RE: APPROVAL OF CERTIFICATE OF DESIGNATION FOR COLORADO LANDFILL,
INC. - ERIE SITE
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home

Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
u: WHEREAS, on the 4th day of May, 1983 , a public hearing was
held in the Chambers of the Board of County Commissioners of Weld
County, Colorado for the purpose of considering whether or not

HE to grant a Certificate of Designation to Colorado Landfill, Inc.

for a solid waste disposal site and facility to be located on the
following described property:
ez A tract of land situated in the East z of the NE4
Section 29 , Township 1 North, Range 68 West
of the 6th P.M. in Weld County, Colorado,
being more particularly described as follows:
Commencing at the Northeast Corner of said
Section 29 and considering the North line
of said Section 29 to bear North 89°37 ' 31"
West with all bearings herein relative
thereto; Thence North 89°37 ' 31" West, a
distance of 144 . 00 feet to the True Point
of Beginning;
Thence South 00°04 ' 55" West, a distance of
106155 feet,
Thence South 69°25 ' 05" West, a distance of
1252 . 00 feet;
Thence North 00°04 ' 55" East, a distance of
1506. 00 feet,
Thence South 89°37 ' 31" East, a distance of
1172. 73 feet to the True Point of Beginning,
said tract of land containing 34 . 5 acres ,
more or less,
EXCEPT, beginning at the Northeast corner
of said Section 29 , Thence 500 feet West
along the North line of said Section 29
to the True Point of Beginning; South 200
feet; Thence West 435 . 6 feet; Thence North
200 feet; Thence East 435 . 6 feet to the
True Point of Beginning; said excepted
tract containing 2 acres, more or less.
WHEREAS, Section 30-20-104 , CRS 1973 , requires the Board of
County Commissioners to take into account certain factors, and
WHEREAS, the Board has taken into account such factors and
hereby finds as follows:

a) The solid waste disposal site and facility
will have no substantial detrimental effect
on the surrounding property.
b) That the solid waste disposal site and
facility will be convenient and accessible
to potential users.
M _Z c) That the applicant has the ability to comply
with the health standards and operating pro-
cedures required under Section 30-20-101 ,
et seq. , CRS 1973 and the rules and regula-
tions as prescribed by the State Department
_ of Health.
z d) That the Board has considered the recommenda-
tions by the Weld County Department of Health.
e) That the proposed use will comply with the
Weld County Comprehensive Plan.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado that the Certificate of Desig-
nation for Colorado Landfill, Inc. for a solid waste disposal
site and facility located on the hereinabove described real pro-
perty be, and hereby is, granted.
The above and foregoing Resolution was, on motion duly made
and seconded, adopted by the following vote on the 4th day of
May, A.D. , 1983 .

CRS 1973 , the Board of County Commissioners of Weld County, Colo-
