P /` ai ;)Itii� 0 jai 60p ! �/ E. 1 i I I I RESOLUTION RE: APPROVAL OF AMENDMENT TO DEVELOPMENT STANDARD #16 OF USE BY SPECIAL REVIEW - BUCKLEN EQUIPMENT COMPANY WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners held a public hearing on the 24th day of August, 1983, at the hour of 2 : 00 o' clock p.m. in the Chambers of the Board for the purpose of hearing the request of Bucklen Equipment Company, 804 North 25th Avenue, Greeley, Colorado 80631, to amend Development Standard #16 of the Use by Special Review which was approved August 18 , 1982 , on the following described real estate, to-wit: Part of the SW4, Section 31, Township 6 North, Range 65 West of the 6th P .M. , Weld County, Colorado WHEREAS , Section 24 . 4 . 2 of the Weld County Zoning Ordinance provides standards for review of said Use by Special Review, and WHEREAS, Development Standard #16 of the Use by Special Review granted to Bucklen Equipment Company currently reads as follows: "Prior to starting excavation, a six (6) foot wooden privacy fence shall be set up, maintained and located in such a manner as to fence and adequately screen from adjoining property owners that border the southern boundary of the subject site. " , and WHEREAS , the applicant has presented a petition requesting that said Development,Standard #16 be amended to read as follows: "Prior to starting excavation, a six (6) foot chain link fence with security barbed wire strands shall be set up, maintained and located in such a manner as to fence from adjoining property owners that border the southern boundary of the subject site. " , and WHEREAS , the Board of County Commissioners heard all of the testimony and statements of those present, has studied the re- quest of the applicant and the recommendations of the Weld County Planning Commission and all of the exhibits and evidence presented in this matter, and having been fully informed, finds that the LHR 2133 4-619O?�/J�� 830154 Page 2 RE: AMEND USR - BUCKLEN EQUIPMENT proposed amendment will provide adequate protection of the health, safety and welfare to the neighborhood and the County. Russell Anson Planning Department Representative, Rod Allison The following business was transacted: I hereby certify that pursuant to a notice dated August 3 , 1983 , and duly published August 11 , 1983 , in the La Salle Leader, a public hearing was held for the purpose of considering a Use by Special Review - Amend Development Standard #16 for Bucklen Equipment Company. Before this Hearing commenced the Chairman Pro-Tem announced that only four Commissioners were present and the applicant could request a continuance until all five Commissioners are present. The appli- cant chose to have the request heard today. Russell Anson, Assistant County Attorney, read this request into the record. Rod Allison, Planning Department representative, read the favorable recommenda- tion from the Planning Commission into the record. Sue Ann Bucklen was present to answer questions of the Board. She explained that the original Development Standard #16 had specified that they were to put up a wooden fence, but they had received opposition from the adjacent • homeowners. Ms . Bucklen said a petition had been circulated and over 50% of the neighbors favored a chain link fence. Commissioner N. Carlson moved to approve this amendment to the Use by Special Review. Commissioner Johnson seconded the motion. Mr. Reuben Weiderspahn, adjacent landowner, asked what the set-back requirements are for the Bucklen' s fence. Mr. Allison explained that there are no set- back requirements for a fence, so the Bucklen' s can put the fence on their property line. Mr. Weiderspahn voiced concerns about where the fence would be erected. Mr. Anson said this problem would have to be worked out with the Bucklen ' s. After a short discussion, the motion carried unanimously.
