WHEREAS, the petitioner was present, and WHEREAS, evidence was presented in support of the granting of the Special Use Permit for a dairy operation on the above described real estate, and WHEREAS, Section 3 . 3 (E) (2) of the Weld County Zoning Resolu- tion authorizes such a use in an Agricultural District upon approval by the Board of County Commissioners, and WHEREAS, the Board of County Commissioners of Weld County, Colorado heard all of the testimony and statements of those +3071 ) present, has studied the request of the petitioner and the recom- mendations of the Weld County Planning Commission and all of the exhibits and evidence presented in this matter, and having been fully informed, is satisfied that the request for a Special Use Permit for a dairy operation on the hereinabove described real estate, conforms to the purposes of Section 3. 3 (E) (2) of the Weld County Zoning Resolution. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commis- sioners of Weld County, Colorado that the application of Roy Schmidt for a Special Use Permit for a dairy operation on the hereinabove described tract of land be, and hereby is , granted subject to the following: 1. The Development Standards contained in the Special Use Permit. 2 . All accesses shall have the approval of the Weld County Engineering Department. All plans, specifications and data pertaining to the dairy operation shall be submitted to the Weld County Health Department for approval prior to obtaining a building permit for the dairy operation. 7. There shall be no discharge of wastes into any streams, other bodies of water, or adjacent drainage systems without obtaining a National Pollution Discharge Elimination System Permit from the Colorado Department of Health. 8. The Special Use Permit shall be limited to the plans shown hereon and governed by the Development Standards stated above and all applicable Weld County Regula- tions. Any material deviations from the plans and/or Development Standards as shown or stated above shall require the approval of an amendment to the Special Use Permit by the Planning Commission and the Board of County Commissioners be- fore such changes from the plans and/or Development Standards shall be permitted. There were general questions pertaining to the runoff into the ditch and if there would be any problems with flooding. Mr. Schmidt explained that there would be not problems with flooding. Mr. Honn reviewed the Planning Commissions ' favorable recommendation and the nine recommended development standards . To date there have been no objections to this request and no on was in attendance today in opposition. The applicant was present for questioning. Mr. Honn stated that since the County Health Department no longer has jurisdiction of the milk inspection program the Board mignt want to consider changing development standard #6 . He will check with the State and see if they do "plan reviews" and if the do the wording could be changed to State Health Department or it could be eleminated totaly. Commissioner Roe made a motion to approve the special use permit with the development standards and amending #6 to indicate that plans will be reviewed by the State Health Department unless they do not offer this service and then #6 will be eleminated. The over all number of cows with offspring hiefers to be raised as replacements will be around 800 head . This is a replacement barn as there were 150 co','s milked here for the past thirty five years . The old facilities are outdated and worn out. . The producing cows were sold with the young hiefers remaining on the farm. At the present time there are approximately 1175 head of cattle in the pens , some to be used as replacement cows and others to be fattened. The barn will be built to meet all the reauirements of the Weld Health Dept. and. the State of Colo. The State has inspected the existing holding pond with approval . This is a 320 acre farm and all pollutants will be trapped_ in the pond. Cdor will be no more than normal_ for this type of operation and will meet all health requirements . Noise will be minimal as only electricity will be used. This farm is in the IaSal_le Fire Protection District. All electrical and safety devices will be installed to meet inspection and code. The farm is located five miles south of LaSalle on ::Teld County TRoad 37. All roads are maintaned by Weld County and kept in good repair. There will be easy acsess to the barn for every other day milk pick yap . The existing water supply consists of 2 domestic wells that produce approx. 1 000 gal. Per hour. These wells have been in existence since the farms beginning. They have supplied water for up to 800 head of livestock in the past and present. The depths of the wells is between 80 to 100 feet. It formed on eolian deposits. Included in this unit are some soils with lime above 40 inches. Typically the surface layer is brown sand about 8 inches thick. The underlying material, to a depth of 60 inches is brown sand. Permeability is rapid. Available water capacity is moderate. Effect- ive rooting depth is 60 inches or more. Surface runoff is slow and erosion hazard is low. This soil is suited to limited cropping; intensive cropping is hazardous because of erosion. The cropping system should be limited to close grown crops such as alfalfa, wheat and barley. The soils also are adopted to irrigated pasture. A suitable cropping system would be alfalfa 3 to 4 years followed by corn and small grain for 2 years and alfalfa seeded with a nurse crop. Close grown crops may be irrigated from closely spaced contour ditches or sprinklers. Contour furrows or sprinklers should be used for new crops. Applications of barnyard and commercial fertilizer will help maintain good production. The potential vegetation on this soil is dominated by sand bluestem, sand reedgrass, switchgrass, sideoats grama, needle and thread, little bluestem and blue grama. Potential production ranges from 2500 pounds Cper acre in favorable years to 1800 pounds per acre in unfavorable years. When range condition deteriorates, sand bluestem, switchgrass, sand reed- grass, sideoats grama and little bluestem decrease and production drops. 0 _ E w Sand sage increases, undesirable weeds and annual plants invade and "blowout" conditions can occur as range condition becomes poorer. Management of vegetation on this soil should be based on taking half and leaving half of the total annual production. Seeding is advisable if range is in poor condition. Sand bluestem, sand reed- grass, Indiangrass, switchgrass, sideoats grama, little bluestem and blue grama are suitable for seeding. Due to the wind erosion suscepti- bility of this soil seeding should he done with an interseeder or in a firm, clean sorghum stubble-prepared the growing season prior to seeding- with a grass drill. Early spring seeding has proven most successful. Brush management can also help improve deteriorated range. CWindbreaks and environmental plantings are fairly well suited to this soil. Blowing sand and available water capacity are the principle hazards to establishing trees and shrubs. The soil is so loose that a trees need to be planted in shallow furrows and maintain vegetation cover between the rows. Supplemental irrigation will be needed to insure survival. Trees that are best suited and have good survival are Rocky Mtn. juniper, eastern redcedar, ponderosa pine and Siberian elm. Shrubs best suited are skunkbush sumac, lilac and Siberian pea shrub. Wildlife is an important secondary use, with these soils best suited for openland and rangeland wildlife. In cropland areas, habitat favorable for ring-necked pheasants, mourning doves, and many non-game species can be developed by establishing wildlife areas for nesting and escape cover. (. For pheasants, the inclusion of undisturbed nesting cover is vital and should he included in plans for habitat development; this is especially true in areas of intensive agriculture. Rangeland wildlife, exemplified mss, by the pronghorn antelope, can be assisted and encouraged by develop- ment of livestock watering facilities, proper livestock grazing manage- ment, and range reseeding where needed. This Valent soil has a fair potential for urban development. The primary limiting soil features are the rapid permeability and suscep- tibility to wind erosion. Septic tank absorption fields will function properly, however the proper filtering effect may not be achieved by the sandy substratum. Sewage lagoons would require sealing. Lawns, shrubs and trees, for beautification, when once established will do well.
