RE: APPROVAL OF RECORDED EXEMPTION NO. 481 - DUANE BASHOR, ET AL.
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, it has been determined by the Board of County Com-
missioners of Weld County, Colorado, at a public meeting held on
the 22nd day of April, 1981 in the Chambers of the Board of County
Commissioners of Weld County, Colorado, that the division into
two parcels of land, as shown on the plat known as Recorded Exemp-
tion No. 481, being the property of Duane Bashor, et al. , described
as part of Section 16 , Township 6 North, Range 63 West of the 6th
P.M. , Weld County, Colorado, being more particularly described as
follows, does not come within the purview of the definition of
the terms, "subdivision" and "subdivided land" , pursuant to its
authority under Section 30-28-101 (10) (d) , CRS 1973, as amended:
The South Half of the Southwest Quarter of
Section 16 , Township 6 North, Range 63 West
of the 6th P.M. , Weld County, Colorado.
LOT "A"
A parcel of land located in the South Half
of the Southwest Quarter of Section 16 ,
Township 6 North, Range 63 West of the 6th
P.M. , Weld County, Colorado, being more
particularly described as follows:
Beginning at the Southwest Corner of said
Section 16 and considering the South line
of said Southwest Quarter as bearing South
88°51' 20" East, with all other bearings
contained herein relative thereto;
Thence South 88°51 ' 20" East, along said
South line, 819. 55 feet;
Thence North 01°08 ' 40" East, 707 . 13 feet;
Thence North 88°51' 20" West, 242. 12 feet;
Thence South 01°08 ' 40" West, 243. 64 feet;
Thence South 84°34 ' 32" West, 571. 65 feet
to a point on the West line of said South-
west Quarter;
Thence South 02°31 ' 00" West, along said
West line, 398. 21 feet to the Point of
Beginning.
Said described parcel of land contains
9. 590 acres, more or less, including 0. 564
acres , more or less, reserved for county
road right-of-way purposes and is subject
to any rights-of-way or other easements as
granted or reserved by instruments of record
or as now existing on said described parcel
of land.

WHEREAS, the Board of County Commissioners of Weld County,
Colorado finds that this particular division of land is not taithin
the purposes of the Weld County Subdivision Regulations and the
Board desires to exempt this particular division of land from the
definitions of "subdivision" and "subdivided land" pursuant to its
authority under Section 30-28-101 (10) (d) , CRS 1973, as amended,
and Section 2-1A(3) of the Weld County Subdivision Regulations.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado that the hereinabove described
parcel of land owned by Duane Bashor, et al. , be, and hereby is,
exempt from the definition of the terms "subdivision" and "sub-
divided land" pursuant to its authority under Section 30-28-101
(10) (d) , CRS 1973, as amended.
The above and foregoing Resolution was , on motion duly made
and seconded, adopted by the following vote on the 22nd day of
April, A.D. , 1981.

RE: Recorded Exemption # 481
Dear Commissioners :
The attached application, plat, and related items are in reference to a request
from Duane Bashor et al for a recorded exemption. The parcel of land on which
this request has been made is described as S; SWa Section 16, T6N, R63W of
the 6th. PM, Weld County, Colorado This property is located 1; miles east of
Barnesville. The property contains approximately 80 acres of Class I , II , III ,
& IV irrigated soils. The request is to split the property into parcels of
9.59 acres and 70.0 acres.
The Bashor Brothers have requested this exemption for financing purposes on a
planned fuel alcohol facility. The Bashor Brothers have applied for a special
use permit for the fuel alcohol facility.
Based upon the information submitted and the adopted policies in the County, the
the Department of Planning Services Staff recommends the request be approved for
the following reasons :
1. The proposed split conforms with Section 9-2 of the Weld County Subdivision
Regulations (intent clause of the recorded exemption procedure) , Section
3-3 A. of the Weld County Zoning Resolution (intent clause of the Agricultural
Zone District) , and the Weld County Comprehensive Plan in that the use will be
compatible with surrounding agricultural uses.
2. The request complies with the provisions of Section 9-4 A. of the Weld
County Subdivision Regulations.
