RE: APPROVAL OF RECORDED EXEMPTION NO. 602 - LARRY AND JEAN
CROISSANT
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, it has been determined by the Board of County Com-
missioners at a public meeting held in the Chambers of the Board,
that the division into two parcels of land, as shown on the plat
known as Recorded Exemption No. 602 , being the property of Larry
and Jean Croissant, described as the West 1/2, Southeast ;, Section
20, Township 5 North, Range 67 West of the 6th P.M. , Weld County,
Colorado, being more particularly described in the plat which
shall be provided by the applicant and known as Exhibit "A" , said
plat to be recorded, does not come within the purview of the defi-
nition of the terms , "subdivision" and "subdivided land" , pursuant
to its authority under Section 30-28-101 (10) (d) , CRS 1973 , as
amended.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado that the hereinabove described
parcel of land owned by Larry and Jean Croissant be, and hereby
is, exempt from the definition of the terms , "subdivision" and
"subdivided land" .
BE IT FURTHER RESOLVED by the Board that this approval is
conditional upon the applicant submitting a mylar plat to the
Department of Planning Services ' Office to be recorded in the
office of the Clerk and Recorder. The plat shall be drawn in
accordance with the requirements of Section 9-2 C. (4) of the
Weld County Subdivision Regulations. The plat shall be sub-
mitted within ninety (90) days from the date of approval by the
Board.

Re: Recorded Exemption #602
Dear Commissioners:
The attached application, plat and related items are in reference to a
request from Larry and Jean Croissant for a recorded exemption. The parcel
of land on which this request is being made is described as the West 1/2,
Southeast 1/4, Section 20, Township 5 North, Range 67 West of the 6th P.M. ,
Weld County, Colorado.
The property is located approximately 2.75 miles north of Johnstown on
Weld County Road 54. The property contains approximately 80 acres of Class
Ile (prime) , IIIe, IVe, VIe irrigated and IVa, VIe nonirrigated soils.
The request is to divide the property into parcels of 45 acres and 35 acres,
more or less. The intent of this recorded exemption is to create a third
major residence on a 400 acre family operated farm for one of the sons.
Based upon the submitted information and policies of the County, the Depart-
ment of Planning Services staff recommends the request be approved for the
following reasons:
1. The request complies with Section 9-2 C. of the Weld County
Subdivision Regulations submission requirements.
2. The request complies with Section 9-2 E. of the Subdivision
Regulations as follows:

- The 80 acres, more or less, under consideration will allow
agricultural and related uses to be the predominant uses.
The uses will be compatible with existing surrounding agri-
cultural uses. These facts support the proposal as being
consistent with the intent clause of the Agricultural Zone
District.
- The proposal was reviewed by the City of Johnstown and was
found to comply with their longe-range Comprehensive Plan.
- The proposal is in compliance with Section 1-3 of the Weld
County Subdivision Regulations and the proposed land division
complies with the Weld County Comprehensive Plan; therefore,
the proposed use is consistent with efficient and orderly
development.
The proposal does not exist in an overlay district area.
- The proposed lots meet minimum lot size requirements for
land division.
- The Little Thompson Water District has indicated adequate
water service is available for this proposal.
- The proposed lots are not part of a recorded exemption within
the last five (5) years.
- The two lots proposed will have adequate access from Weld
County Road 54.
- The Weld County Health Department has indicated, in a letter
dated March 30, 1983, that both lots will have adequate
sewage capacity.
The Department of Planning Services staff's recommendation for approval is
conditional upon the applicant submitting a mylar plat to the Department of
Planning Services office to be recorded in the office of the Clerk and Recorder.
The plat shall be drawn in accordance with the requirements of Section 9-2 C. (4)
of the Weld County Subdivision Regulations. The plat shall be submitted
within ninety (90) days from the date of approval by the Board.

COMMENTS:
The 80 acre Croissant parcel is characterized by a drainage area which divides
the southeastern portion of the property. This parcel has slopes to the southeast
and to the southwest.
Proposed Lot "A" would contain approximately 45 acres and would have access to
Weld County Road 54, a paved road. Improvements include an existing house and a
garage. Prime farmland is located on Lot "A".
Proposed Lot "B" would contain approximately 35 acres and would also have
access to Weld County Road 54. Improvements include a barn and corrals. A
proposed building site for a house has been selected in the southeastern
corner of the tract.

Request for a Recorded Exemption
Dear Commissioners :
We wish to submit the following proposal and explanation
for a recorded exemption in order to build a new home or a portion
of the Croissant family farm.
Background Information:
Croissant Farms is a family agricultural partnership. The
partners are Leon H. Croissant and his sons, Larry L. Croissant
and James D. Croissant. The partnership rents the land and facilities
owned by Leon H. Croissant. The farm consists of 400 acres. The
80 acres which we propose to divide is a contiguous part of the farm.
Presently, the farm has two major residences and one labor house.
One of the major residences is occupied by Leon and Viola Croissant
and James Croissant. The other is occupied by the paternal grand-
parents. We, Larry and Jean Croissant and family,have ten:pordl ly
occupied the labor house. The farming partnership has an existing
and continuing need for the labor house as a labor house.
Purpose and Intent :
The purpose and intent of this request for recorded exemption
is to establish a 3rd major residence on the farm and to keep the
personal residences' cost, maintenance, and improvements separate
from the business relationship.
Land Usage :
The 80 acres which this request addresses is naturally
separated into two parcels of approximately 45 acres of prime
farm land plus the labor house, and 35 acres of rough irrigated
and dry pasture. There is a dividing fence which follows the
contour change. This is intended to become the boundary between
the two parcels.
The 80 acres would continue to oe managed the same as it
is today with the 45 acres in row crop and the 35 acres being grazed.
The yearly gross income potential of the 35 acres is uinimal,
approximately ; 600 as pasture. This does not significantly
affect the yearly gross income of the 45 acres which is approxi-
mately 020,000 when in row crop.
The land adjoining our proposed building site is also rough
pasture. The farm across the road is pasture and row crop land.
We intend to maintain our farming operation ii.uch as it is today.
The division of this property would not significantly alter the
character of the existing surrounding land uses,
