
ning Services staff.
The above and foregoing Resolution was, on motion duly made
and seconded, adopted by the following vote on the 27th day of
July, A.D. , 1983.

GETTY TRADING AND TRANSPORTATION COMPANY
1. The permitted use on the said described parcel of land shall be a
Crude Oil Receiving Station.
2. The major facilities shall be six (6) holding tanks (each with the
capacity for five-hundred (500) barrels of oil) , Automatic custody
units (skid mounted) , and additional equipment as listed on the plat
submitted for record.
3. The permitted use shall comply with Section 24.5 et seq. (Design
Standards for Use by Special Review) of the Weld County Zoning
Ordinance.
4. The permitted use shall comply with Section 24.6 et seq. (Operation
Standards for Uses by Special Review) of the Weld County Zoning
Ordinance.
5. Design and construction of the facility shall be in accordance with
the submitted application materials, recorded plat and Weld County
Building Code Regulations.
6. The appearance of the facility shall be maintained in a neat and
orderly condition through periodic painting and maintenance.
7. The Use by Special Review Permit area shall be maintained in such a
manner as to prevent soil erosion and fugitive dust.
8. The Use by Special Review Permit shall be limited to the plans shown
hereon and governed by the Operation Standards stated above and all
applicable Weld County Regulations. Any material deviations from the
plans and/or Operation Standards, as shown or stated above, shall
require the approval of an amendment of the Use by Special Review
Permit by the Planning Commission and the Board of County Commis-
sioners before such changes from the plans and/or Operation Standards
shall be permitted. Any other changes from the plans and/or Operation
Standards shall be filed in the office of the Department of Planning
Services.
9. The property owner and/or operator of this operation shall be respons-
ible for complying with all of the above stated Operation Standards.
Noncompliance with any of the above stated Operation Standards may be
reason for revocation of the Use by Special Review Permit by the
Board of County Commissioners.

The following business was transacted:
I hereby certify that pursuant to a notice dated July 11, 1983, and duly
published July 14, 1983, in the LaSalle Leader, a public hearing was held
for the purpose of considering the request of Getty Trading and Transportation
Company for a Use by Special Review for a crude oil unloading and storage site.
Lee Morrison, Assistant County Attorney, read this request into the record.
Rod Allison, representing the Planning Deparment, read the favorable recom-
mendation from the Planning Commission, he also read the conditions recommended.
He said that conditions #2 and #3 have been corrected. Alan Sanstra, repre-
senting Getty Trading and Transportation, was present. He said that this
particular site was selected because there is an existing pipeline here
which has the correct capacity. He said oil would be hauled from the Weld
County area to this site and injected into the pipeline and shipped to Casper
or Cheyenne, Wyoming. Mr. Sanstra said this is a joint operation between
Getty and Husky. After further discussion, Commissioner Johnson moved to
• approve this Use by Special Review with the conditions as listed by the Planning
Commission. Commissioner N. Carlson seconded the motion and it carried
unanimously.

RE : Application for Use By Special Review
Gentlemen :
Getty Trading and Transportation Company hereby submits its
application for Use By Special Review for permission to in-
stall a crude oil receiving station as required by Section 24 ,
Weld County Zoning Ordinance .
We believe that our proposed facility is consistent with the
Weld County Comprehensive Plan and the intent of the district
in which it will be located for the following reasons :
1- The proposed facility will be located adjacent to an
existing (Chevron ) oil facility .
2- The proposed facility will be located on dry land ,
Class III , type 174 agricultural land , rather than
irrigated land .
3- The proposed facility will _utilize agricultural land
which is not readily accessible to efficient farming
techniques .
4- The proposed facility will be located approximately one
half mile North of the town of Pierce , Colorado , thus
providing an adequate buffer in case of emergency sit-
uations . Further, all major components at this location
will be enclosed within a chain link fence to prevent
accidental injury to third parties .
5- The proposed facility will be located beyond that area
identified as " Future Town Growth Area " on the Weld
County Future Land Use Map , dated January , 1973 .
Our proposed facility is designed to accommodate the receipt
of crude oil trucked to the site primarily from lease in Weld

County . The site will be used jointly by Getty and Husky .
The trucked oil will be received in crude oil holding tanks
and then pumped into Husky ' s pipeline via A . C .T . units at the
site as shown on the enclosed drawings .
We currently estimate that between 5 to 10 truckloads of oil
per day would be received at this proposed facility . Because
of this volume , we have made application to the State Highway
Department for the relocation of the existing access to this
property and requested permission to install an additional
access . We feel that this site provides maximum visibility
for trucks entering and leaving the highway and suffient room
for loading activities .
We plan to begin construction on this facility as soon as ap-
proval is received from Weld County , State Highway Department
and the town of Pierce . It is hoped that the facility can be
operational by mid-July .
In the event that the facility proposed in this application is
no longer needed for the purposes intended , our lease agreement
with the owner requires us to restore the surface area to as
near original condition as possible .
We are aware of some of the problems Weld County is facing due
to the growth of Denver and the surrounding areas , and the
demand for public services brought about by this growth . One
of the consoling features of the facility we are proposing is
that it will add to the tax base while requiring minimal public
services .
