Ality-� F !Al1 tit ` is f AA ti ii ?d Illmit.E net =ill III . . . . . _ • `yV. i RESOLUTION RE: APPROVAL OF A USE BY SPECIAL REVIEW FOR THE EXPANSION OF A CATTLE FEEDLOT WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners held a public hearing on the 16th day of December, 1981, at the hour of 2 : 00 o' clock p.m. in the Chambers of the Board of County Commissioners for the purpose of hearing the application of H. A. Schneider and H. A. Schneider, Jr. , 34534 Weld County Road 33 , Greeley, Colorado, for a Use by Special Review for the expansion of a cattle feedlot, on the following described real estate, to-wit: Part of the NWa, Section 11, T6N, R66W of the 6th P.M. , Weld County, Colorado. WHEREAS, Section 24. 4. 2 of the Weld County Zoning Ordinance provides standards for review of said Use by Special Review, and WHEREAS, the Board of County Commissioners heard all of the testimony and statements of those present, has studied the request of the applicants and the recommendations of the Weld County Planning Commission and all of the exhibits and evidence presented in this matter, and having been fully informed, finds that: 1. The submitted materials are in compliance with the application requirements of Section 24 . 7 of the Weld County Zoning Ordinance. 2. It is the opinion of the Board that the applicant has shown compliance with Section 24. 4 . 2 of the Weld County Zoning Ordinance as follows: The proposal is consistent with the Comprehensive Plan in that policies of the plan promote agribusinesses so long as they do not create negative impacts on the environment of the County. No such impacts have been identified with this proposal. The proposal is consistent with the intent of the Agricultural Zone District in that the use does not constitute an interference with agricultural activities. In fact, this request is to increase the capacity of the feedlot existing on the farm. The use is both compatable with existing agricultural activity and with land use which is contemplated to be agricultrual in the Comprehensive plan. No overlay districts affect the site. Operation and design standards provide adequate protection of the health, safety and welfare of the neighborhood and the County. 810485 PAGE 2, USR, FEEDLOT, SCHNEIDER NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners that the application for a Use by Special Review for the expansion of a cattle feedlot on the hereinabove described tract of land be, and hereby is, granted subject to the following conditions: 1. The following Standards for Use by Special Review be adopted: a. The average stock population shall be three thousand (3, 000) head. b. The stock pen area shall be approximately three hundred and ten thousand (310, 000) square feet. c. Stock-pen runoff should and will be controlled on the farm of which this feedlot is a part, under normal conditions. d. Design standards for Uses by Special Review, Section 24 . 5 et. seq. of the Weld County Zoning Ordinance shall be complied with. e. Operations Standards for Uses by Special Review, Section 24. 6 et. seq. of the Weld County Zoning Ordinance shall be complied with. f. The Use by Special Review shall be limited to the plans shown hereon and goverened by the Standards stated above and all applicable Weld County Regulations. Any material deviations from the plans and/or standards as shown or stated above shall require the approval of an amendment of the Permit by the Weld County Planning Commission and the Board of County Commissioners before such changes from the plans and/or standards are permitted. Any other changes shall be filled in the office of the Department of Planning Services. g. The property owner and/or operator of this operation shall be responsible for complying with all of the above stated standards. Noncompliance with any of the above stated standards may be reason for revocation of the permit by the Board of County Commissioners. 2 . The plat for the Use by Special Review permit be placed on record by the Department of Planning Service' s staff prior to any building permits being issued on the site. A. Schneider and H. A. Schneider , Jr. for a use by special review to expand a feedlot. The Planning Commission recommended that this request be approved with development standards. Ken Lind, legal counsel, representing the applicant was present and reviewed the existing feed lot and the requested expansion. The development standards were discussed. Hank Schneider, Jr. was present and commented on his request. The retension pond will be just west of the feedlots, hopefully the run off will never run off the property. Dick Anderson, an adjacent landowner south of this property, was present. He contends that there is and has been a waste water problem. Mr. Schneider stated that he keeps his corrals clean and keeps the dust down. Mr. Anderson stated that he does not want Mr. Schneider' s waste water on his property. Tape change 81-99 Commissioner Carlson made a motion to approve this request and amend standards a, b and c to read as follows: a. SCHNEIDER • Response to Question 1(d): The operation is a normal and customary cattle feeding operation which employs three full time employees and two part-time employees for periods of certain work. The operation is conducted in a clean and neat fashion such that by application of the manure onto the surrounding fields and by use of the existing drainage system, no runoff has ever been seen to reach any body of water. In the unlikely event that any runoff would reach a body of water, it would reach the No. 2 Ditch which is a non-navigable body of water privately owned and to which no objection has ever been made for livestock runoff entering into the Ditch as this increases the fertility of the water and that water is subsequently applied to fields. Air pollution is minimized as the pens are continually kept clean which eliminates dust problems. Additionally, the capacity of the pens in relation to the number of head is a very good ratio thereby giving the cattle more than ample room. Noise has not been a problem as the only "abnormal" noise that may occur is the use of feeder trucks, which by themselves do not generate an unusual amount of noise in an ag zoned area. Applicant knows of no glare, fire, traffic or safety hazards that would be greater than any normal farming operation. All unloading facilities are off of the County Road which should result in no traffic problem. SPECIAL USE PERMIT H. A. SCHNEIDER Response to Question 1(e): As explained on the Waste Inventory, manure is removed from the pens not less than four times per year. During spring and fall, this manure is removed by use of loader and truck and subsequently spread on the applicants' farm fields adjoining the property. During winter and summer, the manure is again removed by use of loader and truck and piled upon Applicants' property at a location east of the feedlots. During the spring and fall, this manure is then spread upon the fields and all of the manure is then plowed or disked under.
