HomeMy WebLinkAbout830170.tiff RESOLUTION RE: APPROVE CONTINUANCE OF USE BY SPECIAL REVIEW HEARING TO AUGUST 17, 1983, CONCERNING AN ARABIAN HORSE FACILITY - RONALD W. AND MARGARET DUBOIS WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, a Use by Special Review hearing for an Arabian house facility for Ronald W. and Margaret DuBois was scheduled for July 27, 1983, at 2 : 00 p.m, as stated in the Notice dated July 11, 1983, a copy of said Notice being attached hereto and incorporated herein by reference, and WHEREAS, at the hearing of July 27 , 1983, it was determined that the property had not been posted prior to the hearing date, therefore, the Weld County Planning staff requested a continuance to August 17, 1983, at 10 : 00 a. m. , said request was considered by the Board, and WHEREAS, the Board, after consideration, deems it advisable to approve the request for a continuance of this matter until August 17, 1983, at 10: 00 a.m. NOW, THEREFORE, BE IT RESOLVED by the Board of County Com- missioners of Weld County, Colorado that the Use by Special Review for an Arabian horse facility for Ronald W. and Margaret DuBois be, and hereby is, continued to August 17, 1983, at 10 : 00 a.m. The above and foregoing Resolution was, on motion duly made and seconded, adopted by the following vote on the 27th day of July, A.D. , 1983. M. , with the following present: Chuck Carlson Chairman John Martin Pro Tart Gene Brantner Commissioner Norman Carlson Commissioner Jacqueline Johnson Commissioner Also present: Acting Clerk to the Board, Tommie Antuna Assistant County Attorney, Leo D. Morrison Planning Department Representative, Rod Allison The following business was transacted: I hereby certify that pursuant to a notice dated July 11, 1983, and duly published on July 14, 1983, in the LaSalle Leader, a public hearing was held for the purpose of considering the request of Ronald and Margared DuBois for a Use by Special Review for an Arabian horse facility. Rod Allison, Planning Department, said that the Planning staff is requesting a continuance for this matter because the property was not posted ten days in advance of this hearing. Commissioner N. Carlson noted that there were several people here who had driven quite a distance expecting to be heard today. Mr. Allison suggested that their testimony be heard thus eliminating the need for a second trip at a later date. The Chairman said that this hearing should be opened and testimony heard from those present and then continued to a later date. Lee Morrison, Assistant County Attorney, read this matter into the, record. Mr. Allison read the favorable recommendation frum the Planning Commission into the record. This recommendation does contain conditions. Shelton McKim, a neighbor of the DuBois' , came forward and requested that this matter be heard today. He said that at least 33 people had received certified letters advising them of this hearing. Mr. McKim said he felt this facility should be considered a home business and he was opposed to this permit being granted. He read Section 31.4.15 - Home Businesses - from the Comprehensive Plan into the record. After further comments by Mr. McKim, Margaret DuBois came forward and explained the purpose of requesting a Use by Special Review permit. After further discussion, Mr. Morrison said that posting of the premises is required by State statute and also Weld County's Ordinance for this type of zoning decision. He said the certified letters were more of a courtesy and not required by law. He said that his recommendation would be to con- tinue this matter so that there is adequate time for posting before a final decision is made by the Board. Commissioner N. Carlson moved that this matter be continued to August 17, 1983, at 10:00 A.M. Commissioner Martin seconded the motion and it carried unanimously.
