Re: Recorded Exemption #RE 679
Dear Commissioners:
The attached application, plat and related items are in reference to a request
from Hazel Zupke for a recorded exemption. The parcel of land on which this
request is being made is described as the EL SEk and the Ek W1 SEk, Section
21, T5N, R65W of the 6th P.M. , Weld County, Colorado.
The property is located approximately .75 miles east of Evans on Weld County
Road 54. The property contains approximately 120 acres of Class IIe (prime),
IIs (prime) , IVw, VIw irrigated and IVe, VIw nonirrigated soils. The parcel
of land under consideration is the total contiguous land holdings of the
applicant.
The request is to divide the property into parcels of 119 acres and 1 acres,
more or less. Mrs. Zupke would like to deed one acre with an existing
residence to her grandson, Larry Magnuson.
Based upon the submitted information and policies of the County, the
Department of Planning Services staff recommends the request be approved for
the following reasons:
1. The request complies with Section 9-2C. of the Weld County
Subdivision Regulations submission requirements; and
2. The request complies with Section 9-2E. of the Subdivision
Regulations as follows:
- The 120 acres, more or less, under consideration will
allow uses which are consistent with the intent clause of
the Agricultural Zone District. The uses will be
compatible with existing surrounding uses.
- The proposal was reviewed by the city of Evans and was
found to comply with their long-range Comprehensive Plan.
841019
Board of County Commissioners
Page 2
- The proposal is in compliance with Section 1-3 of the Weld
County Subdivision Regulations and the proposed land
division complies with the Weld County Comprehensive Plan.
Therefore, the proposed use is consistent with efficient
and orderly development.
- The proposal does exist in a Flood Hazard Overlay
District. Any development north of the Latham Ditch will
require a Flood Hazard Development Permit.
- The proposed lots meet minimum lot size requirements for
land division.
- The Central Weld County Water District has indicated
adequate water service is available for this proposal.
- The proposed lots are not part of a recorded exemption
within the last five (5) years.
- The two lots proposed will have adequate access from Weld
County Road 54.
The Department of Planning Services staff recommendation for approval is
conditional upon the following:
1. The applicant shall submit a mylar plat to the Department of Planning
Services to be recorded in the office of the Weld County Clerk and
Recorder. The plat shall be drawn in accordance with the requirements of
Section 9-2C. (4) of the Weld County Subdivision Regulations. The plat
shall be submitted within ninety (90) days from the date of approval by
the Board of County Commissioners.
Respectfully,

a paved road. The Latham Ditch separates the improvements from the rest of the farm

Applicants for the attached Recorded Exemption is Hazel Zupke.
Larry Magnuson and his wife, Helen Christine Magnuson, propose to take
the property as joint tenants. The Magnuson's have address of 20741 Weld
County Road 54, Greeley, Colorado 8O631 and telephone #339-3233. The
Magnuson's address is that of the acreage which they seek a recorded
exemption for. Hazel Ionise Zupke is the grandmother of Larry Magnuson.
Larry Magnuson has in fact, lived nearly 2O years on the
property in question, having been raised by his grandparents when his
father died at the age of four years. As Mr. Magnuson has lived on the
property in question his entire life, and as his grandmother is willing to

establishing a recorded excemption, Mrs. Zupke makes applir•ation of the
same via this submission.
Domestic water and sewage already exist for the parcel in
question and serve the structure located upon that property which has been
the home of Mr. Magnuson for 2O years.
This proposal is entirely consistent with Weld County
Comprehensive Plan and is additionally consistent with the intent of the
District in which the use of the proposed land is located. The continued use
of the parcel in question is a residence and would be compatible with the
existing surrounding land uses as this is in fact has been the use in the
past.
A copy of the proposed deed from Mrs. Zupke, as has already
been signed, will be filed of record if the recorded exemption is allowed
and is attached hereto and incorporated herein by reference. This deed
establishes that the applicant has an interest in the property.
Finally, a sketch and plan of the property on a suitable scale
is also provided for your approval. The boundry lines that will be utilized
are indicated by a dark black line.
If you have any questions, please don't hesitate to call.

RE: Referrals submitted to the City of Evans for review and rec-
ommendation.
To whom it may concern:
At the regularly scheduled meeting of the Evans Planning and
Zoning Commission, on April 24, 1984, the subject referrals were
reviewed. Following are the recommendations of the commission of each
referral by case number:
S-232:84:4 - Preliminary plan Mobile Home Park Subdivision requested
by Roy Lundvall.
RECOMMENDATION: approval with a request that the subdivision
be developed in accordance with City of Evans
regulations as the property is within our
potential growth area in the next five years
RE 679 - Recorded Exemption requested by Hazel L. Zupke
RECOMMENDATION: Approval., This, property lies tside of our
preliminary master plan area, ut would be a
"coth"iatable use for the atee. gh the City of Evans.
BOA 860 - Setback variance requested by Ralph Rodman
RECOMMENDATION: This property is in the immediate growth area
of the City and therefore we recommend a mini-
mum setback of fifteen (15) feet in lieu of
the twelve (12) feet requested, as this would
provide conformance with the Evans Zoning Reg-
ulations at such time as the porperty may be
annexed.
USR 629 - Use by special review requested by Steven Sears.
RECOMMENDATION: Approval. This property lies within our pre-
liminary master plan area and the proposed use

•
appears compatable with the plan for the area.
USR 628 and RE 681 - Use by special review and recorded exemption
requested by Harold and Judy Elam
RECOMMENDATION: Approval of both requests. Since both requests
involve the same property they were reviewed
together. This property lies outside of our
preliminary master plan area, but appears
to be compatable with the area and the City of
Evans.
